RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF SANTA MONICA, CALIFORNIA, ADOPTING GUIDELINES AND PROCEDURES FOR IMPLEMENTATION OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT OF 1970 AND THE REGULATIONS OF THE STATE RESOURCES AGENCY. WHEREAS, the Redevelopment Agency IS required to adopt guidelines and procedures for Implementation of the Cal ifornla Environmental Qual ity Act of 1970 and the regulations of the State Resources Agency adopted pursuant thereto. NOW, THEREFORE, THE REDEVELOPMENT AGENCY OF THE CITY OF SANTA MONICA, CALIFORNIA, hereby approves and adopts the guidel ines and procedures for implementation of the California Environmental Quality Act of 1970 and the regulations of the State Resources Agency adopted pursuant thereto, which Redevelopment AgeAcy gUidelines and procedures are attached hereto labeled ExhibIt "A" and incorporated herein by th I S reference. II. [5 200] DI.::FI1GTIONS Whenever the followlng terms are used In these Proce- dures, unless othen'ilse defl.ned, such terms shall have the meanlng ascrlbed to them 1n this Part 200. A. [~ 201] proJect ProJect means a Redevelopment Project belng carrled out by the Agency pursuant to the Callfornla COIT~unl.ty Redevelop- men t La..,. B. (~ 2021 EnVlYOnment EnVlron~ent means the physlcal co~dltlons WhlCh exist wlthin the area whlch wlll be af=ected by a proposed Project lncluding laad, alr, water, mlnerals, flo=a, fauna, a~lent nOlse, obJects of hls~or~c or aesthetlc slgnlflcance. c~ [5 203J Slgn~f2cant Effect Slgnlflcant effect means a substantial adverse lmpact on the enVlronment. [5 205] Inlt1al Study Inltlal study means a prellminary analysls prepared by the Agency to determlne whether a Subsequent EIR or a Negatlve Declaratlon must be prepared. - 2 - . . ~ . . F. [5 206J Subsequent EIR Subsequent EIR means the preparat10n and adopt~on of an add1t1onal EIR because of substantial changes proposed to be made 1n a Plan or lmplementatlon of a Plan Wh1Ch in- volves env1ronmental lrnpacts not consldered 1n the orlg1nal EIR which was prepared and adopted for a Project. G. [5 207J Negative Declaration Negatlve Declaratlon means the statement prepared by the Agency that finds that a proposed w~endment to a Rede- velopment Plan, if approved and adopted, wlll not have a signlflcant effect on the enVlronment and which includes a brlef statement of reasons to support the flndings and a brief descr1ption of the proposed ~~endment. H. [5 208] Notlce of Complet1on Notice of Completion means the statement filed w1th the Secretary of the Resources Agency of the State at such time as the Draft EIR is completed setting forth a brlef descrip- tlon of the Project, ltS proposed location, ~~d the address where copies of the Draft EIR are avallable. [~ 209} Not1ce of Determ1nation Notice of Determlnation means the state~ent flled with the County Clerk wlthln a reasonable tioe after the City CaUDell adopts or amends a Redevelopment Plan WhlCh glves notlce that the Agency wlll carry out a Project which 1S subJect to the requlrements of CEQA. III. [~300] EVALU.'1.TIO:.r OF SIGKIFICA:.'l'T ADVERSE Hi?ACT OF PROJECT ON ENVIRONMENT A. [~ 301] Cr~terla for Determinln~ Slgnlflcant Adverse Environ~ental Inpact The determination of whether a ProJect may have signi- ficant adverse effect on the environment shall be based on - 3 - . . ~ . . SClentlflC and factual data and shall reflect upon the nature and slgnlflcance of the actlvltles proposed in the Pla~. In maklng lts determlnation of the slgnlf1cant effect of the ProJect, the Agency staff shall use the fol- lowlng gU1del1nes: 1. If 1t 1S anL1Clpated that there 1S or may be a substantlal body of op1nlon that conslders a partlcular effect of the ProJect to be adverse in an enVlron- roental sense, the Agency staff shall prepare a Draft EIR to explore the en- vlronmental effects lnvolved. 