M-1/19/1993 I I I 448 CITY OF SANTA MONICA CITY COUNCIL MINUTES JANUARY 19, 1993 An adjourned meeting of the Santa Monica City Council was called to order by Mayor Abdo at 7:35 P.M. on Tuesday, January 19, 1993, in the Council Chambers. Roll Call: Present: Mayor Judy Abdo councilmember Ken Genser Councilmember Asha Greenberg councilmember Robert T. Dykhouse Councilmember Holbrook led the assemblage in the Pledge of Allegiance to the Flag of the united States of America. Also Present: Mayor Abdo announced that Mayor Pro Tempore Vazquez is absent due to his participation in the inaugural events. a-A: EFFECTIVE TIME/INTERIM ORDINANCES: Presented was an ordinance for introduction and first reading amending Santa Monica Municipal Code section 9.04.20.16.060 allowing an interim ordinance to be extended for up to 50 months and 15 days. Council asked questions of staff. At 7: 43 P.M., Mayor Abdo declared the public hearing open. Member of the public Joy Fullmer expressed her concerns. Mayor Abdo closed the public hearing at 7:45 P.M. Councilmember Rosenstein moved to introduce for first reading an ordinance entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING SANTA MONICA MUNICIPAL CODE SECTION 9.04.20.16.060 REGARDING INTERIM ZONING," reading by title only and waiving further reading thereof, with the proviso that the extension expire and not become permanent. Second by Councilmember Holbrook. Councilmember Genser moved a substitute motion to introduce for first reading an ordinance entitled: IIAN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING SANTA MONICA MUNICIPAL CODE SECTION 9.04.20.16.060 REGARDING INTERIM ZONING, II reading by title only and waiving further reading thereof. Second by Councilmember Olsen. council asked questions of staff. Discussion was held. The substitute motion was approved by the following vote: 1 January 19, 1993 449 council vote: Affirmative: Counci1members Olsen, Greenberg, Genser, Mayor Abdo Negative: Counci1members Rosenstein, Holbrook I Absent: Counci1member Vazquez Councilmember Rosenstein requested that the record reflect that he voted "no" on this item even though he has no opposition to the extension of 120 days, but he feels that continuing the length of time for moratoria discourages diligence in enacting adequate zoning measures in the Code. By virtue of the above action, the zoning Ordinance was amended to allow an interim ordinance to be in effect for up to 50 months and 15 days. 8-B: EXTENSION OF CITYWIDE MORATORIUM/NON-RESIDENTIAL/HOTEL DEVELOPMENT: Presented was an ordinance for introduction and first reading extending the Citywide moratorium on non- resident ia1 and hotel development for 120 days. At 7: 51 P . M. , Mayor Abdo declared the public hearing open. Member of the public Joy Fullmer expressed her concerns. Mayor Abdo closed the public hearing at 7: 52 P.M. Councilmember Holbrook moved to introduce for first reading an ordinance entitled: nAN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA EXTENDING THE CITYWIDE MORATORIUM ON NON-RESIDENTIAL AND HOTEL DEVELOPMENT," I reading by title only and waiving further reading thereof. Second by Councilmember Greenberg. The motion was approved by the following vote: Council vote: Affirmative: Councilmembers Genser, Greenberg, Holbrook, Olsen, Rosenstein, Mayor Abdo Absent: Mayor Pro Tempore Vazquez By virtue of the above action, the existing commercial development moratorium was extended for 120 days to June 26, 1993. 8-D: ADJUSTMENTS FOR GARAGE ACCESSORY BUILDINGS: Presented was an ordinance for introduction and first reading amending Santa Monica Municipal Code section 9.04.20.34.030 regarding adjustments for garage accessory buildings. At 7:59 P.M., Mayor Abdo declared the public hearing open. Member of the public Alan Zebker spoke in support of the staff recommendation. Member of the public Joy Fullmer expressed her concerns. Mayor Abdo closed the public hearing at 8: 01 P.M. Councilmember Genser moved to make findings and introduce for first reading an ordinance entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING SANTA MONICA MUNICIPAL CODE SECTION I 9. 04 . 20. 34 . 030 REGARDING ADJUSTMENTS FOR GARAGE ACCESSORY BUILDINGS, II reading by title only and waiving further reading 2 January 19, 1993 I I I 450 thereof. Second by Councilmember Greenberg. approved by the following vote: The motion was council vote: Affirmative: Councilmembers Rosenstein, Olsen, Holbrook Greenberg, Genser, Mayor Abdo Absent: Mayor Pro Tempore Vazquez 9-A: 1993-94 CITY BUDGET PRIORITIES: Presented was the hearing to receive public input and requesting Ci ty council direction regarding 1993-94 city budget priorities for preparation of the FY 1993-94 City budget. Member of the public Laurie Newman spoke in support of services for women and children. Member of the public Michael Hill spoke in support of HIV Project Santa Monica (AIDS awareness). Member of the public Alan Toy spoke in support of participation in Americans With Disabilities Act. Members of the public Bob Gabriel, Jack Siegal, Bill Worcester, Walt McHendry, Dorothy Ehrhart-Morrison, and Jean McNeil Wyner spoke in support of continued funding for the Convention and Visitors Bureau. Member of the public steve Ramirez spoke in support of funding for the Latino Resource Organization. Member of the public Patty Borden presented a petition in opposition to the reduction of number of hours allowed for employees of the Cultural