A regular meeting of the Santa Monica city Council was called to
order by Mayor Abdo at 7:40 P.M., on Tuesday, July 23, 1991, in
the Council Chambers.

At 7: 42 P.M., a City Council/Housing Authority Special Joint
Meeting was convened.

HA-1: MINUTES APPROVAL: Chair Pro Tempore Genser moved to
approve the Housing Authority minutes of June 25, 1991, as
presented. Second by Authority Member Holbrook. Discussion was
held. Authority Member Vazquez moved a substitute motion to
amend the motion to continue the approval of the minutes to the
meeting of August 6, 1991. The motion was duly seconded and was
unanimously approved.

Member Holbrook declared a conflict of interest and removed

certificates. Councilmember Katz moved to adopt Resolution No.
47 (HAS) entitled: lIA RESOLUTION OF THE HOUSING AUTHORITY OF THE
CITY OF SANTA MONICA APPROVING THE SUBMISSION OF AN APPLICATION
FOR 72 HOUSING ASSISTANCE VOUCHERS/CERTIFICATES, 1I reading by
title only and waiving further reading thereof. Second by Chair
Pro Tempore Genser. The motion was approved by the following

whereby all items are considered and approved in one motion
unless removed from the calendar for discussion. councilmember
Zane moved to approve the Consent Calendar, with the exception of
Item No. 6-D, reading resolutions and ordinances by title only
and waiving further reading thereof. Second by Mayor Pro Tempore

6-K: WEED AND RUBBISH ABATEMENT PROGRAM: The 1991 Weed and
Rubbish Abatement Assessment Roll was approved thereby confirming
the costs and assessments.
6-L: LOW-EMISSION TRANSIT COACHES: Bid No. 2360 was awarded to
TMCI, Inc. in the amount of $2,115,490 for ten low-emission
transit coaches for the Santa Monica Bus Lines.

6-D: HANDICAPPED PARKING: Presented was a resolution
establishing parking zones for the physically handicapped
adjacent to 1438 17th street and 1848 17th street. Councilmember
Katz moved to adopt Resolution No. 8261(CCS) entitled: "A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
ESTABLISHING PHYSICALLY HANDICAPPED ZONES ADJACENT TO 1438 17TH
STREET AND 1848 17TH STREET," reading by title only and waiving
further reading thereof. Second by Mayor Pro Tempore Genser.
The motion was approved by the following vote:

Mayor Pro Tempore Genser moved to consider Item No. 7-A and Item I
No. 7-B concurrently. Second by Councilmember Holbrook.
Discussion was held. Mayor Pro Tempore Genser withdrew his
motion.
7-A: APPEAL/CUP 90-012/CONDOMINIUMS/113S-1144 YALE STREET:
Presented was the appeal of two Planning Commission conditions of
approval (No. 15 and No. 39) for Conditional Use Permit 91-012 to
permit the construction of an 8-unit condominium project at 1138-
1144 Yale street. Applicant/Appellant: stark Family Trust.
(The pUblic hearing on the appeal was held on July 9, 1991. )
Mayor Pro Tempore Genser moved to affirm the decision of the
Planning Commission with the modification to delete Condition No.
15. Second by Councilmember Zane. The motion was approved by
the following vote:

7-5: APPEAL/CUP 91-013/CONDOMINIUMS/1142 18TH STREET: Presented
was the appeal of two Planning commission conditions of approval
(No. 13 and No. 34) for Conditional Use Permit 91-013 to permit
the construction of a 5-unit condominium project at 1142 18th
street. Applicant/Appellant: Henry Yarmark. (The public I
hearing on the appeal was held on July 9, 1991.) Council asked
questions of staff. Mayor Pro Tempore Genser moved to leave in
Condition No. 34 and delete Condition No. 13 and require that the
Planning Commission must approve plans which show that there is
no encroachment which exceeds 50% of the depth of the front yard.
Discussion was held. Second by Councilmember Olsen. Discussion
was held. Mayor Pro Tempore Genser withdrew his motion.
Councilmember Holbrook moved to deny the appeal of Condition No.
34 and uphold the appeal to delete Condition 13. Second by
Councilmember Zane. The motion was approved by the following

MONICA AMENDING SANTA MONICA MUNICIPAL CODE SECTIONS 61000, 61002
AND 61008, AND ADDING SECTION 61010 TO THE SANTA MONICA MUNICIPAL
CODE and "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA AMENDING SANTA MONICA MUNICIPAL CODE SECTION 6601 TO

Palisades Park. Council asked questions of staff. At 8:47 P.M.,
Mayor Abdo declared the public hearing open. Member of the
public Polly Benson-Brown spoke in opposition to tax increases
and in support of budget reductions. Member of the public Joy
Fullmer expressed her concerns. Members of the public Jack
Siegal, Dorothy Ehrhart-Morrison, Dino Nanni, Betty Griffin,
Nancy Lynch, Sherrie Laveroni, Sherry Kellogg, Monica Neumann,
Michelle NObriga and Beverly Moore spoke in opposition to an
increase in the Transient Occupancy Tax rate.
Councilmelllber Zane moved to hear the completion of Item 8-A,
Items 8-C, 8-0, S-E, 12-A, the "14" items, and the Closed Session
this evening, and continue Items 9-A and 13-A to the August 6,
1991, meeting. Second by councilmember Katz. The motion was
unanimously approved.

