Mayor Pro Tempore Jennlngs led the assemblage in the pledge of allegiance to the Unlted States. Roll Call: Present: Mayor Christlne E. Reed Centered at 7:55 P.M.) Katz moved to add to the agenda a request for a Closed Sesslon for the purpose of consldering threatened IltIgatIon, pendIng lItIgation and lltlgation to be commenced by the CIty. Second by Councilmember EpsteIn. The motIon was unanlmously approved. 11-0: SPECIAL MUNICIPAL ELECTION: Presented was a staff report transmIttlng resolutions pertaIning to call1ng a Special Munlclpal Electlon on June 3 t 1986, to place before the voters Charter Amendment measures, one entltled "Tenant Incentive Program" (a qual1fled petitlon) and another relatIng to Councllmember compensatIon; the resolutIons haVIng been prepared at the request of Councll at the1r meeting of February 11 and 25, 1986. D1 SCUSSIon was held. Member of the publlC John Jurenka requested that the tenant proposltion be descrIbed as establIshing a "new base rent ceillng" Instead of "vacancy decontrol." Councilmember A. Katz moved to allow another member of the publlC to speak. Second by Councllmember H. Katz. The motIon was unanlmously approved. Jlm Jacobson spoke In support of wording on the ballot that descrlbes the measure as "a new base rent ceIlIng." DIScussion was held. Councllmember Epstein moved to adopt Resolutlon No. 7173(CCS) entItled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CALLING AND GIVING NOTICE OF THE HOLDING OF A SPECIAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY t JUNE 3, 1986," readIng by tl tIe only and walving further readIng thereof, deletlng the portlon about March 4,1986 438 CouncIl compensatIon. Second by Councllmember H. Katz. During dIScussIon, and wi th the consent of the second, Councllmember EpsteIn incorporated into the motion language amendIng the proposItIon descrIptIon In the resolution, page 3, section 6, to read as follows: "Shall Article XVIII of the CIty Charter entl tIed Rent Control be amended by adding certaIn new sectIons I and amending certaIn eXIstIng sections to permIt, at the landlord's optIon, decontrol upon voluntary vacancy followed by recontrol If the landlord complies wIth the provIsions of a program entitled "Tenant IncentIve Program?" DIScussion was held. Coun C Ilmember A. Katz requested the record to reflect that thIS IS a mInIsterial actIon the CouncIl is taking to place an inItIatIve, properly presented by Santa MonIca CItIzens, on the June 3rd ballot. The motIon was approved by the following vote: CouncIl vote: Unanimously approved 4-0 Absent: CouncIlmember Conn, Zane, Mayor Reed Mayor Reed entered at 7:55 P.M. Councllmember EpsteIn moved adoptIon of ResolutIon No. 7174(CCS) entItled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES TO CONSOLIDATE A SPECIAL MUNICIPAL ELECTION OF THE CITY OF SANTA MONICA TO BE HELD ON JUNE 3, 1986 WITH THE STATEWIDE DIRECT PRIMARY ELECTION TO BE HELD ON SAID DATE PURSUANT TO ELECTIONS CODE SECTION 23302," was adopted, thereby requesting consolidatIon of CIty electIon with the county, and approval of an appropriatIon of $40,000 from the General Fund Reserves to the CIty Clerk's electIon account number 01-120-212-000-506. Second by Councilmember A. Katz. DurIng diSCUSSIon, and WIth the consent of the second, Councilmember Epstein amended the motIon to reflect the conformIng changes to Incorporate the reVIsed wordIng of the tenant measure and to delete the CounCIl compensatIon proposi tIon. The motIon, as amended, was approved by the following vote: Roll Call: UnanImously approved 5-0 Absent: Councilmembers Conn, Zane DiSCUSSIon was held. Councllmember A. Katz moved to adopt I ResolutIon No. 7175(CCS) entItled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AUTHORIZING CERTAIN OF ITS MEMBERS TO FILE WRITTEN ARGUMENTS REGARDING PROPOSITIONS TO BE PLACED ON THE BALLOT AT THE SPECIAL MUNICIPAL ELECTION ON TUESDAY, JUNE 3, 1986," readIng by tItle only and waiVIng further reading thereof, authorizing Mayor Reed and CouncIlmember A. Katz to write arguments agaInst the Tenant IncentIve Program measure, and IncludIng the procedural changes to delete the Councllmember 2 March 4,1986 I I 439 compensation measure. Second by Mayor Reed. approved by the followIng vote: The motIon was Councll vote: Unanimously approved 5-0 Absent: Councllmember Conn, Zane CLOSED SESSION: Presented was a request for Closed Sesslon to conslder threatened lItIgatIon and pendIng litIgatIon. At 8: 00 p.m., Councilmember Epstein moved to adjourn to Closed Sesslon to consIder the followlng pendIng case: Santa Monlcans for Renters' RIghts, et.al. v. City of Santa MonIca, et.al., Santa MonIca Super lor Court Case No. WEe 101479. The motIon was duly seconded and unanimously approved. At 8:07 p.m., Councll reconvened wIth fIve members present, Counc1lmembers Conn and Zane absent. Mayor Reed announced that no action had been taken.