and Recreation Department. Members of the public James Davis, Kevin Brunk, Caroline Hutchinson, Larry Arreola, and steve Mount spoke in opposition to reduction of hours allowed for employees of the Cultural and Recreation Department. Members of the pUblic Joy Fullmer and Marcelus Laidlen expressed their concerns. Member of the public Irene Zivi urged council to eliminate non-essential items such as the bicycle plan and EIR for evaluating enclave parking plan in Sunset Park before cutting items relating to children such as the Child Care Master Plan. Member of the public Harold Dunnigan urged council to continue funding for those social service agencies that serve the social needs of the community. Member of the public June Coleman spoke in support of funding for parks maintenance and recreation programs. Council asked questions of staff. Discussion was held. Councilmember Genser moved to maintain the range of services which the City has traditionally provided, ask staff to diligently investigate any savings which might result from improvement of efficiencies in City operations, ask staff to begin preparation of the first draft of the budget spreading any reductions in range of service equally, and ask staff to provide an analysis of options available for increasing revenues. Second by Councilmember Olsen. Discussion was held. Councilmember Greenberg moved a substitute motion to conduct a study session to discuss options. Second by Councilmember Holbrook. Discussion was held. Councilmember Greenberg moved to amend the motion and combine the main motion and the substitute motion. The motion was accepted as friendly by the maker of the main motion and the second. Discussion was held. Council 9-B: AMENDMENT/COMPREHENSIVE LAND USE AND ZONING ORDINANCE/ I ON-SITE REFUSE AND RECYCLING FACILITIES: Presented was the staff report recommending adoption of a resolution of intention directing the Planning Commission to initiate an amendment to the Comprehensive Land Use and zoning ordinance requiring on-site refuse and recycling facilities. Member of the public Joy Fullmer expressed her concerns. Discussion was held. Mayor Abdo moved to adopt Resolution No. 8527(CCS) entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA DIRECTING THE PLANNING COMMISSION TO INITIATE AN AMENDMENT TO THE COMPREHENSIVE LAND USE AND ZONING ORDINANCE,t1 reading by title only and waiving further reading thereof. Second by Councilmember Rosenstein. Members of the public Mary Rogers and Jim McNeal urged Council to select Schaefer ~mhulance as the contractor for emergency I ambulance transport service. Members of the pUblic Lee McNett, Gregg Chiasson, and Rob Wirtz spoke in support of the staff recommendation to contract with Goodhew Ambulance Service for emergency ambulance transport service. Councilmember Greenberg moved to award Contract No. 5919(CCS) to Goodhew ~mhulance Service for emergency ambulance transport service. Second by Councilmember Holbrook. The motion was approved by the following vote: Council vote: Affirmative: Councilmerobers Genser, Greenberg, Holbrook, Olsen, Rosenstein, Mayor Abdo Absent: Mayor Pro Tempore Vazquez 9-0: CLOSED SESSION: Held at end of meeting. 14-A: SUPPORT OF CIVIL RIGHTS OF ALL CITIZENS/REFUSAL TO PARTICIPATE IN CONFERENCES OR OTHER OFFICIAL BUSINESS IN COLORADO: Councilmember Rosenstein presented his request to discuss supporting the civil rights of all citizens by refusing to participate in conferences or other official business in Colorado. Councilmember Rosenstein moved to adopt Resolution No. 8528 (CCS) entitled: "A I RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA FORBIDDING CITY OFFICIALS AND STAFF TO TRAVEL AT CITY EXPENSE TO THE STATE OF COLORADO, IN ORDER TO EXPRESS THE CITY'S 4 January 19, 1993 I I I 452 DISAGREEMENT WITH THE PASSAGE OF AMENDMENT TWO", reading by title only and waiving further reading thereof. Second by Mayor Abdo. Councilmember Greenber9 moved to amend the motion and amend section 2 of Resolution No. 8528(CCS) to read, "This measure will be lifted if and when Colorado's Amendment Two is rescinded and invalidated by the colorado Supreme Court." The amendment was accepted as friendly by the maker of the motion and the second. Discussion was held. Item No. l4-A. was unanimously l4-A: RECONSIDERED SUPPORT OF CIVIL RIGHTS OF ALL CITIZENS/REFUSAL TO PARTICIPATE IN CONFERENCES OR OTHER OFFICIAL BUSINESS IN COLORADO: Councilmember Rosenstein moved to adopt Resolution No. 8528 (CCS) entitled: tlA RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA FORBIDDING CITY OFFICIALS AND STAFF TO TRAVEL AT CITY EXPENSE TO THE STATE OF COLORADO, IN ORDER TO EXPRESS THE CITY'S DISAGREEMENT WITH THE PASSAGE OF AMENDMENT TWO,tI as amended by Councilmember Greenberg, reading by title only and waiving further reading thereof. Second by Mayor Abde. Councilmember Genser moved to amend the motion to ask the city Clerk to mail copies of the resolution to the Governor of the State of Colorado, the State Tourism Board, and any other appropriate agencies. The amendment was accepted as friendly. City of Santa Monica, et aI, Santa Monica Superior Court Case No. SC 020 730. Council reconvened at 11:20 P.M. with all members present except Councilmember Greenberg and Mayor Pro Tempore Vazquez. 5 January 19, 1993 453 Councilmember Holbrook moved to approve settlement in the case of Pamela Weir-Quiton in the amount of $23,450. Second by Councilmember Rosenstein.
