RESOLUTION NO. 8860

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA MAKING CEQA FINDINGS
NECESSARY TO APPROVE THE ZONING ADMINISTRATOR DETERMINATION
ALLOWING A SUPERMARKET UNDER THE TERMS OF
THE EXISTING ARBORETUM DEVELOPMENT AGREEMENT
WHEREAS, the City Council has certified an Environmental
Impact Report for the Zoning Admlnlstrator Determination allowing
a supermarket under the terms of the existing Arboretum
Development Agreement;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS.
SECTION 1. Consistent with Article VI, Section 12 of the
City of Santa Monica CEQA GUldelines and Sections 15091 and 15092
of the State of California CEQA Guidell.nes, the City Council
finds that all impacts resultlng from the project can be reduced
to an acceptable level. All significant environmental effects as
ldentlfled below can feasibly be avoided and have been ellminated
or substantially lessened.
(a) The flnal EIR determined that, without mitigation and
as compared to the development allowed under the existing
Development Agreement, development of a supermarket under the

proposed Zoning Adminlstrator Determlnation could signlficantly
lmpact traffic flow at the lntersectlon of 20th Street and
W1Ishire Boulevard in the PM peak hour period. Consistent with
Artlcle VI, Section 12 of the Clty CEQA Guidelines and Section
15091 of the State of California CEQA Guidelines, the City
Council finds that the followlng mitlgation measure has been
required in the project which wlll mitlgate these traffic impacts
to below the level of signlficance:
(1) For the intersectlon of 20th Street and Wilshire
Boulevard the applicant is required under the eXlsting
Development Agreement to restripe the northbound approach on
20th Street to provide two through lanes instead of one
right-turn only lane and one through lane. When this is
completed, the impact identified for this intersection will
be fully mltigated.
(b) The CEQA-mandated environmentally superior alternative
was found to be residential development of the site, as analyzed
fully in Scheme C in the Final EIR. This is not a feasible
alternative under the Zonlng Admlnlstrator Determlnation scenario
because the Zonlng Admlnlstrator and the City Councll have not
found resldential to be a permltted use under the terms of the
orlginal Arboretum Development Agreement.

SECTION 2. Consistent with Section 21081.6 (d) of the
California EnvlTonmental Quality Act, the documents which
constitute the record of proceedings for approvlng this project
are located ln the Planning and Communlty Development Department,
1685 Main Street, Room 212, Santa Monlca, California. The
custodian of these documents is ASSoclate Planner Drummond
Buckley.
SECTION 3. The City Clerk shall certify to the adoption of
thlS Resolution, and thenceforth and thereafter the same shall b~
in full force and effect.
