R-8866 e e CA:f:\atty\muni\laws\mox\fees.res city council Meeting 2-2B-95 Santa Monica, california RESOLUTION NO. 8866 (CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA REVISING VARIOUS PERMIT AND USER FEES WHEREAS, the City of Santa Monica recently completed a comprehensive analysis of all permit and user fees charged by various departments, for the purposes of updating fee amounts and thereby preserving public financial resources; and WHEREAS, various fees charged by the city's Building and Safety Division, Police Department and Environmental and Public Works Management Department were included as part of such analysis; and WHEREAS, it is the policy of the City of Santa Monica to charge for the full costs of services provided by City Staff when such services benefit individual users rather than members of the community as a whole; and WHEREAS, sections 3.56.050 and 6.20.060 of the Santa Monica Municipal Code as originally adopted authorized the setting of various Police fees by ordinance; and - 50- - e WHEREAS, section 8.04.020 of the Santa Monica Municipal Code adopted by Ordinance, the Uniform Administrative Code, 1991 Edition, including building permit and inspection fees ("Building and Safety" fees) set forth therein, as part of the Administrative Code of the City of Santa Monica, ("Administrative Code"); and WHEREAS, sections 4.12.130 and 4.12.140 authorize the setting of "After Hours Construction" permit fees for demolition, excavation, grading, construction, maintenance and repair activities; and WHEREAS, Ordinance Number 1754 ( CCS ) (the "0rdinance"), adopted July 12, 1994, governs the setting of the amount of user fees or fees for services provided to or for the benefit of particular individuals rather than the general public; and WHEREAS, the Ordinance allows such user fees or fees for services to be set by ordinance, by a resolution adopted by the City Councilor by any other means authorized by law; and WHEREAS, the City desires to revise the existing Police, Building and Safety , and After Hours Construction permit fees by this resolution, - 51 - e e NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. Sections 3.56.050 and 6.20.060 of the Santa Monica Municipal Code and the fee schedule set forth in Table 6.20.060 are hereby amended to set new fee levels as detailed in Attachments A and B to this resolution. SECTION 2. Section 8.04.020 of the Santa Monica Municipal Code and the fee schedules set forth in Tables 3A, 3A-l, 3A-2, 3B, 3C, 3D AND 3E are amended to set new fee levels as detailed in Attachments C, D, E, F and G to this resolution. Tables 3A-l, 3A- 2, 3B,3C, 3D, and 3E are superseded by the fees in such Attachments. SECTION 3. Sections 4.12.130 and 4.12.140 of the Santa Monica Municipal Code are hereby amended to set new fee levels as detailed in Attachment H to this resolution. SECTION 4. Commencing upon July 1, 1996, and on July 1 of each fiscal year thereafter, all fees established by this resolution shall be administratively revised annually by a factor equal to the difference in the Los Angeles-Anaheim-Riverside Consumer Price Index for Wage Earners and Clerical Workers for the twelve (12) month period April through April of the prior fiscal year. No later than January 1, 2000, and at least five (5) year - 52 - . e intervals thereafter, the city will conduct a comprehensive study of all fees set by this resolution to determine if fees are adequately recovering City costs for these services and the results of the comprehensive study shall be reported to the Council. SECTION 5. The Police permit fees set forth in this resolution shall be effective March 1, 1995. The Building and Safety and After Hours Construction permit fees shall be effective on May 1, 1995 pursuant to State law. SECTION 6. The city Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect.
