RESOLUTION NO. 8590 (CCS)
(CITY COUNCIL SERIES)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
APPROVING THE ASSESSMENT DIAGRAM AND CONFIRMING ASSESSMENT
OF COSTS FOR STREET RECONSTRUCTION AND APPURTENANT WORK ON
LINCOLN COURT BETWEEN OLYMPIC BOULEVARD AND MICHIGAN AVENUE
IN CONJUNCTION WITH 1991-92 STREET RESURFACING PROGRAM
WHEREAS, the C1ty of Santa Monica, pursuant to Section 5100 et seq.
of the Streets and H1ghways Code, commenced proceedings to Reconstruct L1ncoln
Court between Olympic Boulevard and M1chigan Avenue and appurtenant work; and
WHEREAS, the proceed1ng is more fully descr1bed 1n the Resolut1on of
Intention adopted by the C1ty Council on November 12, 1991. being Resolut1on
Number 8324 (CCS); and
WHEREAS, the contract for the above-descr1bed work has been fulfilled
to the sat1sfaction of the Superintendent of Streets; and
WHEREAS, the Supen ntendent of Streets has made an assessment to
cover the sum due for the work performed and spec1fled 1n the contract; and
WHEREAS, the assessment has been f1led w1th the C1ty Clerk; and
WHEREAS, the C1ty Clerk gave the notTce requTred by SectTons 5362 and
5363 of the Streets and Highways Code; and
WHEREAS, upon the day and hour fixed for hear1ng by the Clty Clerk,
the CIty (ouncll of the C1ty of Santa Mon1ca WIll hear and pass upon any and
all objections, appeals, and protests,

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOllOWS:
SECTION 1. All obJect1ons, appeals, and protests of every k1nd and
nature be to the confirmation of assessment of costs, and the same are hereby,
overruled and den1ed.
SECTION 2. The diagram of property, affected and benef1ted by:
l1ncoln Court between Olymp1c Boulevard and Mich1gan Avenue
1n the C1ty of Santa Mon1ca, as more fully described 1n Resolut10n Number 8324
(CCS) and thereln declared to be the property to be assessed to pay the expense
of the 1mprovements, 1S approved and the C1ty Clerk 15 d1rected to execute the
cert1f1cate on the d1agram certifying such approval and to del1ver the d1agram
to the Superintendent of Streets.
SECTION 3. The assessment for:
llncoln Court between Olymp1c Boulevard and M1ch1gan Avenue
as more fully descrlbed 1n Resolut1on Number 8324 (CCS), be, and the same
hereby 1S, conf1rmed and approved.
SECTION 4. The Superintendent of Streets shall forthw1th attach a
warrant to sa1d assessment bear1ng the date of this conf1rmat1on.
SECTION 5. The assessment roll, warrant, and d1agram shall be
recorded in the Offlce of the Supenntendent of Streets, and 1mmed1ately
thereafter the City Clerk shall f1le a copy of the assessment d1agram 1n the
Off1ce of the County Recorder, and thereafter shall record 1n sa1d Offlce of
the County Recorder a Not1ce of Assessment, all 1n the manner and form

prescn bed by Sect 1 on 3114 of the Streets and Hl ghways Code of the State of
Callforma.
SECTION 6. Assessments not pald to the Clty withln the speclfled
tlme shall be sent to the Los Angeles County Assessor to collect such
assessments upon the tax roll WhlCh general taxes are collected.
SECTION 7. The C 1 ty Cl erk shall cert 1 fy to the adopt 1 on of th 1 s
Resolutlon, and thenceforth and thereafter, the same shall be In full force and
effect.
