RESOLUTION NO. 8650
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA APPROVING THE APPLICATION
FOR GRANT FUNDS FROM THE COUNTY OF LOS ANGELES REGIONAL
PARK AND OPEN SPACE DISTRICT SPECIFIED PROJECT GRANT
PROGRAM FOR LINCOLN PARK
\VHEREAS, the people of the County of Los Angeles on November
3, 19921 enacted Los Angeles County Proposition A, Safe
Neighborhood Parks, Gang Prevention, Tree Planting, Senior and
Youth
Recreation,
Beaches
and
wildlife
Protection
(the
Proposition), which provides funds to the County of Los Angeles
and other public agencies in the County for the purposes of
acquiring and/or developing facilities for public recreational
facilities and open space; and
HHEREAS, the Proposition also created the County of Los
Angeles Regional Park and Open Space District (the District) to
administer said funds; and
HHEREAS, the District has set forth the necessary procedures
governing local agency applications for grant funds under the
Proposition; and
WHEREAS, the District's procedures require the Applicant to
certify, by resolution, the approval of the application before
submission of said application to the District; and
WHEREAS, said application contains assurances that the
Applicant must comply with; and

WHEREAS, the Applicant will enter into an Agreement with the
District to provide funds for acquisition or development of the
Project;
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL HEREBY:
1. Approves the filing of an application with the County of
Los Angeles Regional Park and Open Space District for
funds under Section 8, Paragraph B, Part 1 of Proposition
A for the above Project; and
2. certifies that said Applicant understands the assurances
and certifications in the application form; and
3. Certifies that said Applicant has, or will have,
sufficient funds to operate and maintain the Project in
perpetuity; and
4. Appoints the city Manager as agent of City of Santa
Monica to conduct all negotiations, and to execute and
submit all documents including, but not limited to,
applications, agreements, amendments, payment requests
and so forth, which may be necessary for the completion
of the aforementioned Project.

Funds allocated to ApplIcant that are used for landscapmg, pIantmg trees or any other plantIng projects shall use
dnp lITIgatIOn systems and shall use drought-reSIstant or xerophytic trees, plants, la\\11 or sod, except when
applicant can show, to the DIstrict's satIsfactIOn, that such use IS mfeasIble When projects Involve the
rehablhtatIOn of eXIsting ImgatIon systems or the creatIOn of new ImgatIon s)'stems, reclaImed water should be
used whenever possible and pnonty shall be gIven to development ofrec1a1med \\-ater ImgatIOn systems
In order to mamtain the exclUSIOn from gross Income for federal Income tax purposes of the mterest on any
bonds, notes or other eVIdences of indebtedness issued for purposes of thIS grant program, Apphcant covenants to
comply with each applicable reqUIrements of SectIOn 103 and SectIOns 141 through 150 of the Internal Revenue
Code of 1986, as amended.
All grant funds allocated for projects mvolvmg the rehabIlItatIOn or restoratIon of beach, park, recreatIOn, open
space or natural lands shall be used, to the maXImum extent practical, to employ youth from the communIty In
\vhlch the partIcular rehabIlItatIOn or restoratIOn Project IS bemg carried out
To the maximum extent feaSIble, Ap.l'hcant IS encouraged to enter mto, and has authority to use funds receIved
through this grant for, agreements \\-1th commumty conservatIOn corps, the CalIfornIa ConservatIOn Corps and
other commumty organIzations, partlcularly when youth can be employed to work on restoratIOn or rehablhtatIOn
projects bemg carried out m theIr 0\\-11 comrnunItles Such agreements shall be entered mto soleI)' for the
accomplIshment of the purposes set forth m thIS apphcatIOn
Applicant \\111 proVIde reasonable pubhc access to lands acqUIred In fee WIth funds made avaIlable through thIS
grant, except where that access may Interfere WIth resource protectIon Reasonable publIc access mc1udes parkIng
and publIc restrooms
No wetlands or nparian habitat acqUIred pursuant to the PropOSItIOn shall be used as a dredge spoIl area or shall
be subject to revetment that damages the qualIty of the habItat for whIch the property was acqUIred
Applicant will comply, where applIcable, WIth proVISIons of the CalifornIa Environmental QualIty Act and the
CalIfornIa Relocation Assistance Act, and all other federal, state and local laws, rules and regulations
