M-5/18/1993 I I I 75 CITY OF SANTA MONICA CITY COUNCIL MINUTES May 18, 1993 An adJourned meeting of the Santa Monica City Council was called to order by Mayor Abdo at 6:45 P.M. on Tuesday, May 18, 1993, in the Council Chambers. Roll Call: Present: Mayor Judy Abdo Mayor Pro Tempore Antonio Vazquez CounCllmember Ken Genser Councilmember Asha Greenberg Councilmember Robert T. Holbrook Councilmember Paul Rosenstein Absent: Councilmember Kelly Olsen Also Present: City Manager John Jalili Acting City Attorney Joe Lawrence Assistant City Clerk Beth Justlce Councilmember Holbrook led the assemblage in the Pledge of Allegiance to the Flag of the Unlted States of America. 5-A: COMMERCIAL DEVELOPMENT STANDARDS: At 6:50 P.M., the publlc hearing was continued from May 11, 1993. Member of the publlC Mat Millen urged Council not to approve a provision that a management plan be submitted for transitional housing programs without specific guidellnes. Member of the public Clyde Smith expressed concern with continued spot zoning of P1CO Boulevard between 21st and 31st Streets. Members of the public John Bodln, Saxe Dobrln, Robert Seldon, Chris Harding, Merritt Coleman, Laurel Roennau, Eric Siss, and Irma Vargas, spoke in opposition to the proposal. Member of the public Sara Faulds urged a process of communlty reVlew. Members of the public Linda Bozung, David Thurman, and Bob Nicksln spoke in opposition to the combination of residential and industrial uses. Member of the public John Dudzinsky urged Council to appolnt a speclal task force or a commission of community leaders to create an economic strategy for the City's future and then review the commercial development standards. Member of the public Davld Hlbbert expressed concern with the proposed changes to the C5 zone. Member of the public Ken Kutcher dlscussed his belief that the standards for mixed use proJects are lnadequate. Member of the public Joseph Palazzolo urged Councll to approve the proposal even though he believes it to be ill-concelved. Councilmember Genser moved to hear the remainder of the ChltS. Second by Councilmember Rosensteln. The motlon was unanimously approved, Councilmember Olsen absent. Member of the public Don Empackerls spoke in support of the proposal. Members of the public Sandra Deerlng, Jlm Gray, David Bohn, Dave Paradis, Bob Gabriel, and William Brantley spoke in opposition to an extension of the commercial moratorium. Member of the publlc Donn Morey discussed 1 May 18, 1993 76 the redevelopment of the Von's Market site. Members of the publlC Mark Harding and Francie Rehwald discussed the hardships I the proposal will place on automobile dealerships. Member of the publlC Eric Parlee urged a process of community review. Members of the public Mike Sulllvan, Sol Gindoff, Maurice Levln, Robert Blair I and Graham Pope spoke in OppOSl tion to the proposal. Member of the public Mlke O'Neal urged Council to retaln the M-1 zoning for the Dresher property. Members of the public Walt Me Hendry and John Bohn spoke in opposition to the cornbinatlon of residentlal and lndustrial uses. Mayor Abdo closed the public hearlng at 8:37 P.M. At 8 38 P.M., Council adjourned for a short recess. Council reconvened at 8:58 P.M. with all members present, Councilmember Olsen absent. 5-A' COMMUNITY DEVELOPMENT STANDARDS (RESUMED): Council asked questions of staff. D1Scussion was held. The ordinance for introductlon and first reading amendlng multiple zoning ordinance sectlons to implement the provisions of the commerclal development standards program; adoption of a resolution approving the Commercial Development Standard Program and adoption of the Statement of Overriding Consideration; introduction for first reading of an interim ordinance to implement interim development standards for a portion of the M1 and C5 area located north of the Santa Monica Freeway and east of 19th Place Alley; and adoptlon of a resolution approvlng the environmental review for I the interim ordinance was continued to the meeting of May 25, 1993. 9-A: CLOSED SESSION: Held at end of meeting. 