M-3/16/1982 . . . . 257 CITY OF SANTA MONICA CITY COUNCIL MINUTES MARCH 16, 1982 A meeting of the Santa Monica City Council was called to order by Mayor Yannatta Goldway at 7:39 P.M. Tuesday, March 16, 1982, having been continued from March 9, 1982. Mayor Yannatta Goldway led the assemblage in the pledge of allegiance to the United States of America. Roll Call: Present: Mayor Ruth Yannatta Goldway Mayor Pro Tempore Ken Edwards Councilmember James P. Conn Councilmember Dolores M. Press Councilmember Christine E. Reed Councilmember Dennis Zane City Manager John Alschuler, Jr. City Attorney Robert M. Myers Assistant City Clerk Connie McNeely Absent: Councilmember William H. Jennings . Councilmember Zane moved to add Items 4-C and 14-G to the agenda. Second by Mayor Yannatta Goldway. The motion was approved by i unanimous vote. 4-C: COMMENDATION: Mayor Yannatta Goldway presented a : commendation for outstanding service to resigning City Clerk Ann M. . Shore. 10-A: PIER TASK FORCE: Presented was a recommendation of the Pier Restoration and Development Task Force regarding the proposed park adjacent to the Carousel building. Discussion was held. Councilmember Conn moved to approve the recommendation thereby referr~ng pending plans for the undeveloped area east of the Carousel building to the Pier Task Force for consideration and inclusion in their current pier planning process. Second by Councilmember Zane. The motion was approved by the following vote: Counc~l Vote: Unanimously approved 6-0 Absent: Councilmember Jennings 10-B: LOCAL COASTAL PLAN: Presented was a recommendation of the Pier Restoration and Development Task Force regarding the Local Coastal Plan. Discussion was held. Mayor Yannatta Goldway moved to direct staff to prepare the Santa Monica Local Coastal Plan for submiss~on to the the Coastal Comm~ss~on. Second by Councilmember Press. Council Vote: Unanimously approved 6-0 Absent: councilmember Jennings Il-B: BUILDING PERMIT/DEMOLITION PERMIT/COASTAL PERMIT: Presented was a staff report transmitting a recommendation to direct the City Attorney to prepare an ordinance making issuance of a Building Permit subject to issuance of a Coastal Permit for projects located in the Coastal Permit Zone. Discuss10n was held. Councilmember Zane moved to direct the City Attorney to prepare an ordinance making the issuance of a Building Permit and/or Demolition Permit subject to the issuance of a Coastal Permit for any proJect located in the Coastal Permit Zone. The motion was approved by the following vote: Council Vote: Unanimously approved 6-0 Absent: Councilmember Jennings . 12-A: INTERIM DEVELOPMENT PERMIT/1540 SEVENTH STREET: Presented was a staff report transmitting an appeal of the decision of the Planning Commission to grant Interim Development Permit No. DR 027 for the construction of a mixed use office/residential building at 1540 Seventh Street. Discussion was held. Speaking in regard was to the matter was Chet Widom. Councilmember Zane moved to direct staff to meet with Dr. David Nellis, or his representatives, and to determine appropriate language that would assure that if the City waived its guidelines, that it would do so 1n a fashion which would provide for the community need of affordable housing. Second by Councilmember Conn. Following further discussion, the motion was approved by the following vote: Council Vote: Affirmative: Councilmembers Conn, Press, Zane and Mayor Yannatta Goldway Negative: Councilmembers Edwards and Reed Absent: Councilmember Jenn1ngs 14-B: UNPAID ASSESSMENTS: Presented was the request of Councilmember Reed to direct staff to report on the collection of unpaid assessments. Discussion was held. Mayor Yannatta Goldway moved to direct staff to review the matter of unpaid assessments and to report on establishing a revolving loan fund for the people in need in the City. The motion was approved by the following vote: . Council Vote: Unanimously approved 6-0 Absent: Councilmember Jennings 14-C: COUNCIL CHAMBER USE: Presented was the request of Mayor Yannatta Goldway to waive the fee for use of the Council Chamber by the Los Angeles County Registar-Recorder on May 7 and May 14, 1982 2 March 16, 1982 . . . . . 259 Ifor election precinct officer training. councilmember Conn moved to waive the usual fee for the use of the Council Chamber by the Los Angeles County Registrar-Recorder on Fr~day, May 7, 1982 and Friday, May 14, 1982 for the purpose of training precinct officers Ifor the June 8, 1982 primary election. Second by Councilmember ,Press. The motion was approved by the following vote: Council Vote: Unanimously approved 6-0 Absent: Councilmember Jennings 14-D: APARTMENT UTILITY SHUT-OFFS: Presented was the request of Mayor Yannatta Goldway for a discussion regarding preparation of an ordinance prohibiting landlord utility shut-offs in apartment Ibuildings. Mayor Yannatta Goldway introduced discussion. Mayor Xannatta Goldway moved to direct the City Attorney to prepare an ordinance prohibiting landlord utility shut-offs in apartment buildings. After further discussion, the motion was approved by Ithe following vote: ! Council Vote: Affirmative: Councilmembers Conn, Edwards, Press, Zane and Mayor Yannatta Goldway Negative: Councilmember Reed Absent: Councilmember Jennings 114-E: CALIFORNIA AIR RESOURCES BOARD: Presented was the request 'of Mayor Yannatta Goldway for a d~scussion of the proposed expansion of the California Air Resources Board. Mayor Yannatta Goldway introduced discussion. Mayor Yannatta Goldway moved to ,inform the California Air Resources Board of Council support of ladditional programs and to inform the South Coast Air Quality ,Management District of that position. Discussion was held. Council directed staff to report on the legal proceedings in 'respect to Ornyte and to prov~de an update on the status of the toxic chemical di&closure ordinance compliance. I 14-F: CIVIC AUDITORIUM USE: Counc~lmember Conn moved to continue the request of Mayor Yannatta Goldway for a discussion of the request for cosponshorship of Senior Health and Peer Counselling ,Center Conference and waiving of the fee for use of the civic IAuditorium on May 27, 1982 to the meeting to be held on March 23, '1982. The motion was approved by unanimous vote. I 14-G: FOURTH STREET FREEWAY ON-RAMP: Presented was the request of Mayor Yannatta Goldway for discuss~on of the Cal Trans action regarding a new Fourth Street freeway on-ramp and direction to 'staff to re-evaluate the proposal. Mayor Yannatta Goldway lintroduced discussion. Mayor Yannatta Goldway moved to direct 'staff to re-evaluate the Fourth Street on-ramp matter and report back to Counc~l so that action could be taken as to whether the matter should be maintained as a priority. Second by Councilmember ,Reed. The mot1on was approved by the following vote: ! 3 March 16, 1982 260 .. Councilmember Conn moved to recess to closed session to consider pending litigation and personnel matters. Second by Councilmember Zane. The motion was approved by unanimous vote. At 10:56 P.M., Councll reconvened with the following members present: Mayor Yannatta Goldway, Mayor Pro Tempore Edwards, Councilmembers Conn, Press, Reed and Zane. Mayor Yannatta Goldway announced that no actlon had been taken during the closed session. ADJOURNMENT: At IO:57 P.M. Mayor Yannatta Goldway moved to adjourn the meeting in memory of Herschel L. Younger and Lester Twigg. Second by Councilmember Conn. The motion was approved by the following vote: Council Vote: Unanimously approved 6-0 .
