A RESOLUTION OF INTEI~ITZ~N OF THE CITY COUNCIL OF
THE CITY OF SANTA MONTCA SETTING A PUBLIC
HEARING ON JUNE 8, 1393, FOR THE PURP45E OF
DETERMINING WHETHER OR NOT THE PUBLIC
CONVENIENCE AND NECESSITY REQU~RE THE
CONSTRUCTION OF CONCRETE GUTTER, STREET
RESURFACING, SIDEWALK, DRrVEWAY AND CURB REPAIR
AND THE REMOVAL OF DAMAGED PAVEMENT IN PARKWAY
AREAS AND APPURTENANT WORK, IN CONJUNCTION WITH
THE FY 1992-93 STREET R~SURFACING PR~GRAM AS
SHOWN ON CITY DRAWING N~. 6463, IN THE CITY ~F
SANTA MONICA
WHEREAS, the City Council of ~he City of Santa Manica
proposes to initiate proceedings under the Impro~vement Act af
1911 and Government Code far the constructian of concxete
gutters, street resurfacing, repair nf damaged sidewalks,
driveways and curbs, and ~he remo~al of damag~d pavem~nt in
parkway areas; and
WHEREAS, Section 19 of Article XVZ af tha California
Constitutian pro~ides that certain specified d~~t limitation and
majarity protest provisions shall not apply if, after the giving
of such reasonable notice by pub~icat~on and posting and the
holding of suah public hearing as the City Council of the City of
Santa Monica shall have prescribed, the City Council, by no less
than four-fifths vate of all members thereof, finds and
determines that the public convenience and necessity require the
proposed improvements ta be made; and
WHEREAS, Streets and Highways Code Section 2804 provides
that the "Special Assessment, Investigation, Limitation and

Majarity Protest Act of 1931" shall nat a~ply to any proceeding
otherwise subject thereto when said improve~aent proceeding is by
a charter city and said city has complied with the provisions of
Section 19 of Art~.c~e XVI of the Ca~ifarnia Constit~tion; and
WHER~AS, the City of Santa Monica is a charter city of
the State of California,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FQLLOWS:

streets are to be resurfaced and the ~ethod af repair include:
age, surface and subsurface conditians, complaints received, type
af us~ (i.e., cammercial, industrial or residential}, current
tra~fa.c volume, and prajected change of use or traffic volume.
The proposed work or impro~ements ir~ ~he opini~n af City Council
of the City of Santa Monica is of more than local or ordinary
pub].ic benefit, and the City Co~ncil hereby proposed ~hat:

shown upon a certain map indicating the exterior b~undary
thereof, which said Drawing No. 6063A is on file in the office of
the City Engineex-. The map hereby is referred to and shall
govern for all details as to the extent of said assessment
district. The assessment district inc~udes in general the lots
and parcels descxibed in Section 1 abave but reference her~by is
made to said Drawing for all details as to the extent af said
assessment district and for any variation between ~.he last
mentioned general descriptian and the extent o£ sazd assessm~nt
dis~rict as shown on said map.
SECTIaN 4. No bonds will be issued far the
aforementioned assessment distra.ct.

SECTION 5. Notice is hereby given that on Tuesday, the
8th day of June~ 1993, at 6:30 P.M., in the City Cauncil Chamhers
located in City Ha~.l, 1685 Main Street, Santa Manica, CaZiforn~a,
there shall be a public hearing before saxd City Council for the
purpose o~ determining whether the public convenience and
necessity require the above-described improvements and for the
purpose of allowing any and all persons having any abjectians ta
the proposed wark or impravements to appear and show caus~ why
the said prapas~d work or impravements shall not be carried out
in accordance with said Resolution of Intention. Inquiries
concerning this pub].ic heari.ng should be directed to the
bepartment of General Servic~s, Division of Engineering, at
458-8721.
SECTION b. The City Clerk shall give notice of the
hearing by posting a cogy of this Reso2ut~on in the manner
described by the Streets and Highways Cade Sactians 5065 and 5616
and by publicatiQn as hereinafter pravided. Any interested
person may make pratest against the propos~d improvement in
writing filed with the City Cl~rk at any time not later than the
hour set for th~ hearing in the manner provided by the Streets
and Highways Code Section 5220.
S~CTION 7. The Superintend~nt of S~reets sha11 cause
ta be eanspicuously posted along the ~ine af said contemplated
w~rk or improvements and a~so aZong all the open streets within
said district, notice of the passage of this Resalutivn of
Intention in the manner and form prescra.bed by law.

The City Clerk is directed to mail notices, pursuant to
Government Cvde Section 54954.9, in the manner and form
prescribed by law, of the adoptian of this Resolu~ion to all
pers4ns owning cornmercial and industrial property in the
hereinbefare described assessment district, whose names and
addresses appear on the last equalized assessment rall for the
City taxes ar as knawn to the office o~ the City Engineer.
SECTxON 8. The Ci~y C~erk is directed to publish this
Resolution, in accordance with Government Code Section 6066, in
The aut~oak once a week far two weeks with at least five days
intervening between the first date and second date of
publication. The first publicatian is ta be made not less than
45 days prior to the date of the above public hearing,
SECTIflN 9. Pursuant to PubZic Caritract Code Saction
20433, the City Counci~ hereby finds that it is no~ in the public
interest to allow property v~rners t~ contract far ths street
resurfacing and gutter construction ~mprove~ents and thereby the
eity shall be respansible for awarding and administering the
construction contract far this district.
SECTION 10. The City Clerk shall certify ta the
adoption af this Resolution, and thereafter the same shall be in
fui1. force and e£fec~.
