RESOLUTION NUMBER 396 (RAS) A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF SANTA MONICA INVOKING THE PROVISIONS OF HEALTH AND SAFETY CODE SECTION 33334.2 FINDING THAT THE PROVISION OF LOW AND MODERATE INCOME REPLACEMENT HOUSING WILL BE OF BENEFIT TO THE OCEAN PARK REDEVELOPMENT PROJECT AREA AND AUTHORIZING THE EXPENDITURE OF AGENCY FUNDS FOR SUCH PURPOSE WHEREAS, the redevelopment plans for the Ocean ParK Redevelopment Projects l(a) and l(b) (hereinafter referred to collectively as "Ocean ParK Redevelopment Project") were adopted by the City Council by Ordinance Number 497 on June 30, 1960, and Ordinance Number 516 on January 17, 1961, respectively; and WHEREAS, It was necessary for the Agency to demolish and remove approx1mately 700 low and moderate income housing units in the course of implementing the Ocean ParK Redevelopment ProJect; and WHEREAS, the Redevelopment Agency desires to replace this housing by providing housing outS1de the Project Area boundaries, available at affordable costs for persons and families of low and moderate income; and WHEREAS, Health and Safety Code Sect10n 33334.2(g) requlres that expenditure of tax increment funds for low and moderate hOUSing may only be used outSIde a Income redevelopment project area upon a resolution of the Agency and the legislative body that such use will be of benefIt to such redevelopment and further prOVides that such project, 1 . . . determination by the Agency and the legislative body shall be final and conclusive as to the issue of benefit to the Project Area; and WHEREAS, the Legislature has found and declared in Health and Safety Code Section 33334.2 that the provisIon of replacement housing pursuant to the Community Redevelopment Law is always of benefit to a Redevelopment Project; and WHEREAS, a judgment was entered in the Superior Court of Los Angeles on August 12, 1983, requiring the Agency and City to comply with the terms of an Amended Sales Agreement for Private Development (the "Amended Sales Agreement") pertainIng to completion of Phase II of the Ocean Park Redevelopment Project Area; and WHEREAS, said Amended Sales Agreement imposes a legal obligation upon the Agency to construct 5S units of housing affordable to low and moderate income persons and farn1lles within the area bounded by Pico and Lincoln Boulevards, the C1ty boundar1es, and the PacIfic Ocean; and WHEREAS, the Redevelopment Agency desires to provide f1nancing for construction of such 55 units of low and moderate income housing outside of the boundaries of the Ocean Park Redevelopment Project Area; and WHEREAS, said 55 units of low and moderate income housing will require the expenditure of $3,500,000 of Agency funds, 2 . . . . ,.-.. NOW, THEREFORE, THE REDEVELOPMENT AGENCY OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION Agency finds and The Redevelopment 1. determines that the Ocean Park Redevelopment Project will benefit by the provision of 55 units of low and moderate income replacement housing in accordance with Health and Safety Code Section 33334.2, and in accordance wlth the Agency's legal obligations to comply with the Amended Sales Agreement for of the Ocean Park Private Development Redevelopment ProJect Area which includes a requirement for the construction of such low and moderate Income housing. SECTION 2. The Redevelopment Agency hereby authorIzes the expenditure of $3,500,000 of Agency funds for purposes of increas1ng and expanding the supply of low and moderate income housing available at affordable costs within the City of Santa Monica for low and moderate income persons and families. Such expenditure of Agency funds shall be for purposes of financing S5 units of replacement low and moderate income hOUSing. SECTION 3. The Agency Secretary shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect. APPROVED AS TO FORM: ROBERT M.
