R-8571• i RESOLUTION NUMBER 857I(CCS) (CITY C4UNCIL SERIES) A RESOLUTION OF INTEI~ITZ~N OF THE CITY COUNCIL OF THE CITY OF SANTA MONTCA SETTING A PUBLIC HEARING ON JUNE 8, 1393, FOR THE PURP45E OF DETERMINING WHETHER OR NOT THE PUBLIC CONVENIENCE AND NECESSITY REQU~RE THE CONSTRUCTION OF CONCRETE GUTTER, STREET RESURFACING, SIDEWALK, DRrVEWAY AND CURB REPAIR AND THE REMOVAL OF DAMAGED PAVEMENT IN PARKWAY AREAS AND APPURTENANT WORK, IN CONJUNCTION WITH THE FY 1992-93 STREET R~SURFACING PR~GRAM AS SHOWN ON CITY DRAWING N~. 6463, IN THE CITY ~F SANTA MONICA WHEREAS, the City Council of ~he City of Santa Manica proposes to initiate proceedings under the Impro~vement Act af 1911 and Government Code far the constructian of concxete gutters, street resurfacing, repair nf damaged sidewalks, driveways and curbs, and ~he remo~al of damag~d pavem~nt in parkway areas; and WHEREAS, Section 19 of Article XVZ af tha California Constitutian pro~ides that certain specified d~~t limitation and majarity protest provisions shall not apply if, after the giving of such reasonable notice by pub~icat~on and posting and the holding of suah public hearing as the City Council of the City of Santa Monica shall have prescribed, the City Council, by no less than four-fifths vate of all members thereof, finds and determines that the public convenience and necessity require the proposed improvements ta be made; and WHEREAS, Streets and Highways Code Section 2804 provides that the "Special Assessment, Investigation, Limitation and - 5 - i i Majarity Protest Act of 1931" shall nat a~ply to any proceeding otherwise subject thereto when said improve~aent proceeding is by a charter city and said city has complied with the provisions of Section 19 of Art~.c~e XVI of the Ca~ifarnia Constit~tion; and WHER~AS, the City of Santa Monica is a charter city of the State of California, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FQLLOWS: SECT~ON 1. The criteria usea to det~rntine wh~ch streets are to be resurfaced and the ~ethod af repair include: age, surface and subsurface conditians, complaints received, type af us~ (i.e., cammercial, industrial or residential}, current tra~fa.c volume, and prajected change of use or traffic volume. The assessment district inc~udes in general the lots and parcels descxibed in Section 1 abave but reference her~by is made to said Drawing for all details as to the extent af said assessment district and for any variation between ~.he last mentioned general descriptian and the extent o£ sazd assessm~nt dis~rict as shown on said map. Notice is hereby given that on Tuesday, the 8th day of June~ 1993, at 6:30 P.M., in the City Cauncil Chamhers located in City Ha~.l, 1685 Main Street, Santa Manica, CaZiforn~a, there shall be a public hearing before saxd City Council for the purpose o~ determining whether the public convenience and necessity require the above-described improvements and for the purpose of allowing any and all persons having any abjectians ta the proposed wark or impravements to appear and show caus~ why the said prapas~d work or impravements shall not be carried out in accordance with said Resolution of Intention. Inquiries concerning this pub].ic heari.ng should be directed to the bepartment of General Servic~s, Division of Engineering, at 458-8721. SECTION b. The City Clerk shall give notice of the hearing by posting a cogy of this Reso2ut~on in the manner described by the Streets and Highways Cade Sactians 5065 and 5616 and by publicatiQn as hereinafter pravided. Any interested person may make pratest against the propos~d improvement in writing filed with the City Cl~rk at any time not later than the hour set for th~ hearing in the manner provided by the Streets and Highways Code Section 5220. S~CTION 7.
