M-4/5/1983 . . . . 217 MINUTES OF THE ADJOURNED MEETING OF THE CITY COUNCIL OF SANTA MONICA, CALIFORNIA APRIL 5, 1983 The adjourned meeting of the City Council of March 22, 1983 was held on Tuesday, April 5, 1983 beginning at 7:40 P.M. The meeting was called to order by Mayor Yannatta Goldway, who led the assemblage in the pledge of allegiance to the United States of America. Reed Councilmember Press moved, Mayor Pro Tempore Edwards seconded and it was unanimously approved to add Items 4-C, 6-M. 6-N, 8-C. Il-K, Il-L. ll-M 14-F, 14-G. 14-H and 14-1 to the agenda. 4. SPECIAL AGENDA ITEM: 4-C: Presentation of Commendation to Santa Monica citizen. Mayor Yannatta Goldway presented a proclamation to Glenn Syndby, Editor of International Gymni~t, expressing appreciation for his magazine motivating young gymnists, encouraging excellence in amateur sports and commending him for his example of physical excellence. 6. CONSENT CALENDAR: The Consent Calendar was presented. Councilmember Zane moved, and Mayor Pro Tempore Edwards seconded to approve the Consent Calendar, reading resolutions by title only and waiving further reading thereof. 6-M: Resolution No. 6658(CCS) entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA PROCLAIMING THE CONTINUED EXISTENCE OF THE LOCAL EMERGENCY," was adopted. 1 April 5, 1983 218 . 6-N: Resolution No. 6659(CCS) entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ORDERING THE CANVASS OF THE GENERAL MUNICIPAL ELECTION HELD ON TUESDAY, APRIL 12, 1983 TO BE MADE BY THE CITY CLERK," was adopted. The motion was approved by the following roll call vote: Affirmative: Councilmembers Edwards, Press, Zane and Mayor Yannatta Goldway Negative: Councilmembers: None Absent: Councilmembers: Conn, Jennings, and Reed 8. ORDINANCES: 8-B: Ordinance for introduction and first readins establishins nuisance abatement procedures. . The City Attorney presented the staff report. There being no members of the public wishing to speak, Mayor Pro Tem~ore Edwards moved, Councilmember Zane seconded and the mot~on was unanimously approved to close the public hearing. After discussion, Councilmember Zane moved and Mayor Pro Tempore Edwards seconded to introduce an ordinance entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ESTABLISHING NUISANCE ABATEMENT PROCEDURES," reading by title only and waiving further reading thereof. The motion was approved by the following roll call vote: Affirmative: Councilmembers: Edwards, Press, Zane and Mayor Yannatta Goldway Negative: Councilmembers: None Absent: Councilmembers: Conn, Jennings and Reed 8-C: Ordinance for introduction and first readins amendins supplemental fire protection ~rovisions. The City Attorney presented the staff report. . There being no members of the public wishing to speak, Councilmember Zane moved, Mayor Yannatta Goldway seconded and the motion was unanimously approved to close the public hearing. In the discussion that followed, Mayor Pro Tempore Edwards requested staff to furnish an analysis of why some buildings have not met the fire standard codes. 2 April S, 1983 . . . . . 219 Councilmember Zane moved and Mayor Yannatta Goldway seconded to introduce an ordinance entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING SUPPLEMENTAL FIRE PROTECTION PROVISIONS," reading by title only and waiving further reading thereof. The motion was approved by the following roll call vote: Affirmative: Councilmembers: Edwards, Press, Zane and Mayor Yannatta Geldway Negative: Councilmembers: None Absent: Councilmembers: Conn, Jennings and Reed 11. ADMINISTRATIVE ITEMS: ll-J: Request for Closed Session to discuss pending litigation and personnel matters. See page 5. ll-K: Recommendation to authorize the Cit~ Mana~er to approve ~rant applications developed by Santa Monica Arts Commission for fundin~ in the amount of $10,000 or less for the remainder of Fiscal Year 1982-83. The City Manager gave the staff report. Councilmember Zane moved and Mayor Pro Tempore Edwards seconded to authorize the City Manager to approve grant applications developed by the Santa Monica Arts Commission which seek program activity funding support from private and public sources in amount of $10,000 or less for the balance of the