M-4/21/1992 232 CITY OF SANTA MONICA CITY COUNCIL MINUTES I APRIL 21, 1992 A regular meeting of the Santa Monica City Council was called to order by Mayor Genser at 7:35 P.M. on Tuesday, April 21, 1992, in the Council Chambers. Roll Call: Present: Mayor Ken Genser Mayor Pro Tempore Judy Abdo Councilmember Robert T. Holbrook Councilmember Herbert Katz (arrived at 7:41 P.M.) Councilmember Kelly Olsen councilmember Antonio Vazquez Councilmember Dennis Zane Also Present: City Manager John Jalili City Attorney Robert M. Myers City Clerk Clarice E. Dykhouse Councilmember Olsen led the asseThblage in the Pledge of Allegiance to the Flag of the United States of America. Mayor Pro Tempore Abdo moved to consolidate Item Nos. a-A, a-B, I and 10-A. Second by Councilmember Vazquez. The motion was unanimously approved. Mayor Genser moved to advance three young speakers in the speaking order. Second by Mayor Pro Tempore Abdo. The motion was unanimously approved. a-A: STANDARDS FOR LIGHTING: The ordinance for introduction and first reading amending Santa Monica Municipal Code section 9040.27 regarding standards for lighting was continued to the meeting of April 28, 1992. 8-B: PROPERTY DEVELOPMENT STANDARDS/RVC DISTRICT: The ordinance for introduction and first reading amending Santa Monica Municipal Code Section 9015.6 regarding property development standards in the RVC District was continued to the meeting of April 28, 1992. 9-A: CLOSED SESSION: Not held. 10-A: APPEAL/PLANNING COMMISSION APPROVAL/FINAL EIR 90-007/DR 91-006/RPP 91-008/Z0NING ORDINANCE TEXT AMENDMENTS 91-006 AND 91- 007/SANTA MONICA PIER: Presented was the public hearing on appeal of Planning Commission approval of Final EIR 90-007, DR 91-006, RPP 91-008 and Council consideration of zoning Ordinance I Text Amendments 91-006 and 91-007 for the proposed development on the Santa Monica Pier. Applicant: Santa Monica pier Restoration corporation. Appellant: Diane Simpson. Council asked questions 1 April 21, 1992 I I I 233 of staff. Member of the pier Restoration Corporation Board of Directors Ruth Goldway and John Gilchrist, Executive Director of the Pier Restoration Corporation, representing the applicant, spoke in support of the proposed development on the Santa Monica pier. Mayor Pro Tempore Abdo requested an opinion from the city Attorney with regard to a letter from Jeri Jackson which indicated that Mayor Pro Tempore Abdo and Councilmember Zane may have a conflict of interest on this item. City Attorney Myers stated he had read the letter and in his opinion there was not a conflict of interest. It was the City Attorney's opinion that there would not be a conflict of interest and that they could participate in the discussion and any decisions reached by the Councilmembers. Council asked questions of the applicant. Diane simpson, Leah Cavenaugh, and Graham Pope, speaking on behalf of the appellant, spoke in support of development of the pier, but in opposition to the inclusion of adult rides in the Fun Zone. At 9: 41 P.M., Mayor Genser declared the public hearing open. Mayor Pro Tempore Abdo moved to waive the rules and hear a wri tten statement by a child who had to leave the meeting. Second by Councilmember Vazquez. Discussion was held. The motion was approved, Councilmember Holbrook and Mayor Genser opposed and Councilmember Katz abstained. The written statement of Kristin Bowman in support of the proposed Fun Zone was read. Members of the public Peggy Fontenot and Cynthia Fontayne spoke in support of the proposed Fun Zone. Member of the public Denise Fast spoke in support of the pier restoration but in opposition to the roller coaster and ferris wheel in the Fun Zone. Member of the pUblic John Bodin spoke in opposition to the proposed Fun Zone. Member of the public Sharon Gilpin spoke in opposition to the certification of the EIR. Councilmember Vazquez moved to hear youth speakers, under the age of 18, before the break is taken. Second by Mayor Pro Tempore Abdo. The motion was unanimously approved. Members of the public Ron RiSCh, Rocky scotti, Alej andro Martinez, Kris Walker, Costa Karros, Alicia Gonzalez, and Manuel Lares spoke in support of the proposed Fun Zone. A petition with 730 signatures in support of the Fun Zone was presented to the Councilmembers by Alejandro Martinez. At 10: 28 P . M., Council adj ourned for a short recess. reconvened at 10:45 P.M. with all members present. Council Mayor Genser moved to extend the meeting to 1:00 A.M. The motion was duly seconded and approved, Councilmember Olsen abstained. Members of the public Suzanne Rabuchin, Chris Amos, Dayle Kerry, Joel Simpson, Morris Magid, Ron Magid, Mitchell Lachman, Donna Alvarez, Audre Slater, and Francesca Runza spoke in opposition to the proposed Fun Zone. Member of the public Jeri Jackson discussed conflicts of interest and other legal improprieties of certain councilmembers in participating in this decision. Member of the public Stephanie Barbanell discussed various aspects of the staff report and studies. Members of the public Brian Morgan, Elinor Morgan, Al Gesulga, Renee Ellis, Terry Goggin, Michael Breitner, Ernie Powell, Thaxter Trafton, and John Greer spoke in support of the proposed Fun Zone. Members of the public 2 April 21, 1992 234 Joe McKinsey, Marcel GeIsen, and Susan Morris spoke in opposition to the proposed project. Members of the public Jerry Shanberg, Paul Rosenstein, and Bruce Cameron spoke in support of the I proposed project. Member of the pUblic Sally Reinman discussed the history of the public process as it relates to this project and also spoke in opposition to the certification of the EIR. Member of the public Ron Rocco spoke in support of the development of the pier predicated on addressing the problems of gridlock, crime, and parking. Councilmember Zane moved to hear late speakers for two minutes each. The motion was duly seconded and unanimously approved. Member of the pUblic Helen Cho spoke in opposition to the proposed Fun Zone. John Gilchrist, representing the applicant, presented a rebuttal. Council asked questions of Mr. Gilchrist. Appellant Diane Simpson presented a rebuttal. council asked questions of Ms. Simpson. At 12:25 A.M., Mayor Genser closed the public hearing. Council asked questions of staff. Councilmember Katz moved to continue Item Nos. 8-A, 8-B, 10-A, and ll-A as "5" items at the meeting to be held on April 28, 1992. Second by Mayor Genser. The motion was unanimously approved. No action was taken on Item lO-A. This item was continued to the meeting of April 28, 1992. II-A: ALCOHOL POLICY/SANTA MONICA PIER: The recommendation to establish an alcohol policy for the Santa Monica Pier was continued to the meeting of April 28, 1992.
