CA:f:\atty\muni\laws\mtt\srre19 City Council Meeting: 1/11/93 Santa Monica, California RESOLUTION NUMBER 8709 (City Council Series) A RESOLUTION OF THE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ESTABLISHING REGULATIONS REGARDING ENTERPRISE PERMITS WHEREAS, the City Council of the City of Santa Monica has enacted an ordinance requiring enterprise permits for enterprises providing solid waste, refuse and source separated recyclable material services; and WHEREAS, the ordinance requires that certain standards for the enterprise permit be set by resolution; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. Pursuant to Santa Monica Municipal Code Section 5.08.420, the application fee shall be Three Hundred Dollars ($300.00), payable annually with the application for an enterprise permit or renewal thereof. SECTION 2. Pursuant to Santa Monica Municipal Code Sections 5.08.430 and 5.08.470, a solid waste enterprises shall post with the Director of General Services a performance deposit of Two Thousand Dollars ($2,000.00) and a recycling enterprises shall post with the Director of General Services a performance deposit of One 1 . . Thousand ($1,000.00). SECTION 3. Prior to the issuance of an enterprise permit, and at all times during the period that the enterprise permit is in effect, the applicant shall obtain and maintain the following types and minimum amounts of insurance coverage: (a) Commercial General Liability Insurance: One million dollars, $1,000,000.00, combined single limit per occurrence for bodily injury and property damage. (b) comprehensive Automobile Liability Insurance: One million dollars, $1,000,000.00, combined single limit per accident for bodily injury or property damage. Coverage shall include environmental restoration (pollution liability) which would protect against loss, damage, or destruction of natural resources arising out of accidental discharge, disposal, release or escape into or upon the land, atmosphere, watercourse, or body of water, of any commodity transported by a solid waste enterprise. (c) Workers' Compensation: Workers' Compensation limits as required by the Labor Code of the state of California. 2 . . (d) Other Insurance provisions: (i) The city of Santa Monica; members of its city Council, boards and commissions, off icers, agents and employees are to be covered as insured as respects liability arising out of activities performed by permittee related to the solid waste permit. (ii) Insurance is to be placed with insurers admitted and licensed in the state of California; or in the case of non-admitted insurers, must be rated A:6 or better as determined by A.M. Best's rating service. (iii) Each insurance policy required by this Section shall be endorsed to state that coverage shall not be suspended, voided, canceled, reduced in coverage or in limits except after thirty (30) days written notice has been given to the Director of General Services of the City of Santa Monica. (iv) Permittee shall furnish 3 . . the city with certificates of insurance of specific coverage required herein. The certificates are to be on forms signed by a person authorized by that insurer to bind coverage on its behalf. The certificates are to be on forms provided by the city and are to be received and approved by the City before the enterprise permit is issued. SECTION 4. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
