M-1/20/1987 I 234 CITY OF SANTA MONICA CITY COUNCIL MINUTES JANUARY 20, 1987 A meeting of the santa Monica city Council was called to order by Mayor Conn at 7: 43 P . m. on Tuesday, January 20, 1987, in the Council Chambers, having been adj ourned from January 13, 1987. councilmember A. Katz led the assemblage in the pledge of allegiance to the United states of America. Roll Call: Present: Mayor James P. Conn Councilmember David B. Finkel Councilmember William H. Jennings (entered at B:50 p.m.) Councilmember Alan S. Katz Councilmember Christine E. Reed councilmember Dennis Zane Also Present: City Manager John Jalili City Attorney Robert M. Myers City Clerk Ann M. Shore Absent: Mayor Pro Tempore Herb Katz The following items were considered, having been continued from January 13, 1987. II-A: KIDSOAY ACTIVITIES: Presented was a staff report recommending approval of KidsDay activities on April 25, 1987. Discussion was held. Councilmember Reed moved to approve the waiving of the Carousel fee for children up to age 17 on April 25th, approve the preliminary plans as described in the report dated January 13, 1987, and authorize the staff to work on the suggestions of Councilmembers with regard to some sort of kids' government-type activity, recognizing that those suggestions are not completely specific. Second by Councilmember Finkel. Discussion was held. The motion was approved by the following vote: Council vote: Unanimously approved 5-0 Absent: Councilmember Jennings, Mayor Pro Tempore H. Katz ll-C: CLOSED SESSION: Held later in the evening. 13-B: FIRE CODE: Presented was the request of Keith W. Bair (not present) to address Council regarding interpretation of Fire Code. Councilmember Zane moved to receive and file the communication. Second by Councilmember Reed. The motion was unanimously approved. 1 January 20, 1987 235 13-C: ELECTION CAMPAIGN: Presented was the request of Herman Rosenstein to address Council regarding the recently completed election campaign. Mr. Rosenstein spoke in support of regulations limiting campaign financing, prohibiting misrepresentation in campaign literature and other foul practices. Discussion was held. The matter was referred to the March 17, 1987 hearing on the subject. 13-D: BEACH PARKING LOT/1750 APPIAN WAY: The request of Sam Israel to address Council regarding beach parking lot at 1750 Appian Way was withdrawn at his request. 14-A: THIRD STREET DEVELOPMENT CORPORATION: Presented was the matter of appointment of a member to the Third street Development Corporation. Councilmember Zane moved to continue this item to the first meeting in February. Second by Councilmember A. Katz. The motion was unanimously approved. There was no objection to Councilmember Zane's request that the City Clerk be authorized to republish the notice of vacancy. 14-8: STOP SIGNS IN ALLEYS: Presented was a request of councilmember Zane to discuss the need for stop signs in alleys. Discussion was held. Councilmember Zane introduced discussion and moved to direct staff to evaluate and bring back to us a wri tten report about the appropriateness of stop signs in the alleys in the downtown area. Second by Councilmember A. Katz. Discussion was held. The motion was unanimously approved. 14-E: COUNCIL CHAMBER USE: Presented was a request of Mayor Conn to discuss waiving the fee for use of the Council Chambers by the State Park and Recreation Commission on February 6, 1987. councilmember Reed moved to waive the fee. The motion was duly seconded and unanimously approved. 14-F: ART GALLERIES: Presented was the request of Councilmerober Finkel to discuss ways to encourage and assist City location of art galleries. Discussion was held. Councilmember Finkel moved to hear from a member of the public. Second by Councilmember A. Katz. The motion was approved. Martin Sosin, member of the Arts commission and Arts Foundation, requested Council to encourage ways of making Santa Monica attractive for arts activities. Councilmember Finkel moved to instruct staff to meet with the Arts Commission and the Planning Commission and attempt to articulate those respects in which the City can most effectively encourage art galleries, artists, in all respects, to feel the welcome mat in the City for them, even if that includes addressing zoning considerations such that the zoning laws will be designed to maximize that artistic involvement and participation in the City, and to come back with appropriate recommendations. Second by Councilmember Zane. Discussion was held. Councilmember Reed moved an amendment to direct staff to address the incubator manufacturing zone and come back with an ordinance that would permit art galleries of a certain size in the incubator manufacturing zone. The maker and the second of the motion accepted the amendment as fr iendly , thereby 2 January 20, 1987 I I 236 incorporating it in the motion. unanimously approved. The motion, as amended, was 14-I: FIRE SPRINKLER SYSTEM: Presented was the request of Cuncilmembers A. Katz and Reed to discuss and possibly direct the City Attorney to prepare an ordinance extending the compliance date for the installation of fire sprinklers in mUlti-family residential buildings over 55 feet in height. Councilmember A. Katz introduced discussion. (councilmember Jennings arrived at 8:50 p.m.) Councilmember A. Katz moved to extend the compliance date for installation of fire sprinklers in mUlti-family residential buildings over 55 feet in height until April 1st, and request an emergency ordinance be prepared to implement this. Second by Councilmember Reed. Discussion was held. During discussion, Councilmember A. Katz incorporated into the motion Councilmember Reed I s statement for the record that this motion for an emergency ordinance should be drafted as stipulated but that the lengthening of time is for those buildings which can show that they have an asbestos problem for which they need the time and for no other buildings. Councilmember A. Katz moved to hear from members of the public for three minutes each. Second by Councilmember Jennings. The motion was approved. Bob Skodis spoke in opposition to installation of fire protection systems which disturb asbestos. Dr. David Dantes requested extension of the deadline for compliance in order to thoroughly investigate the risks and merits of alternatives. Discussion was held. The motion was approved by a vote of 5 to 1, Mayor Conn opposed. 15: PUBLIC INPUT: No one was present. ll-C: CLOSED SESSION: Presented was a request for Closed Session for the purpose of considering personnel matters and threatened litigation, pending litigation and litigation to be commenced by the city. At 9:20 p.m., councilmember Heed moved to adjourn to Closed Session to consider the following cases: David v. City of Santa Monica, Santa Monica Superior Court Case No. WEC 88617; Atkinson v. City of Santa Monica, Santa Monica Superior Court Case No. WEC 95704; Grandy v. City of Santa Monica, Santa Monica Superior Court Case No. WEC 75045; Claim of Robert J. Councilmember Reed moved to approve settlement in the following cases: Higgins, $7,500; Robert J. Regan, $2,889.21; and Stevens, 3 January 20, 1987 237 The motion was $31,500.
