M-6/7/1993 I I I ..LU..L CITY OF SANTA MONICA CITY COUNCIL MINUTES JUNE 7, 1993 A special meeting of the Santa Monica City CounC11 was called to order by Mayor Abdo at 6:40 P.M. on Monday, June 7, 1993, in the Council Chambers. Roll Call: Present: Mayor Judy Abdo Councilmember Ken Genser Councllmember Robert Holbrook Councilmember Kelly Olsen Councllmember Asha Greenberg Councilmember Paul Rosensteln Mayor Pro Tempore Antonio Vazquez Also Present: Clty Manager John Jalili Acting City Attorney Joe Lawrence Clty Clerk Clarlce E. Dykhouse CLOSED SESSION: At 6: 4 0 P. M. , Council adj ourned to Closed Session for the purpose of conslderlng personnel matters. At 7.35 P.M. Council reconvened No action was taken. 1993-94 BUDGET STUDY SESSION: Presented was a budget overview and discussion on revenues for the 1993-94 budget wlth presentations and discussion of budget proposals by the following departments: Clty Councll, City Manager, City Clerk, Clty Attorney and Finance. 14-A: REGULATION OF CITY PARKS: Councllmember Olsen presented his request to discuss direction to the Clty Attorney to prepare an ordinance that would regulate the hours of operation of Santa Monlca City Parks. Councilmember Olsen moved to direct the City Attorney to prepare either one or two ordinance{s), based on his advlce, but definltely for Palisades Park with the possibillty of inclusion of other parks, relating to thelr closure between the hours of 12: 00 Midnight and 5: 00 AM, and include a one-year sunset clause. Second by Councllmember Genser. Discussion was held. Mayor Pro Tern Vazquez moved a substltute motion to remand this ltem to the Parks and Recreation Commlssion for the study of other parks and return with recommendatlons. Second by Mayor Abdo. Discussion was held. The substitute motlon falled by the followlng vote: Councll vote Affirmative: CounCllmember Vazquez, Mayor Abdo Negative: Councilmembers Genser, Greenberg, Holbrook, Olsen, Rosenstein Councilmember Holbrook moved to amend the motlon that this item - 1 - 102 be prepared as an emergency ordinance The motion was accepted as friendly Councilmember Rosenstein moved to amend the motion I that staff respond to questlons which have been ralsed and which may be raised ln the intervenlng perlod in regard to thlS ordinance so that as much thought as possible can be given to the impllcatlons of these ordinances, what may be expected from them, and what to be concerned about. The motion was accepted as friendly. Discusslon was held. Councilmember Greenberq moved to amend the motlon to include a definltlon of park in the ordinance. The motion was accepted as friendly. Dlscussion was held. Councilmember Rosensteln moved to amend the motion to direct the Clty Attorney to prepare an ordinance to close palisades Park between the hours of 12:00 Midnight and 5:00 A.M., and request staff to return with an analysls as to the effects of both the closure of palisades Park as well as the closure of other parks in the Clty. The amendment was not accepted as frlendly and dled for lack of a second. Discussion was held. The main motion was approved by the following vote: Councll vote: Afflrmatlve: Councilrnembers Genser, Greenberg, Holbrook, Olsen, Rosensteln Negative: Councilmember Vazquez, Mayor Abdo Mayor Pro Tern Vazquez requested that the record reflect that he voted "no" on thlS item because he feels that setting policy based on a hunch rather than actual data supportlng the policy is I wrong. Mayor Abdo requested that the record reflect that she voted II no" on thlS item because she feels that this ordinance does not specifically address drug deallng, lt addresses everyone: those who are law-abldlng, homeless or housed, and it does not necessarily make it any easier to arrest anyone for drug deallng or drug uSlng.
