M-11/17/1992 414 CITY OF SANTA MONICA I CITY COUNCIL MINUTES NOVEMBER 17, 1992 An adjourned meeting of the Santa Monica city Council was called to order by Mayor Genser at 7:45 P.M. on Tuesday, November 17, 1992, in the Council Chambers. Roll Call: Present: Mayor Ken Genser Mayor Pro Tempore Judy Abdo Councilmember Robert T. Holbrook Councilmember Herbert Katz (arrived during Closed Session) councilmember Kelly Olsen (arrived at 8:20 P.M.) councilmember Antonio Vazquez Councilmember Dennis Zane Also Present: City Manager John Jalili Acting City Attorney Joe Lawrence City Clerk Clarice E. Dykhouse Mayor Pro Tempore Abdo led the assemblage in the Pledge of Allegiance to the Flag of the United states of America. I Councilmember Holbrook moved to hear Item No. 9-A at this time. Second by Councilmember Vazquez. The motion was unanimously approved. 9-A: CLOSED SESSION: At 7:46 P.M., Council adjourned to Closed Session for the purpose of considering the following cases: 1) calfon Construction, Inc. v. City of Santa Monica, Los Angeles superior Court Case No. C 751 798i 2) Sakakura America, Inc. v. city of Santa Monica, Los Angeles Superior Court Case No. BC 030112; 3) Martha Sierras v. City of Santa Monica, Case No. 91 C 01840; 4) Trist Hillman v. city of Santa Monica, Case No. SC 012 878. At 8:05 P.M., Council reconvened with all members present except Councilmember Olsen. 4-A: RECOGNITION/COUNCILMEMBER KATZ: John DUdzinsky, President of the Santa Monica Area Chamber of Commerce, Dr. Richard Moore, representing Santa Monica College, Pam Brady, representing the santa MonicajMalibu School District Board of Education, and members of the Santa Monica Firefighters Association, spoke in recognition of retiring councilmember Katz. Mayor Genser, on behalf of the City council, presented a proclamation and gift to Councilmember Katz. II Councilmember Olsen reported present at 8:20 P.M. 1 November 17, 1992 415 At 8:30 P.M., a Housing Authority Special Meeting was convened. Dykhouse HA-1: MINUTES APPROVAL: Presented were the Housing Authority Minutes of June 23 and August 11, 1992. Vice Chair Abdo moved to approve the Housing Authority minutes of June 23, and August 11, 1992. Second by Authority Member Holbrook. The motion was unanimously approved. HA-2: SECTION 8 PREFERENCE RATING SYSTEM/LOCAL TRANSITIONAL HOUSING PROGRAM: Presented was the staff report recommending amendment of Section 8 preference rating system for active participants in a local transitional housing program. Member of the public Joy Fullmer expressed her concerns. Commissioner Zane moved to approve the change in the Section 8 preference to create I a local preference for homeless applicants who have been participating in a local homeless transition program for a minimum of six months. Second by Commissioner Katz. The motion was approved by the following vote: Housing Authority vote: Unanimously approved 7-0 At 8:37 P.M., the Housing Authority Special Meeting was adjourned and the City Council Meeting was reconvened. 6. CONSENT CALENDAR: Presented was the Consent Calendar, whereby all items are considered and approved in one motion unless removed from the calendar for discussion. Councilmember Katz removed Item No. 6-A from the calendar. 6-A: BICYCLE LICENSE FEES: Presented was the staff recommendation to amend Santa Monica Municipal Code Section 3.20.070 to increase bicycle license fees. Discussion was held. council asked questions of staff. Councilmember Katz moved to not adopt the recommendation to amend Santa Monica Municipal Code section 3.20.070 to increase bicycle license fees from $1 to $2 per year. Second by Councilmember Holbrook. Discussion was held. councilmember Katz withdrew his motion; Councilmember Holbrook withdrew his second. Councilmember Katz moved to table this item. Second by Councilmember Zane. The motion was I approved, Mayor Genser opposed. 2 November 17, 1992 I I I 416 7-B: APPEAL/ZONING ORDINANCE INTERPRETATION/SECTION 9044.3(e)/PARKING REQUIREMENTS/CHANGE OF USE: Presented was the appeal of zoning Ordinance interpretation of Section 9044.3 (e) regarding parking requirements for changes of use. Discussion was held. Mayor Genser moved to continue the Appeal of Zoning Ordinance interpretation of Section 9044.3(e} regarding parking requirements for changes of use. Second by Councilmember Olsen. Council asked questions of staff. Council concurred the appeal would be considered on December 8, 1992. The motion was unanimously approved. 