14-A: "DAWN'S EARLY LIGHTlI FIREWORKS PROGRAM: Presented was the request of Councilmember Genser to dlSCUSS giving direction to staff to resume the presentation of the "Dawn's Early Lightrr fireworks program on July 4, 1993. Discussion was held. Councilmember Genser moved to ask staff to return next year at an appropriately early date and determine whether or not Council wlshes to have "Dawn's Early Llght rr fireworks presentatlon for July 1994. Second by Mayor Abdo with the condition that staff return in February 1994. The amendment was accepted as friendly Discussion was held. Mayor Pro Tempore Vazquez moved to amend the motion to include criterla for not only this event but all other major events on the pier. The amendment was accepted as friendly. Discussion was held. The motion was unanimously approved, Councilmember Olsen absent. Councilmember Holbrook moved to direct staff to conduct dlscussions with Santa Monica College to determine ~f the Clty could assist them in enhancing their fireworks presentation for community use. Discuss~on was held. Second by Councllmember Rosenstein. The mot~on falled, Councilmembers Genser, Greenberg, and Vazquez opposed, Councilmember Olsen absent. I 2 May 18, 1993 I I I 77 14-C: AMENDMENT TO ZONING ORDINANCE/DEVELOPMENT STANDARDS/CHILD CARE CENTERS: Presented was the request of CounC1lmember Rosenstein to discuss a Resolution of Intent d1recting the Plann1ng Comm1ss1on to 1n1t1ate an amendment to the Zoning Ordinance relating to development standards applicable to Child Care Centers in res1dential d1str1cts and directing staff to reV1ew fees charged for a City permit. Councilmember Rosenste1n moved to direct staff to prepare a Resolution of Intent d1recting the Planning Cormnission to initiate an amendment to the Zoning Ord1nance relating to development standards app11cable to Child Care Centers in residential districts and directing staff to review fees charged for a City permit Second by Mayor Abdo. The mot1on was unanimously approved, Councilmember Olsen absent. 14-D: EXPANSION AND CLARIFICATION OF CONFLICT OF -INTEREST -- REGULATIONS: Presented was the request of Councilmember Ganser to discuss directing the City Attorney to prepare and-feturhwith an ordinance to expand and clarify conf11ct of interest regulations. Discussion was held. Councilmember Genser moved to direct the City Attorney to prepare and return w1th an ordinance or evaluation to expand and clarify conflict of interest regulations, as follows: 1) Councilmernbers, appointed.~ff1cials, and city employees refrain from participating in matters specif1c or directed toward private corporations for which they serve as unpaid directors or officers; 2) Councilmembers and certa1n off1c1als not represent part1es having administrative business before the City as paid consultants, 3) Certain officials not be h1red as consultants by part1es hav1ng regulatory matters before certain boards and commissions; 4) Participants 1n d1scuss1ons should not be paid to support or oppose a certain body's decision 1f he/she participated 1n making those decisions; 5) Study broader ethics issues; and 6) Not participate in neighborhood organization boards wh1ch are 1nd1rectly funded by the City. Second by Councilmember Rosenstein. D1SCUSS1on was held. The motion was unanimously approved, Councilmember Olsen absent. 14 -E: LB'l"l'ER OF RESIGNATION/LUIS C. DeCASTRO/RECREATION AND PARKS COMMISSION: Mayor Abdo moved to accept w1th regret the letter of resignation from Luis C. DeCastro from the Recreation and Parks Commission and authorize the City Clerk to publish a Notice of Vacancy. Second by Councilmember Rosenstein. The mot1on was unan1mously approved, CounC1lmember Olsen absent 14-F: AB242 POSSESSION OF FIREARMS;SB612 PROHIBITION OF SEXUAL HARASSMENTjAB1548 - STALKING: Presented was the request of Counc1lmernber Greenberg, on behalf of the Commission on the Status of Women, to d1scuss support of AB242 relating to possession of firearms, SB612 relating to prohibit1on of sexual harassment, and AB1548 relating to exemplary damages in cases 1nvolving the crime of stalking Councilmember Greenberg moved to direct staff to send letters to the appropr1ate committees conveying support of AB242, SB612, and AB1548. Second by Mayor Abdo w1th the stipulation that letters be sent to all leg1slators. Discussion was held. The motion was unanimously approved, CounC1lmerober Olsen absent. 3 May 18, 1993 78 9-A: CLOSED SESSION: At 10:55 P.M., Counc~l adjourned to Closed Sess~on for the purpose of consider~ng personnel matters and threatened litigation, pend~ng litigation and litigation to be I commenced by the City. At 11:37 P.M., Council reconvened with all members present except Councilmernber Olsen No action was taken in Closed Session. ADJOURNMENT: At 11:37 P.M., the meeting was adJourned to May 25, 1993, in memory of Verne Mueller and Reverend Whales Smith.
