M-2/28/1986 I I 435 CITY OF SANTA MONICA CITY COUNCIL MINUTES FEBRUARY 28, 1986 A special meeting of the Santa Monica city council was called to order by Mayor Reed at 5:30 P.M., on Friday, February 28, 1986, in the Council Chambers. Councilmember Zane led the assemblage in the pledge of allegiance. Roll Call: Present: Mayor Christine E. Reed Mayor Pro Tempore william H. Jennings councilmember James P. Conn Councilmember David G. Epstein (Entered at 5:31 P.M.) Councilmember Alan S. Katz (Entered at 5:33 P.M.) Councilmember Herb Katz Councilmember Dennis Zane Also Present: City Manager John Jalili city Attorney Robert M. Myers City Clerk Ann M. Shore RENT CONTROL, PROPOSED AMENDMENT WITHDRAWN: Mayor Reed announced that the meeting had been called to consider withdrawal of direction to the city Attorney to prepare language for a June 1986 election ballot measure amending the Rent Control law relating to Capital Improvements. Councilmember Epstein introduced discussion regarding his decision to withdraw the staff assignment in view of the short amount of time available for staff to do the work and to give the Rent Control Board an opportunity to approach this issue before it is placed on a ballot. Councilmember Epstein moved to withdraw instruction to the city Attorney to prepare such an amendment to the June 1986 ballot, but that, at an opportune time, the City Attorney report to Council, based on the work that has been done to date, and provide the Rent Control Board with a copy of what has been done. Second by Mayor Pro Tempore Jennings. Councilmember H. Katz requested the record to reflect that, as seconder of the original motion (on February 25, 1986), he voted for this in good conscience and still supports this item; he believes it should have been addressed on Tuesday (March 4, 1986), and if the city Attorney had or had not been able to complete it, the time constraint could have been addressed then; he believes that, while it is legal, it is inappropriate to call a meeting for 5: 30 P.M. on a Friday night when the pUblic probably had not much knowledge of the meeting; he thinks it important that Council look at what had been done, and, if it was not complete, let it die, or at least use it as a start for a 1 February 28, 1986 436 future election; he believes this has to do with the city as a whole and deterioration of its buildings; this issue is a city council function -- not a Rent Control Board function alone; he will vote no because he thinks it should go ahead. Discussion was held. Councilmember H. Katz moved to hear from a member of the public who had requested to speak. The motion was I duly seconded and approved by a vote of five to two. Bill Lackey spoke in support of withdrawing the proposed matter from the ballot. Discussion was held. The motion on the floor was approved by the following vote: Council Vote: Affirmative: Councilmembers Conn, Epstein, Jennings, A. Katz, Zane and Mayor Reed Negative: Councilmember H. Katz ADJOURNMENT: At 5:50 P.M., Councilmember Epstein moved to adjourn the meeting. Second by Councilmember Conn. The motion was approved by unanimous vote.
