to order by Mayor Reed at 7:35 p.m., Wednesday, April 30,1986,

report regardIng a Mitigation Program Agreement between the Ersa

WIthdrawn at the request of staff.
8-A: VENDING AT PIER: Presented was a staff report transmitting
an ordInance for adoptIon and second readIng permItting open air
vendIng at the Santa Monica PIer, haVIng been Introduced April
22, 1986. Councilmember Zane moved adoption of OrdInance No.
1366 (CCS) entl tIed: "AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA ADDING SECTION 9118C TO THE SANTA MONICA
MUNICIPAL CODE RELATING TO OPEN-AIR VENDING ON SANTA MONICA
MUNICIPAL PIER," readIng by tItle only and waIvIng further
readIng thereof. Second by Councilmember Epstein. The motion
was approved by the followIng vote:

negatl ve vote is because tl1 t whittles away further at housIng
money; and that whenever the CIty whIttles away at housIng money,
it means that the money that we can leverage from the prl vate
sector and from other lendIng instItutIons, such as the State of
California, dImInIshes as well and so therefore, we're losIng a
great capacIty when we whIttle away In thIS way at housIng
money.tI
8-0/1 O-A: TENANT PROTECTION REGULATIONS/RELOCATION ASSISTANCE:
Presented were (Item 8-D) a staff report transmIttIng an
ordInance for Introduction and fIrst readIng enablIng the Rent
Control Board to adopt regulatIons to Implement tenant protectIon
necessitated by and authorized In the Ellis BIll and
recommendatIon regardIng an ordInance enabling the Rent Control
Board to adopt relocation assIstance programs; and (Item 10-A) a
request of Rent Control Board Member DavId Finkel to address
CounCIl on the subJect of regulations to implement tenant
protections necessitated by the Ellis Bill. DIScussIon was held.
At 7:49 p.m., the public hearing was declared open. David
FInkel, Joy Fullmer, James Baker, Wayne Hall, John Jurenka, and
K. B. Hu ff spoke in regard to the matter. Dl SCUSS Ion was held.
Councllmember Zane moved to waIve the rules to hear a public
member who turned In a late chi t. The motIon was duly seconded
and approved. Tony Alvarez spoke In regard to the matter. At
8: 30 p. m., the public hearIng was declared closed. DIScussIon
was held. Councllmember Zane moved an ordInance entl tIed: !IAN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADDING
SECTION 4614 OF THE SANTA MONICA MUNICIPAL CODE ENABLING THE RENT
CONTROL BOARD TO ENACT REGULATIONS IMPLEMENTING THE ELLIS ACT,
GOVERNMENT CODE SECTION 7060 ET SEQ," reading by title only and
waivIng further readIng thereof. Second by Councllmernber A. I
Katz. WI th the consent of the maker and the second,
Councllmember Epstein moved an amendment to delete the last two
Whereas clauses (on page 2 of the ordInance) and substItute the
folloWIng: "Whereas the CI ty CounCIl belIeves that the Rent
Control Board now has the power to adopt regulations implementing
the protectIons provided for in the EllIS Act, but to remove all
doubt, wishes to exerCIse its power to delegate authority to the
Rent Control Board to adopt such regulatIons...". DIScussion was

partIes, to prepare and brIng back to the CouncIl In a tImely
fashlon an ordInance coverIng relocation for tenants eVIcted for
matters not their fault, the relocation ordInance to Include
dIfferent rates of compensatIon for furnished apartments as
opposed to unfurnIshed apartments. Second by CouncIlmember A.

benefIts be provided for persons In trailer parks and mobile

11-D: CLOSED SESSION: Continued to May 6, 1986.
13-B: PREFERENTIAL PARKING PETITION: Presented was the request
of Regula K. Ziegler to address CouncIl regardIng presentation of
a petItion for a Preferential Parking Zone on Grant Street
between 14th and 16th Streets. Ms. Ziegler spoke regardIng a
petl tion for preferential parking In her neIghborhood due to
college student parking and concern for the safety of children.
DIScussion was held. Counc ilmember A. Katz moved to send thIS
Item to staff and request staff to report back. Second by
Councilmember Epstein. DISCUSSIon was held. With the consent of
the maker, Councllmember Epsteln moved an amendment that thlS
preferentlal parking peti tlon be conSIdered durIng the regular
cycle for hearing parkIng peti tions (WhICh is comIng up soon
durIng the budget session). DIScussIon was held. Wlth the
consent of the maker and the second, Councllmember Zane moved an
amendment to dIrect the Mayor to send a letter to the College
IndIcatIng that we are in receIpt of these petitions and that we
are In the process of delIberating upon theIr merit. Discussion
was held. DurIng discussIon, the maker and the second
Incorporated Into the motion Mayor Reedts suggestion authorIzing
staff to proceed to seek petItIon SIgnatures on Bay and PacifIC

14-B: BUS ~1AINTENANCE LOCATION: Presented was the request of
Councilmember H. Katz to discuss neIghborhood concerns over the
potential location of the Los Angeles CIty MaIntenance Bus
FaCIlIty in Santa Monica. ~ayor Reed moved to hear from members
of the public for three mInutes each. Second by Councilmember A.
Katz. The motIon was unanImously approved. MIchael Perlman,
Donna Alvarez, BIll Putnam, and Paul Rosenstein spoke in
OpposItIon to the proposed location of the bus maintenance
faCIlIty. DISCUSSIon was held. Councilmember Zane moved to ask
staff to prepare for CouncIl reVIew a set of strategy optIons
that we mIght pursue and partIcIpate in, both collectl vely and
IndIvidually, In order to reSIst thIS IntrusIon or InvaSIon by an
unwanted agency in the community, the motion to include Mayor
Reed's suggestIon of the concept of a task force WhICh would
1 nc lude a deSIgnee from the Cl ty At torney's Office and someone
from the PlannIng staff who has been workIng on this, and al so
the concept that the Cl ty be prepared to provide resources for
consultant studIes to enable us to contest data In the EIR If we
belIeve that IS going to be one of the strategies. Second by
Councilmember EpsteIn. DISCUSSIon was held. The motIon was
unanImously approved.
14-C: COMMISSION ON OLDER AMERICANS: Presented was the matter
of acceptance of the reSIgnatIon of Leo Gonzales, ~ewly appointed
member of the Commission on Older AmerIcans, and appOIntment of a
new member. Councllmember EpsteIn moved to continue thIS matter
to the regular appOIntment cycle In June. Second by Mayor Reed.
The motIon was unanimously approved.
14-D: PUBLIC RESOURCES CODE AMENDMENTS: Presented was the
request of Mayor Reed to dISCUSS support for SB 1868 (Rosenthal)
concernIng amendments to the Public Resources Code relatIng to
offshore 011 drIllIng and SB 2027 (Rosenthal) concernIng I
amendments to the Public Resources Code relatIng to Coastal
resources. Mayor Reed introduced dlScusslon and moved to support
the legi slatl ons and so commun i ca te to our representat i yes 1n
Sacramento. Second by Councilmember Epstein. The motIon was
unanimously approved.
14-F: AIDS AWARENESS PROGRAM: Presented was
Councilmember A. Katz to dISCUSS support for
AIDS Awareness Program. Councllmember A.