2. In evaluatlng the slgnlf1cance of the envlronmental effect of the ProJect Agency staff shall conslder both prlnary and secondary consequences. Prlmary consequences are lmmedlately related to the Project, whlle secondary consequences are related l~ore to or occasloned by the prlmary consequences than to the Project 1tself. An lmpact U?O~ the resource base (includlng land, alr, water, and energy use) of the area In quest~on whleh ~ay result from the population growth lS an example of a secondary consequence. 3. Some examples of consequences WhlCh nay have a slgnlflcant effect on the enVlron- ~ent In connectlon wlth most proJec~s vlhe:...."e they occur, lnclude -the follO'.ang: (a) The Plan lS In conrllct Wlth enVlron- mental plans and goals that have been adopted by the Clty; (b) The Project wlll have a substant~al and demonstrable negat1ve aesthetlc effectj (c) The ProJect wlll subs~ant1ally affect a rare or endangered s2eciesj (d) The Project wlll breach any publlshed natlonal, state, or local standards relatlng to SOlld waste or lltter control; - 4 - . . ....... e( e: (e) Tne Project will cause substantlal lnterference wlth the movement of any resldent or illlgratory flSh or wlldllfe specles; (f) The ProJect wlll result ln a substan- tlal d8tri~ental effect on alr or \la ter quail ty, or on arrblen t nOlse levels for ad]Olnlng areaSj (g) The ProJect wlll involve the p05si- blllty of contamlnatlng a publlC water supply system or adversely affectlng ground water; (h) The ProJect could cause substantial floodlng, eroslon, or siltatlon; (i) The ProJect could expose people or structures to major geologlcal hazards. B. [5 302] M~ndatoryFindings of Slgniflcanc~ In every case wnere any of the followlng condltlons are found to eXlst as a result of the ProJect, such Project wlll be deemed to have a slgnlflcant effect on the enviro~~e~t: 1. Iinpacts \-lhlCh have the potentlal to de- grade the quallty of the enVlronnent or curtail the range of the envlronment. 2. Impacts uhich achleve short-term, to the dlsadvantage of long-term, environ- mental goals. A short-terM lwpact on the envl.ro;:1r.tent 1S one WhlCh occurs in a relatlvely brler, defin1tlve period of tlFe whlle long-tern lmpacts wlll en- dure well lnto tne futu~e. 3. Impacts WhlCh are lndi vl<iually lun ted, but cUiliula~lvely co~slderable. The ProJect ma.y If'1?act on two or more separate resources where the l~?act on each resource lS relatlvely small. If the effect of the total of these lffi?acts on the enVlronment lS slgnlflcant, an EIR must be prepared. - 5 - . . ~-- ( e' e 4. The envlronmental e~fects or the ProJect will cause substantlal adverse effects on hUMan belngsr either dlrectly or indlrectly. IV. [~ 400] PROCEDURES FOR PREPAP~TION ft~D ADOPTION OF EIR FOR NE~ pgDEVELOP~lliNT PROJECTS A. [5 401J General An EIR shall be prepared as part of the Report on the proposed Plan regulred to be submltted by the Agency to the City Council for any Plan on which a public hearing is set on or after the date of adoption of these Procedures. B. [5 402] Preparation and Adoptlon of EIR 1. [5 403J Draft EIR A Draft EIR shall be prepared at the ti8e the Agency staff is preparing the Plan. The Draft EIR shall conform to and contalD the informatlon specified In Sections 601 through 613. Before completlng the Draft ErR, the Agency shall consult dlrectly wlth any person or organizatlon it believes \vl.ll be concerned \,Ji th the enVlronmental effects of the PrOJect. 2. Notlce of Corrpletion [5 404J Prlor to presentlng the Draft EIR to the Agency Board for action, the Agency staff shall file a Notlce of C07ple- tlon wlth the Secretary of the Resources Agency of the State. 