M-4/3/1990 76 CITY OF SANTA MONICA ADJOURNED CITY COUNCIL MINUTES APRIL 3, 1990 An adjourned meeting of the Santa Monica City council was called to order by Mayor Zane at 7:39 P.M., on Tuesday, April 3, 1990, in the Council Chambers. Roll Call: Present: Mayor Dennis Zane Mayor Pro Tempore David B. Finkel Councilmember Judy Abdo councilmember Ken Genser (arrived at 7:41 P.M.) councilmember William H. Jennings (arrived at 7:44 P.M.) Councilmember Herbert Katz Absent: Councilmember Christine E. Reed Also Present: City Manager John Jalili Assistant City Attorney Joseph Lawrence City Clerk Clarice E. Johnsen Councilmember Katz led the assemblage in the Pledge of Allegiance to the Flag of the United States of America. 7-C: AMENDMENT TO HOUSING ELEMENT: Presented was a continued public hearing on the proposed amendment to the Housing Element, continued from March 27, 1990. Councilmember Katz moved to hear speakers wishing to address Council regarding this item. Second by Councilmember Genser. The motion was unanimously approved I Councilmembers Jennings and Reed absent. At 7: 43 P.M., Mayor Zane declared the public hearing opened. Councilmember Jennings entered the Council chambers. Member of the pUblic Joy Fullmer expressed her concerns regarding singleperson housing. There being no one else wishing to speak, Mayor Zane closed the public hearing at 7: 46 P.M. Mayor Pro Tempore Finkel moved to adopt Resolution No. SOOl(CCS) entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT ON THE HOUSING ELEMENT OF THE GENERAL PLAN," reading by title only and waiving further reading thereof. Second by Councilmember Ganser. Discussion was held. The motion was approved by the following vote: Council vote: Affirmative: Councilmembers Abdo, Finkel, Genser, Mayor Zane Negative: Councilmembers Jennings, Katz Absent: Councilmember Reed councilmember Jennings requested the record to reflect that he voted II noli on this item as he does not feel that the 1 April 3, 1990 77 Environmental Impact Report adequately addresses the impact of the Ellis Act as it relates to the Housing Element in light the existing background of what is happening with Santa Monica housing. Councilmember Katz requested the record to reflect that he voted "no" on this item for the same reasons as expressed by Councilmember Jennings. Mayor Pro Tem Finkel moved to approve the proposed Housing Element, including the recommended additions contained in Exhibit "B", and transmit the document to the State Department of Housing and Community Development for final review and comment, as supplemented by the changes proposed by councilmember Genser. Second by councilmember Abdo. Discussion was held. Mayor Pro Tem Finkel moved to amend the motion, to insert the word II revenue " in front of the word "bond" on line 3 of addition #5 of the supplement. The motion was accepted as friendly by Councilmember Abdo. Councilmember Katz initiated discussion regarding the incorporation of family-oriented units, with courts, as a part of the normal development of multiple housing units (both apartments and condominiums) and the requirement that a certain percentage of units be barrier-free (Item 14-J). Councilmember Katz moved to amend the motion to address family-oriented units and barrier-free units as design standards in the Zoning Ordinance and to delete density bonuses for family-oriented units. The motion died for lack of a second. Mayor Pro Tem Finkel moved to amend his motion to indicate that all staff recommended changes, as included in the staff report and orally presented at the meeting of March 23rd, are to be reflected in the motion. The amendment was accepted as friendly. Discussion was held. Mayor Zane moved to amend the motion to add the phrase "and until the vacancy rate is 5%, excluding units voluntarily withheld from the market" to the condition prohibiting the conversion of existing rentals to condominiums or cooperatives until the supply of rental housing is equal to the pre-1978 number of units. The motion was accepted as friendly. The motion as amended was approved by the following vote: 2 April 3, 1990 Its Council vote: Affirmative: Councilmembers Abdo, Finkel, Genser, Jennings, Katz, Mayor Zane Absent: councilmember Reed 8-B: INCLUSIONARY HOUSING PROGRAM: Presented was a staff report and a public hearing on an ordinance for introduction and first reading amending Santa Monica Municipal Code Sections 9420, 9421, 9422, 9423, 9424, 9427, 9428, and 9429 relating to the Inclusionary Housing program. Council asked questions of staff. Councilmember Jennings moved to table this ordinance until an initial environmental assessment is provided by staff. Second by Councilmember Katz. The motion failed, councilmembers Abdo, Finkel, and Genser opposed. Discussion was held. Council asked questions of staff. At 9:20 P.M., Mayor Zane declared the public hearing open. Member of the public Mathew Millen spoke in opposition to in-lieu fees and in support of requiring inclusionary housing on-site. Member of the public Joy Fullmer expressed her concern. Members of the public