M-2/18/1992 188 CITY OF SANTA MONICA CITY COUNCIL MINUTES I FEBRUARY ~8, ~992 An adjourned meeting of the Santa Monica City council was called to order by Mayor Pro Tempore Abdo at 6 : ~4 P. M. on Tuesday, February 18, 1992, in the Council Chambers. Roll Call: Present: Mayor Pro Tempore Judy Abdo councilmember Robert T. Holbrook (Arrived during Closed Session) Councilmember Herbert Katz Councilmember Kelly Olsen (Arrived during Closed session) councilmember Antonio Vazquez councilmember Dennis Zane Absent: Mayor Ken Genser city Attorney Robert M. Myers City Clerk Clarice E. Dykhouse CLOSED SESSION: At 6:14 P.M., Council adjourned to Closed Session for the purpose of considering personnel matters. At 7:55 P.M., Council reconvened with all members present, except I Mayor Genser. At 8:10 P.M. Mayor Pro Tempore Abdo called the adjourned meeting to order. Also Present: Councilmember Holbrook led the assemblage in the Pledge of Allegiance to the Flag of the united states of America. Dykhouse a-A: INCLUSIONARY HOUSING PROGRAM: Presented was an ordinance for introduction and first reading amending Santa Monica Municipal Code Sections 9420 through 9433 relating to the inclusionary housing program. The Public Hearing was held on February II, 1992. Council asked questions of staff. I Councilmember Zane moved to introduce an ordinance entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING SANTA MONICA MUNICIPAL CODE SECTIONS 9420 THROUGH 9433 Also Present: 1 February 18, 1992 I I I 189 RELATING TO THE INCLUSIONARY HOUSING PROGRAM," for first reading by title only waiving further reading thereof with the following amendments: 1) the amendment recommended by staff with respect to section 9423(b), (page 16) is changed to read as follows: "The requirements of Section 9423 shall be met either by providing on site inclusionary units meeting the requirements of Section 9425, or by satisfying the requirements of 9426, if both of the following circumstances apply: It and section 9423 (b) (i) is changed to read as follows: "The project is not located on a site as described in subdivision (a) (i) of this section." 2) language in Section 9424 (a) (i) changed to read as follows: "The project is located on a site for which no category C removal permit was issued prior to February 18, 1992, (or issued after February 18, 1992, but applied for prior to February 18, 1992) and which the developed use on February 18, 1992, was mUlti-family housing and at least one dwelling unit was rented at levels affordable to households of moderate income levels or, if vacant on February 18, 1992, when last rented."; 3) language in Section 9424 (b) (i) on page 16 will be changed to read: "The proj ect is not on a site as described in subdivision (a) (i) of this section; 4) the rounding formula in the case of on-site requirement shall be set at .3 rather than any fraction. Second by Councilmember Vazquez. Discussion was held. The motion was approved by the following vote: Council vote: Affirmative: councilmembers Olsen, Vazquez, Zane, Mayor Pro Tempore Abdo Negative: councilmembers Holbrook, Katz Absent: Mayor Genser Councilmember Katz requested that the record reflect that he voted "no" on this item because there is a problem with adequate housing in the City and this ordinance will cut housing and will hurt it immensely--both affordable and market rate--because the on-site will cause problems. Further, this is a punitive ordinance geared toward stopping ownership. 8-B: MODIFICATION OF ZONING AND DEVELOPMENT STANDARDS: Presented was the emergency ordinance modifying zoning and development standards to facilitate shelters, transitional housing, and other affordable housing on an interim basis and resolution modifying planning, zoning and land use fees. Council asked questions of staff. At 9:57 P.M., Council adjourned for a short recess. reconvened at 10:18 P.M. with all members present. Council 8-B: (RESUMED): At 10:18 P.M., Mayor Pro Tempore Abdo declared the public hearing open. Members of the public Doris Ganga, Vivian Rothstein, and Geraldine Moyle spoke in support of the proposed ordinance. Members of the public Doug Brown, Mat Millen, Merritt Coleman, Linda Provost, Duke Kelso, Peter Tigler, Art Casillas, Donna Alvarez, Michele Wittig, and Polly Benson Brown spoke in opposition to the proposed ordinance. Members of 2 February 18, 1992 190 the public Joy Fullmer and steve Alpert expressed their concerns. Member of the pUblic Beloved Quail made suggestions. councilmember Katz moved to hear a late speaker. The motion I failed due to lack of a second. councilmember Katz moved to extend the meeting to 11:30 P.M. The motion was duly seconded and carried. Mayor Pro Tempore Abdo closed the public hearing at 11:00 P.M. councilmember Zane moved to continue this item to the meeting of March 3, 1992. Second by Councilmember Vazquez. Councilmember Zane withdrew his motion. Discussion was held. Councilmember Katz moved to remand this conceptual ordinance to the Planning commission for review and public hearing to elicit input, and return to Council with results by the third week in March. Second by Councilmember Holbrook. Discussion was held. Councilmember Zane moved a substitute motion to continue this item to the meeting of March 3, 1992, as a Resolution of Intention to prepare an ordinance modifying zoning and development standards to facilitate shelters, transitional housing, and other affordable housing on an interim basis. Second by Councilmember Vazquez. Discussion was held. The substitute motion was approved by the following vote: Council vote: Affirmative: Councilmembers Holbrook, Katz, Olsen, Vazquez, Zane, Mayor Pro Tempore Abdo Absent: Mayor Genser 9-C: CLOSED SESSION: Not held. I 14-A: PICK-UP LOCATIONS/RECYCLABLE MATERIALS: Mayor Pro Tempore Abdo presented Mayor Genser's request to discuss pick-up locations for recyclable materials for householdS which currently have curbside or alley collection. Mayor Pro Tempore Abdo moved to direct staff to analyze the possible benefits and detriments of relocating some or all of the alley recyclable collection points to the curb and to report back with a recommendation on this issue for public hearing and future Council action. Second by councilmember Olsen. Discussion was held. The motion was unanimously approved, Mayor Genser absent. 15: PUBLIC INPUT: Member of the public Joy Fullmer expressed her concern with various problems related to zoning and development standards. Member of the public Beloved Quail discussed civil rights violations and services for the homeless. ADJOURNMENT: At 11:28 P.M., the meeting was adjourned to 7:30 P.M., March 3, 1992, in memory of Dr. William Weller.