(RESUMED): Member of the pUblic Dick Lawrence spoke in
opposition to increasing taxes and in support of budget
reductions. Members of the public Bill Conaway, Michael HirSCh,
and Micky Ahmed spoke in opposition to increasing the Transient
Occupancy Tax rate. Member of the public Diane Simpson spoke in
support of reducing the number of transients rather than
increasing taxes. Member of the public Irma Vargas spoke in
opposi tion to the process employed by Council in the proposed
increase of taxes. Members of the pUblic Rod Delson and Patricia
o I Neill spoke in opposition to the proposed increase of the
Property Transfer Tax.
Councilmember Katz moved to extend the meeting to 12: 30 A.M.
Second by Mayor Pro Tempore Genser. The motion was unanimously
approved.
Member of the public Larry Arreola spoke in opposition to the
proposed increase of the Property Transfer Tax and in support of
budget reductions. Member of the pUblic Jerry Bass urged Council
to find methods to equally tax all who will benefit from
additional police officers. Members of the pUblic Margaret
Silbar and Andy Layman spoke in opposition to the proposed
increase of the Property Transfer Tax. Members of the public
Dale Coonse, Bill Worcester, Ernesto Carrillo, Rafael Igoa,
Daniel Gregory, Leigh Kavanaugh, Ilana Rosen, Jeannete Prudencia,
and Doris Vecchia spoke in opposition to the proposed increase of
the Transient Occupancy Tax rate. Member of the public Shane
Talbot spoke in support of the staff recommendation to fund
additional police officers. Member of the public Soheol
Sassoonian spoke in opposition to the proposed increase in
Transient Occupancy Tax and in support of budget reductions.

Councilmember Zane moved to extend the meeting to 1:00 A.M.
Second by Mayor Pro Tempore Genser. The motion was unanimously
approved.
Member of the public Bruce Cameron spoke in support of the
proposed increase in Property Transfer Tax with exemptions.
Member of the public Armando Lopez spoke in opposition to the
proposed increase in Transient Occupancy Tax. Member of the
public Paul Radomski spoke in support of the need of additional
police officers. Member of the public Art Casillas spoke in
support of the staff recommendation and made suggestions. Member
of the pUblic Stephen Alpert expressed his concerns. Member of
the pUblic Jacqueline Clark spoke in opposition to the proposed
increase of Property Transfer Tax. Member of the public Jacquie
Banks spoke in opposition to the proposed tax increases and in
support of budget reductions. Member of the public Haney Sabongy
spoke in opposition to the proposed increase in Transient
Occupancy Tax. Member of the public Neil Gluck spoke in
opposition to the proposed increase in Property Transfer Tax.
Mayor Abdo closed the public hearing at 12:17 A.M.
Councilmember Katz moved to direct staff to review possible
budget reductions with Council and in conjunction therewith
consider the property Transfer Tax to determine its necessity.
Second by Councilmember Holbrook. Councilmember Zane moved a
substitute motion to adopt the staff recommendtion to introduce
an ordinance increasing the Property Transfer Tax to $3.14 per
$1,000, as amended by the City Attorney with the addition of the
following sentence to the end of section 61001: IIprior to
September 15, 1991, the tax at the rate of fifty-five cents
($0.55) for each $1,000.00 of property sale value or fractional
part thereof shall remain in effect. II Second by Councilmember
Vazquez. Discussion was held. Mayor Pro Tempore Genser moved to
amend the motion to delay the implementation date to October 15,
1991; reduce the amount of Property Transfer Tax to $3 per $1,000
instead of $3.14; and, exempt TORCA, historic landmarks, and low
income properties. Councilmember Zane accepted as friendly the
amendment to reduce the amount to $3. Councilmember Zane moved
to extend the meeting to 1:30 A.M. Second by Mayor Pro Tempore
Genser. The motion was approved, Councilmember Holbrook opposed.
Discussion was held. Mayor Pro Tempore Genser moved to amend the
motion to delay the implementation date to October 15, 1991-
Second by Mayor Abdo. Councilmember Zane accepted the amendment
as friendly. Discussion continued. The substi tute motion was
approved by the following vote:

Councilmember Katz requested that the record reflect that the
only reason that he voted uno" on this item is that he still I
believes that it would be prudent to review the budget for any
possible reductions even though it would not delay the hiring of
any police officers.