Fiscal Year 1982-83. The motion was approved by the following roll call vote: Affirmative: Councilmembers: Edwards, Press, Zane and Mayor Yannatta Goldway Negative: Councilmembers: None Absent: Councilmembers: Conn, Jennings and Reed ll-L: Recommendation to request City Attorney to draft ordinance simplifyin~ system for rebate of utility tax to Senior Citizens and request City Treasurer to develop an application form for this process. The City Manager gave the staff report. Mayor Yannatta Goldway moved. Councilmember Zane seconded and the motion was unanimously approved to request the City Attorney to draft an ordinance enabling seniors to make a one-time application for tax rebates which can be utilized 3 April 5, 1983 220 . during the months of May and June, 1983 when senior citizens will be coming to City Hall filing for rebates of last year's taxes and to direct the City Treasurer to develop an application form which will be available for the application and review process. The motion was approved by the following voice vote: Affirmative: Councilmembers: Edwards, Press, Zane and Mayor Yannatta Goldway Negative: Councilmembers: None Absent: Councilmembers: Conn, Jennings and Reed Mayor Yannatta Goldway moved. Mayor Pro Tempore Edwards seconded and it was approved unanimously to hear Items ll-M, l4-G and 14-H simultaneously. ll-M: Recommendation to contract with a professional ~obbyist to represent the City in Sacramento regarding AB 965, rent control measure, and SB 1069, anti-rent control. . l4-G: Request of Mayor Yannatta Goldway to discuss Council opposition to SB 1069, intrOduced by Senator Seymour, regarding anti-rent control. l4-H: Request of Mayor Yannatta Goldway to discuss ~ffective ways in which to lobby against AB 965, rent ~ontrol measure, and other potentially damaging measures currently in legislature. Mayor Yannatta Goldway commented that SB 1069 is anti-rent control legislation. Mayor Yannatta Goldway moved, Mayor Pro Tempore Edwards seconded and it was unanimously approved to go on record as being in opposition to sa 1069. The City Manager submitted the staff report for Item ll-M proposing the need for a lobbyist in Sacramento to protect City interests. Mayor Yannatta Goldway moved and Councilmember Press seconded to direct the City Manager to proceed with seeking a lObbyist, and return with a report to Council on how that lobbyist will function. The motion proposed additionally to review the most effective immediate method of lobbying against AB 965 and authorizing Councilmembers to travel to Sacramento should they wish to act in opposition to either SB 1069 or AB 965. The motion was approved by the following voice vote: . COUNCILMEMBER ITEMS: 14-F: Request of Mayor Yannatta Goldway to discuss letter written by Alexander Pope regarding Status of Pope versus SBE (New Construction Lawsuit}. Continued to April 12, 1983. 14-G: See Item Il-M. 14-H: See Item ll-M. 14-1: Re~uest of Maror Pro Tempore Edwards to discuss re~uest from the California Council on Children and Youth for use of the Council Chamber with fee waived. Mayor Pro Tempore Edwards presented the above request. Mayor Pro Tem~re Edwards moved, Mayor Yannatta Goldway seconded and 1t was unanimously approved to waive the fee for the use of the Council Chamber on April 28, 1983 by the California Council on Children and Youth. The motion was approved by the following voice vote: Affirmative: Councilmembers Edwards, Press, Zane and Mayor Yannatta Goldway Negative: Councilmembers: None Absent: Councilmembers: Conn, Jennings and Press CLOSED SESSION: Il-J: Re~uest for Closed Session to discuss pendin9 litisation and personnel matters. At 8:27 P.M., ~ayor Yannatta Goldway moved, Councilmember IPress seconded and it was unanimously approved to move into !Closed Session for the purpose of discussing pending litigation. At 8:30 P.M., the following members reconvened: Mayor Pro Tempore Edwards, Councilmember Press and .Councilmember Zane. In absence of a quorum no action was taken, and the meeting was adjourned by motion of 'Councilmember Press, seconded by Councilmember Zane and approved unanimously to close in memory of Thelno Knowles, ,Conception Smart, Dr. Robert Mazet, Jr. and Glen H.