Scott Rutherford, Jacquie Banks, Nathan Pratt, Rosario Perry, Claudia Harrington, R. J. Garrett, Evelyn Salem, Leah Mendelsohn, Carolyn Guillot, Tom Miller, selivestr Savarovsky, Ira Sarvian, and Mehrdad Farivar spoke in opposition to an increase in fees. Member of the public stewart Rubin spoke in opposition to an increase in fees and other changes to program 12. Member of the public Joe Palazzolo spoke in opposition to the proposed changes. Member of the public Cathy Weremiuk spoke in support of an increase in percentage of inclusionary units and in-lieu fees. Member of the public Tom Nitti spoke of his concerns with the noticing procedure with regard to this ordinance. Councilmember Katz moved to hear late speakers. Second by Mayor Pro Tempore Finkel. The motion was unanimously approved, Councilmember Reed absent. Member of the public Suzanne Abrescia spoke in favor of an increase in fees and inclusionary units. Member of the public Norman Teufel spoke in opposition to an increase in fees. At 10:10 P.M., Council adjourned for a short recess. At 10:35 P.M., Council reconvened with all members present, except Councilmember Reed. Counci1memher Abdo moved to close the public hearing and continue the item to the meeting of April 17, 1990. Second by Councilmember Ganser. Discussion was held. Councilmember Katz moved a substitute motion to continue the item and re-open the public hearing for members of the public who have not had an opportunity to speak. Second by Councilmember Jennings. Discussion was held. The substitute motion failed by the following vote: Council vote: Affirmative: Councilmembers Jennings, Katz Negative: Councilmembers Abdo, Finkel, Genser, Mayor Zane 3 April 3, 1990 79 Absent: Councilmember Reed The main motion was approved by the following vote: Council vote: Affirmative: Councilmembers Abdo, Finkel, Genser, Jennings, Katz, Mayor Zane Absent: Councilmember Reed l4-B: CONDOMINIUM TAX: Presented was the request of Mayor Zane to discuss increasing the condominium tax. Mayor Zane moved to direct staff to examine increasing the condominium tax and return with recommendations. Second by Councilmember Genser. Discussion was held. Mayor Zane moved to amend the motion that this item be considered the first meeting after April 17th. Second by Mayor Pro Tempore Finkel. The motion was unanimously approved, Councilmember Reed absent. l4-C: HOUSING AND PARK FEES: Presented was the request of Mayor Zane to discuss increasing housing and park fees on commercial development. Mayor Zane moved to direct staff to examine this issue and return with recommendations. Second by Councilmember Genser. Discussion was held. Councilmember Genser moved to extend the meeting to 11: 30 P.M. Second by Councilmember Katz. The motion was unanimously approved, Councilmember Reed absent. The motion was approved, Councilmembers Jennings and Katz opposed, councilmember Reed absent. 14-0: CITY COUNCIL RULES AND PROCEDURES: Zane to discuss changes in City Council directed at streamlining council meetings next regular Council meeting. The request of Mayor rules and procedures was continued to the l4-E: EMERGENCY NEEDS DURING EARTHQUAKES: Presented was the request of Mayor Zane to discuss cooperative efforts with other California cities to meet emergency needs during earthquakes. Mayor Zane moved to authorize the City Manager to explore the development of cooperative arrangements with other communities. Second by Councilmember Katz. Discussion was held. The motion was unanimously approved, Councilmember Reed absent. l4-J: FAMILY-ORIENTED HOUSING UNITS: The request of Councilmember Katz to discuss the incorporation of family oriented units, with courts, as a part of the normal development of multiple units (both apartments and condominiums) and the requirement that a certain percentage of units be barrier-free was considered with Item 7-C. Mayor Pro Tempore Finkel moved to extend the meeting to 11: 45 P.M. The motion was duly seconded and approved. 15. PUBLIC INPUT: Member of the public Joy Fullmer expressed her concerns regarding discrimination against singles and 4 April 3, 1990 80 pornography. Member of the public Archie Arzooyan addressed council regarding the reduction of the amount of rentals available in Santa Monica in comparison with the percentage of tenants in the population. Mr. Arzooyan stated his support of vacancy decontrol. Member of the public Nathan Pratt addressed Council in support of family-oriented housing. CLOSED SESSION: Council adjourned to Closed Session for the purpose of discussing personnel matters and threatened litigation, pending litigation, and the following real estate transaction to be commenced by the City: Purchase by city of Santa Monica of the c.w. Cook property, located on the north side of Pico Boulevard between 21st and 22nd Streets and adjacent to Virginia Parkr within the city of Santa Monica. The negotiator for the owners of the property is Paul Cook. At 11: 45 P.M., Council reconvened, councilmember Reed absent. Mayor Zane announced that no action was taken in Closed Session.