Councilmember Zane moved to amend the FY1991-92 budget to reflect
additional revenues of $1. 3 million and a $1. 3 million capital
expenditure for improvements to Palisades Park. Second by Mayor
Abdo. The motion was approved by the following vote:

Councilmember Zane moved to authorize the City Manager to
negotiate and execute an agreement (Contract No. 5743(CCS)) with
Los Angeles County to collect the city's Real Property Tax
receipts. Second by Mayor Abdo. The motion was approved by the
following vote:

By virtue of the above action, the ordinance entitled: "AN

CODE," was introduced for first reading by title only and waiving
further reading thereof.
No action was taken on the Ordinance to increase the transcient
occupancy tax.
Mayor Pro Tempore Genser moved to extend the meeting to 1:45 A.M.
The motion was duly seconded and unanimously approved.
CLOSED SESSION: At 1:05 A.M., Council adjourned to Closed
Session. At 1:40 A.M, Council reconvened with all members
present, except Councilmember Katz.
Mayor Pro Tempore Genser moved to consolidate Item Nos. 8-B, 8-C,
8-D, and 8-E. The motion died for lack of a second.
8-8: PREFERENTIAL PARKING ZONE U: Presented was an ordinance
for adoption and second reading adding section 3238U to the Santa
Monica Municipal Code to establish Preferential Parking Zone U on
California Avenue between 17th Street and 20th Street.
Councilmember Zane moved to adopt Ordinance No. 1591(CCS)
entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA

9-A: OUTDOOR DINING GUIDELINES: The recommendation to approve
Ocean Avenue and Third street Promenade Outdoor Dining Guidelines
and authorization for the City Manager to negotiate and execute
outdoor dining license agreements with restaurant operators and
direction to staff to prepare citywide outdoor Dining Guidelines
was continued to the meeting of August 6, 1991.
9-B: CLOSED SESSION: Councilmember Vazquez moved to approve the
written settlement agreement (Contract No. 5744(CCS) in the case
of Diaz v. Jalili, et al. The motion was duly seconded and was
approved by the following vote:

12-A: MEMORANDUM OF UNDERSTANDING/POLICE OFFICERS' ASSOCIATION:
Mayor Pro Tempore Genser moved to approve Contract No. 5745 and
adopt Resolution No. 8268 entitled: uA RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF SANTA MONICA AUTHORIZING THE CITY MANAGER
TO EXECUTE A MEMORANDUM OF UNDERSTANDING WITH SANTA MONICA POLICE
OFFICERS' ASSOCIATION" reading by title only and waiving further
reading thereof. Second by Councilmember Olsen. The motion was
approved by the following vote:

13-A: GANDHI STATUE: The request of Louise Gabriel, President,
Santa Monica Historical society, to address Council regarding
reconsideration of the placement of the Gandhi statue in
Palisades Park was continued to the meeting of August 6, 1991.
By council consent the meeting was extended to 2:00 A.M.
14-A: APPOINTMENTS/BOARDS & COMMISSION: Mayor Abdo opened the
floor to nominations to fill the vacancy on the Social Services
Commission. Councilmember Vazquez moved to appoint Carol Rowe by
acclamation to the Social services commission for a term ending
June 3D, 1993. The motion was unanimously approved.
Mayor Abdo opened the floor to nominations to fill the vacancy on
the Convention and Visitors Bureau. Councilmember Katz moved to
appoint Kim Karie by acclamation to the Convention and Visitors

l4-B: AMPLIFIED SOUND/PROMENADE AND PIER: Presented was
Councilmember Zane' s request to discuss the use of amplified
sound by performers on the Promenade and the Pier. Councilmember
Zane moved to ask the City Manager to issue a directive to the
Police Department to vigorously enforce the prohibition of
amplification on the Promenade and pier if it can be heard
indoors. Second by Councilmember Katz. The motion was
unanimously approved.

14-C: REWARD FUND FOR INFORMATION REGARDING HATE LETTERS:
Presented was Mayor Abdo' s request to discuss creation of a
reward fund for information leading to the arrest and conviction I
of the person writing "Hate Letters" to santa Monica High School
parents. Mayor Abdo moved to offer a $5,000 reward from the City
Council Discretionary Fund. Second by Mayor Pro Tempore Genser.
Councilmember Vazquez moved to amend the motion to include a
request for a written report from the Police Department and the
Postal Service with regard to the results of the investigation of
this matter without compromising the investigation itself. The
amendment was accepted as friendly. Discussion was held. The
motion was unanimously approved.
~4-D: BFI/MATERIALS RECOVERY FACILITY: Presented was
Councilmembers Katz and Olsen's request to discuss approval to
use travel funds to make a site visit to the BFI, Materials
Recovery Facility on August 17, 1991. Mayor Pro Tempore Genser
moved to approve the use of travel funds-to make a site visit to
the BFI, Materials Recovery Facility. Second by Mayor Abdo. The
motion was unanimously approved.