3. [~ 405] C'onsultatlon The Agency staff shall transmit copies of the Draft ErR to and shall consult wlth and obtaLn comnents on the Draft EIR from those publlC agencles WhlCh have jurisdlctlon by law with respect to the Project. In addltion, Agency staff may consult "nth persons or agencies ,.;hlCh have speclal exper- tise concernlng the environmental impact of t~e ProJect. If any agency or person who is consulted ,.Ti th regard to a Draft EIR falls to comment 'H thln 30 days after recelpt of a Hri t- ten request from the Agency to do so, it shall be assumed, absent a request for a speciflc extenslon of tlme, that such agency or person has no com~ent to make. 4. r~ 406J PubllC Hearing Any hearlng on a proposed Plan, which may be a ]Olnt hearlng on the Plan by the Agency Board and the City Councll, - 6 - . . - ( e' . shall also be a publlC hearing on the Draft EIR and all cor.ments received thereon and responses of the Agency thereto. The Notice of Public Hearlng on the proposed Plan shall refer to the avallability of the Draft EIR and the public hearing to be held on the Draft EIR. 5. Ui 407] Flnal EIR The Final EIR shall conslst of the Draft ErR; cow~ents received from those agencles or persons consulted or who othenvise commented on the Draft ErR either at the public hearing or by written CO~~Q~icatlon to the Agency; the re- sponses of the Agency to any significant environmental points raised in t~ose co~~ents; and the certiflcation of the Agency that the EIR has been conpleted in cOffi?liance with CEQA, the Regulations, and these Procedures, and that the Agency Board has revlewed and considered the informatlon contained ln the EIR. The Final EIR shall be adopted by G~e Agency Board prior to City Council actlon on the Plan. The City Council s~all adopt the EIR prior to or concurrently wlth lts adop- tion of the Plan. 6. Notlce of Determlnation [5 408] After the City Council has approved and adopted the Plan, a Notice of DeterMlnation shall be flIed ~lth the Clerk of the County. The Notice of Determination shall include (1) the action of the Clty Council ln approving and adopting the Redevelopment Plan, (2) tne determination of the Agency and ci ty Councll \'Thether the ProJect Hill or ;.,ill not have a slgnlflcant effect on the enVlronment, (3) a statement that an ErR has been prepared pursuant to the provlsions of CEQA for the Project, and adopted by the Agency Board and the City Council. 7. [5 409] Statement of Overridlng Conslderatlons--Redevelopnent Plan In the event the Agency and the Cl ty COUDCll approve and adopt a Redevelopnent Plan for which serlOUS adverse enVlrOD- mental consequences have been ldentlfled ln an ErR, the Agency may make statements identifying the other lnterests that warranted approval in lts point of Vlew. If such state~ents are made, they should be lncluded in the record of the appro- val of the Plan and May be attached to the Notice of Determlnation. - 7 - . . ~ -- e( e' v. [~ 500J SUBSEQUENT EIR'S OR NEGATIVE DECLA&\TIONS FOR PROPOSED PLAN AHEND:'lENTS OR SUBSTA...'JTIAL CHANGES IN PLAN IHPLENENTATION A. [~ 501] When to Pre~are Subsequent EIR Where an EIR has been prepared and adopted, a Subsequent EIR need not be prepared and adopted unless: (1) Substant~al changes are proposed to be made to the Plan WhlCh will requlre major revisions of the EIR due to the involvement of new environmental im- pacts not considered in the previous EIR. (2) There are substantlal changes wlth respect to the circumstances under which the Plan lS to be lmplemented which wlIl require waJor revlsions in the EIR due to the lnvolvement of new environmental lmpacts not covered In the previous EIR. B. [g 502] Procedures for Preparation and Adoption of Negatlve Declarat~ons or Subsequent EIR's. 1. [S 503] Inl.tial Study Prlor to holdlng a publlC hearlng on a proposed amend- ~ent to the Plan, the Agency staff shall conduct an Inltial Study to determlne If the proposed amendment may have a slgni- fI-cant effect on the envlronment. Tile Agency I s flndlngs shall be made ln the form of a wrltten report. Such study shall be made In accordance wlth the crlterl.a set forth l.TI Sectlons 301 and 302. The Inltial Study shall also consider whether or not the proposed awendment to the Plan requlres the preparation and adoptlon of a Subsequent EIR or the prep2ratlon of a Negatlve Declaratlon. If the Agency staff flnds that any of the effects of the proposed amendment may have a substantlal adverse impact on the environment (regardless of Hhether the overall effect of the proposed amendment l5 beneflc~al), or finds that a Subse- quent EIR lS requlred, then the Agency staff shall prepare a Draft EIR for the proposed amendment to the Plan. If the Agency staff flnds that there is no substantlal adverse lm- pact on the enVlronment as a result of the proposed arrendment, - 8 - . . ~ e e or If a Subsequent ErR lS not requlreo, then the Agency staff shall prepare a Negative Declaratlon for the proposed amendment. 