RESOLUTION NO. 8630 (CCS)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE ASSESSMENT OF COSTS AND THE REPORT
OF THE SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS, DRIVEWAYS, CURBS AND REMOVAL OF
DAMAGED PAVEMENT IN THE PARKWAY AREA ON VARIOUS
STREETS (SR-93-188)
WHEREAS, the Superlntendent of streets of the City of Santa
Monica, pursuant to sections 5600-5630 of the Streets and Highways
Code, commenced proceedings to cause the repair of damaged
sidewalks, driveways, curbs, and removal of damaged parkway
pavement in the City of Santa Monica at 422 20th Street, 1033 24th
street, 514 25th Street, 602 25th street, 2445 Cloverfleld
Boulevard, 1437 Franklin street, 1636 Franklin street, 1638
Franklin Street, 1215 Grant street, 1315 Grant street, 2115 Maln
street, 1733 pine street, 1739 pine street, 1402 San Vlcente
Boulevard, and 802 Third street, all within the Clty of Santa
Monica; and
WHEREAS, Slxty days after said notlce was served, the work had
not been completed by the owners or persons in possession of the
affected properties, and the Superintendent of streets caused the
work to be done; and
WHEREAS, the Superintendent of streets gave notice to property
owners as requlred by Sectlon 5616 of the Streets and Hlghways
Code; and

WHEREAS, the Superintendent of Streets did file w1th the C1ty
Counc11 of the City of Santa Monica a report of repalrs and costs
as requ1red by Sect10n 5617 of the streets and H1ghways Code; and
WHEREAS, upon the day and hour fixed for hearing by Resolut1on
Number 8592 (CCS), the City Council of the city of Santa Monica
will hear and pass upon the report of the Super1ntendent of Streets
together with all obJections and protests as required by section
5618 of the streets and Highways Code,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The report of the Superintendent of Streets
heretofore filed and above-descr1bed be, and the same hereby is,
confirmed.
SECTION 2. All protests and obj ections of every kind and
nature to the report of the Superintendent of Streets be and the
same hereby are, overruled and denied.
SECTION 3. The cost of the repairs, as set forth in the report
of the Superlntendent of streets, shall be assessed against the
properties herein described, which properties front the s1dewalk
upon which the repairs were made.
SECTION 4. If such assessment 1S not paid w1thin the time
permitted by law, the same shall constltute a speclal assessment

aga1nst and 11en on the propert1es there1n descr1bed In the amount
set forth ln the report of the Superintendent of streets, which
11en shall continue until the assessment lS paid or unt1l it is
discharged of record.
SECTION 5.
I f the assessment 1S not pa1d ,n th1n the tlme
perm1tted by law, the Superintendent of Streets, 1n accordance wlth
Sect10n 5628 of the Streets and H1ghways Code, shall deliver a
Not1ce of Lien, prepared in the manner required by section 5626 of
the streets and Highways Code, to the County Aud1tor who shall
collect the assessnent together \11th all other taxes against the
property.
SECTION 6.
The City Clerk shall certify to the adoption of
this Resolut1on, and thenceforth and thereafter the same shall be
in full force and effect.
