M-9/16/1991 60 CITY OF SANTA MONICA CITY COUNCIL MINUTES I SEPTEMBER 16, 1991 A special meeting of the santa Monica City council was called to order by Mayor Abdo at 9:15 P.M., on Monday, September 16, 1991, in the Council Chambers. Roll Call: Present: Mayor Judy Abdo Mayor Pro Tempore Ken Genser Counci1member Robert T. Holbrook Councilmember Herbert Katz Councilmember Kelly Olsen Councilmember Antonio vazquez (arrived at 9:20 P.M.) Councilmember Dennis Zane Also Present: City Manaqer John Jalili City Attorney Robert M. Myers city Clerk Clarice E. Dykhouse Councilmernber Genser led the assemblage in the Pledge of Allegiance to the Flag of the united states of America. SB 402, SECTION 26 REGARDING 415 PACIFIC COAST HIGHWAY: I Presented was a resolution in opposition to the taking of any action with respect to provisions added by the California Legislature to the State Budget (and any related legislation) pertaining to 415 Pacific Coast Highway or the City's operating agreement with the state of California for the state Beaches wi thin Santa Monica. councilmember Zane moved to hear from the public for two minutes each. Second by Mayor Pro Tempore Genser. The motion was unanimously approved. Members of the pUblic Julie Lopez Dad, Bob Seldon, Bruce Cameron, John Bodin, Joy Fullmer, Art Casillas, Geraldine Moyle and stephen Alpert spoke in support of adopting a resolution or motion in opposition to such action by the California Legislature. Member of the public Don Brandsen spoke in opposition to the City's sixty-year beach concession agreement. Councilmember Katz moved to hear a late speaker. Second by Mayor Pro Tempore Genser. The motion was unanimously carried. Member of the public Sharon Jaquith spoke in opposition to the proposed legislation. Councilmember Katz moved to approve Resolution No. 8296(CCS) entitled: "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA OPPOSING SECTION 26 OF SB 402 AS IT RELATES TO 415 PACIFIC COAST HIGHWAY, URGING ITS VETO AND DIRECTING THE CITY MANAGER TO TAKE ALL NECESSARY IMPLEMENTING MEASURES," reading by title only and waiving further reading thereof. Second by Councilmember Vazquez. Discussion followed. Mayor Pro Tempore Genser asked for clarification of the motion and whether it included the other items listed on the I agenda, which authorized expending money to oppose such legislation, authorizing travel by members of the City Council and city staff and providing direction to the city's lobbyist. 1 September 16, 1991 I I I 61 Councilmember Katz stated those actions were included in his motion. Councilmember Holbrook moved to amend the motion to include, as a top priority of business, a meeting with the Governor. The motion was accepted as friendly. Discussion followed. Mayor Abdo moved to amend the motion to include a request of the Council to meet with Senator Presley to discuss the 26 page document and ask for clarification of parts of the document that are not altogether clear. The motion was accepted as friendly. Discussion followed. Councilmember Zane moved to amend the motion to allow the City to send a delegation to the Governor I s off ice that would include community members, and in particular, some of the community members who participated in the organizing effort, both against this particular project, and also the notion of beach front hotels, so the Governor can have an appreciation for what the non-politicians in the community think and feel about this legislation, and to grant staff the license to hire community organizers who can help in the development of a campaign effort to generate as clear and loud an expression of the City's indignation as possible. The motion was accepted as friendly by the maker of the second. Discussion followed. Councilmember Zane stated that he would like his motion to reflect that the City be authorized to publicize the phone numbers and address of the Governor to encourage a write-in campaign. Discussion followed. Mayor Abdo summed up the motion to reflect: (1) the Council is adopting Resolution 8296 to oppose section 26 of SB 402 as it relates to 415 Pacific Coast Highway, and any related legislation; (2) the Council is authorizing the City Manager to expend money to oppose this legislation in ways that he see fits and is authorizing travel by members of the City Council and City staff, if that's necessary, to go to Sacramento for meetings; (4) that Council is planning direction to the city's lobbyist to work against this division; (5) that two letters are sent, one from staff and one from the Mayor, requesting a meeting wi th the Governor wi th regard to this legislation; (6) that Councilmembers will request a meeting with Senator Presley to discuss the 26 page document; (7) that the City send a delegation to Sacramento, which will include community members: (8) that the City will hire organizers to generate support for the City's position, (9) that council expects communication with the public about how to contact the Governor; and (10) that the City make an attempt to communicate with the Press tonight about how they might want to handle this matter.
