CITY COUNCIL MINUTES
AUGUST 22, 1991
A special meeting of the Santa Monica city Council was called to
order by Mayor Abdo at 6:15 P.M., on Thursday, August 22, 1991,
in the Council Chambers.
Roll Call: Present: Mayor Judy Abdo
Mayor Pro Tempore Ken Genser
Councilmember Robert T. Holbrook
councilmember Kelly Olsen
Councilmember Antonio Vazquez
Councilmember Dennis Zane
Absent: Councilmember Herbert Katz
Also Present: City Manager John Jalili
city Attorney Robert M. Myers
Assistant City Clerk Beth J. Holmes
Councilmember Holbrook led the assemblage in the Pledge of
Allegiance to the Flag of the United States of America.
Presented was an emergency ordinance for introduction and
adoption adding Section 6291 to Chapter 2A of Article VI of the
Santa Monica Municipal Code to establish street performance
regulations for the Third Street Promenade and surrounding areas.
Councilmember Zane moved to hear members of the public for one
minute each. Second by Councilmember Holbrook. The motion was
approved, Councilmember Olsen opposed, Councilmember Katz absent.
Councilmember olsen requested that the record reflect that he
voted "no" on this motion as he wanted members of the public to
be able to speak for two minutes each. At 6:20 P.M., Mayor Abdo
declared the public hearing open. Member of the public Beloved
Quail offered suggestions for amendments to the ordinance.
Members of the public Hanna Hartnell, Young Moon, Roger Genser,
Mathew Cooper, and Jerry Rubin spoke in support of the proposed
ordinance. Member of the public Susan Emann spoke in support of
the ordinance with amendments. Member of the public Sean Hanes
submitted a proposal for self-regulation by entertainers. Member
of the public Russ Taylor asked for clarification of various
points of the ordinance. Councilmember Vazquez moved to hear a
late chit. Second by Councilmember Olsen The motion was
unanimously approved, Councilmember Katz absent. Member of the
public Mickey O'Connor spoke in support of the proposal submitted
by Sean Hanes, above. Mayor Abdo closed the public hearing at
6:47 P.M. Mayor Pro Tempore Genser moved to introduce and adopt
Ordinance No. 1597 (CCS) entitled: "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF SANTA MONICA ADDING SECTION 6291 TO
CHAPTER 2A OF ARTICLE VI OF THE SANTA MONICA MUNICIPAL CODE TO
ESTABLISH STREET PERFORMANCE REGULATIONS FOR THE THIRD STREET
PROMENADE AND SURROUNDING AREAS AND DECLARING AN EMERGENCY,"

reading by title only and waiving further reading thereof.
Second by Councilmember Vazquez. Councilmember Zane moved to
amend the motion to include language to allow for performances to I
occur throughout the afternoon on Saturdays and Sundays rather
than the break from 2: 00 P. M. to 5: 00 P . M. The amendment was
accepted as friendly. Discussion was held. The motion was
approved by the fOllowing vote:
council vote: Affirmative: councilmembers Genser, Holbrook,
Vazquez, Zane, Mayor Abdo
Negative: Councilmember Olsen
Absent: Councilmember Katz
Councilmember Olsen requested that the record reflect that he
voted "no" on this item because he feels that this meeting was
held too soon, with too little notice, and at the last meeting he
told merchants and people that he had concerns and for him to
change his vote when he voted against it at the last meeting
would be dishonest to the people to whom he made a commitment.
ADJOURNMENT: At 7:15 P.M., the meeting was adjourned.
