A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA APPROVING THE ASSESSMENT DIAGRAM AND CONFIRMING
ASSESSMENT OF COSTS FOR GUTTER CONSTRUCTION, STREET
RESURFACING AND THE REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYS
AND CURBS, AND THE REMOVAL OF DAMAGED PARKWAY PAVINGS AND
APPURTENANT WORK ON VARIOUS CITY STREETS IN CONJUNCTION
WITH THE 1991-92 STREET RESURFACING PROGRAM
WHEREAS, the C1ty of Santa Monlca, pursuant to Sectlon 5100
et ~. of the Streets and Hl ghways Code, commenced proceedings to
resurface streets, construct gutters, repalr sldewalks, dr1veways and
curbs and remove damaged parkway pavings and appurtenant work on:

WHEREAS, the proceedlng lS more fully descrlbed 1n the Resolutlon of
IntentlOn adopted by the Clty Councll on Apnl 14, 1992, belng ResolutlOn
Number 8376 (CeS); and
WHEREAS, the contract for the above-descrlbed work has been
fulf1l1ed to the sat1sfactlon of the Superlntendent of Streets; and

WHEREAS, the Supenntendent of Streets has made an assessment to
cover the sum due for the work performed and speclfled in the contract; and
WHEREAS, the assessment has been flled with the City Clerk; and
WHEREAS, the Clty Clerk gave the not1ce requlred by Sections 5362
and 5363 of the Streets and Highways Code; and
WHEREAS, upon the day and hour f1xed for hearlng by the City Clerk,
the Clty Councll of the City of Santa Monlca wlll hear and pass upon any and
all obJectlons, appeals, and protests,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION 1. All obJeetlons, appeals, and protests of every kind and
nature to the conflrmatlon of assessment of costs, be and the same are hereby,
overruled and denled.

SECTION 4. The Supen ntendent of Streets sha 11 forthwl th attaeh a
warrant to said assessment bearlng the date of thlS conflrmatlon.
SECTION 5. The assessment roll, warrant, and diagram shall be
recorded ln the Offlce of the Supenntendent of Streets, and lmmedlately

thereafter the City Clerk shall file a copy of the assessment dlagram 1n the
Off1ce of the County Recorder, and thereafter shall record in sa1d Office of
the County Recorder a Not1ce of Assessment, all ln the manner and form
prescrlbed by Sectlon 3114 of the Streets and Hlghways Code of the State of
Callfornia.
SECTION 6. Assessments not pald to the Clty wlthln the speclfled
tlme shall be sent to the Los Angeles County Assessor to collect such
assessments upon the tax roll WhlCh general taxes are eolleeted.
SECTION 7. The Clty Clerk shall certlfy to the adoptlon of thlS
Resolutlon, and thenceforth and thereafter, the same shall be ln full force
and effeet.