8-B: DESIGNATED PARKS DISTRICT/BEACH PARKING DISTRIcT/R2 BEACH PARKING DISTRICT/R3R DISTRICT: Presented was an ordinance for introduction and first reading amending the Zoning Ordinance by establishing Part 9.04.08.58 implementing the Designated Parks District; establishing Part 9.04.08.60 implementing the Beach Parking District; establishing Part 9.04.08.62 implementing the R2 Beach District; establishing Part 9.04.08.64 implementing the R3R District. Council asked questions of staff. At 8:57 P.M., Mayor Genser declared the public hearing open. Member of the public Joy Fullmer expressed her concerns. Member of the public Fred Harris spoke in support of the staff recommendation. Mayor Genser closed the public hearing at 9:01 P.M. councilmember Katz moved to introduce for first reading an ordinance entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING THE ZONING ORDINANCE BY ESTABLISHING PART 9.04.08.58 IMPLEMENTING THE DESIGNATED PARKS DISTRICT; ESTABLISHING PART 9.04.08.60 IMPLEMENTING THE BEACH PARKING DISTRICT; ESTABLISHING PART 9.04.08.62 IMPLEMENTING THE R2 BEACH DISTRICT; ESTABLISHING PART 9.04.08.64 IMPLEMENTING THE R3R DISTRICT," reading by title only and waiving further reading thereof. Second by Mayor Pro Tempore Abdo. The motion was approved by the following vote: Council vote: Affirmative: councilmembers Abdo, Holbrook, Katz, Vazquez, Zane, Mayor Genser Negative: Councilmember Olsen. 8 -C: PARKING METERS: Presented was an ordinance for introduction and first reading amending Chapter 3.16 of the Santa Monica Municipal Code regarding parking meters and authorizing in-vehicle parking regulators. Council asked questions of staff. At 9: 05 P.M., Mayor Genser declared the public hearing open. Member of the public Dario Manalastas described a device his company produces which is similar to the park-a-meter and requested Council allow him the opportunity to competitively bid on this item. Member of the public Joy Fullmer expressed her concerns. Mayor Genser closed the public hearing at 9: 11 P.M. Counci1member Katz moved to introduce for first reading an ordinance entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING CHAPTER 3.16 OF THE SANTA MONICA MUNICIPAL CODE REGARDING PARKING METERS," reading by title only and waiving further reading thereof. Second by Councilmember Vazquez. The motion was approved by the following vote: Council vote: Unanimously approved 7-0 3 November 17, 1992 417 8-D: ON-SITE INCLUSIONARY UNIT DEVELOPMENT STANDARDS AND IN LIEU FEES: Presented was an ordinance for adoption and second reading amending santa Monica Municipal Code Section 9.28.060 and I 9.28.080 regarding on-site inclusionary unit development requirements and in lieu fees (Proposition R). Councilmember Olsen moved to adopt Ordinance No. 1657 (CcS), entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING SANTA MONICA MUNICIPAL CODE SECTIONS 9.28.060 AND 9.28.080 REGARDING ON SITE INCLUSIONARY UNIT DEVELOPMENT REQUIREMENTS AND IN LIEU FEES," reading by title only and waiving further reading thereof. Second by Councilmember Zane. The motion was approved by the following vote: Council vote: Affirmative: Councilmembers Abdo, Holbrook, Olsen, vazquez, Zane, Mayor Genser Negative: Councilmember Katz 14-A: APPOINTMENT OF MEMBER/COMMISSION ON OLDER AMERICANS: Mayor Pro Tempore Abdo moved to continue this item for one month. Second by Councilmember Katz. The motion was unanimously approved. 9-A: CLOSED SESSION: (HELD EARLIER IN THE MEETING) : Councilmember Holbrook moved to approve settlement in the case of Hillman v. City of Santa Monica in the amount of $30,000. Second by Councilmember Zane. The motion was approved by the following vote: Council vote: Affirmative: Councilmembers Zane, Vazquez, Katz, Holbrook, Abdo, Mayor Genser I Abstain: Councilmember Olsen Councilmember Olsen requested that the record reflect that he abstained from voting on this item due to the fact that he was not present in Closed Session. Councilmember Zane moved to approve settlement in the case of Sierras v. City of Santa Monica in the amount of $21,000. Second by Councilmember Holbrook. The motion was approved by the following vote: Council vote: Affirmative: Councilmembers zane, Vazquez, Katz, Holbrook, Abdo, Mayor Genser Abstain: Councilmember Olsen Councilmember Olsen requested that the record reflect that he abstained from voting on this item due to the fact that he was not present in Closed Session. Mayor Pro Tempore Abdo moved to approve settlement in the case of I Calfon Construction, Inc. v. City of Santa Monica in the amount of $600,000. Second by Mayor Genser.