2. [s 504] N~gatlve Declaratlon The Negatlve Declaratlon shall be prepared by the Agency staff for a proposed amendment to the Plan where requlred pursuant to Sectlon 503. The Negatlve Declaration shall be prepared prlor to any publlC hearing on the proposed a~end- ment and shall be part of the report and reconTendatlons on the proposed amendment to the Plan requlred to be scbmitted by the Agency to the Clty Council. The Negative Declaratlon shall include a brlef descrlptlon of the proposed amendment to the Plan, a findlng that the proposed amendment wlll not have a slgnificant effect on the envlronment, a brlef state- ment of reasons supportlng the flndlng, and a statement lndl- catlng who prepared the Initial Study and where a copy of lt may be obtained. The procedure for the preparatlon and adoptlon of the Negatlve Declaration shall be as set forth below. a. [~ 5051 FlIlng of Negatlve Declaratlon The Executive Dlrector ~s authorized to execute such Negatlve Declaratlon and shall then place caples of the Negative Declaratlon on file In the offlce of the Agency not less than 21 days prlor to a public hearlng on the pro- posed amen~~ent to the Plan. b. [S 506] PubllC Hearlng and ~otlce A pubI1C hearing is not requlred on a Negatlve Declara- tlon, however, the notlce of pubI1C hearlng on the proposed amendment shall lnclude reference to the flndlng and avall- ability to the publlC of the Negative Declaratlon. The publlC hearlng, WhlCh ~ay be a Joint publlC hearing by the Agency Board and the Clty Councllr on the proposed amendment to the Plan, may lnclude a publlc hearlng on the Negatlve Declaratlon. In the event a public hearlng 1S to be held on the ~egatlve Declaratlon, the notlce of public hearing on the proposed anen~~ent shall include reference to the flndlng of the Negatlve Declaratlon, the availablllty of the Negatlve Declaratlon, and the pubIle hearl~g to be held on the Negatlve Dec1aratlon. c. No amen~ent to a Plan shall be approved and adonted by the City Council unless and until a Negatlve Declaratlon or Subsequent EIR is adopted by the Agency Board. d. [S 508] Notice of Determlnatlon After Agency Board approval of the flnding of the Nega- tive Declaration and City Council act~on on the proposed amendment to the Plan, a Notice of Determinatlon (with a copy of Negative Declaration attached) shall be filed with the County Clerk. The Notice of Determlnation shall lnclude the determlnation by the Agency and the City Council that the amendment to the Plan will not have a signlf~cant effect on the environment, that the amend~ent has been approved or dlsapproved by the City Counell, and that no Subsequent EIR has been prepared. 3. [~ 509] Subsequent Draft ErR Plan A~end~ent The Draft EIR shall be prepared by the Agency staff for a proposed amendment to the Plan, where required pursuant to Section 503 or Section 507. Before completlon of the Draft EIR, the Agency shall consult directly wlth any person or organizatlon it belleves wlII be concerned with the enVlron- mental effects of the ProJect. If required pursuant to Sectlon 503, the Draft EIR shall be prepared by the Agency staff pr~or to any publl~ hearing on the proposed amendment. If requlred pursu~~t to Section 507, the Draft EIR shall be prepared by the Agency staff as soon as possible following Agency Board disapproval of the flnding of the Negatlve Declaration. In eit~er case, the Draft EIR shall be part of the report and recon~endations on the proposed amend~ent to the Plan required to be subrrutted by the Agency to the Clty Counell. The Draft EIR shall be wrltten in accordance ~ith the criterla set forth 2n Sect20ns 301 and 302 and shall conta~n the information speclfled in Sectlons 600 through 614.
