Mayor O'Connor at 6 39 P m on Tuesday, January 7, 1997, In the Council Chambers

STUDY SESSION
88-1 Study Session regarding the Brown Act, Parliamentary Procedures, Rules of
Conduct for conducting a publiC meeting, Conflict of Interest, and Proposition
208
ACTION The City Attorney reviewed the Ralph M Brown Act legal require-
ments, parliamentary procedures and rules of conduct for the holding of public
meetings, and conflict of Interest laws for elected and appointed offiCials
As a result of the above discussion staff was directed to determine If there IS any
conflict of Interest In the City providing funding to Neighborhood ServIces Center
(NSC) It was also the consensus of City Council to direct the City Attorney to
request a legal opinion from the Attorney General's Office regarding a
councllmember's constitutional nghts to attend any kind of meeting. Includmg a
politIcal meeting, versus Brown Act limits In the gathenng of more than three
councllmembers. at the same location at the same time
The City Clerk was directed to review the current practice of agenda and minute
preparation by commiSSions and adVISOry bodies. to work With the vanous

preparation by com missions and advisory bodies, to work with the vanous I
commiSSions In the development of a city-wide policy, and to return to Council
with the proposed policy for adoption
The City Clerk reviewed known Impacts of the recently voter-approved
ProposItion 208. and adVised that the Fair Political Practices Commission was
stili grappling With the Interpretation of the new law The City Clerk adVised she
would keep Council current With the Commlsslon"s ruling on different aspects of
Proposition 208
