A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA SETTING A PUBLIC HEARING ON MAY 12, 1992 FOR
THE PURPOSE OF DETERMINING WHETHER OR NOT THE PUBLIC
CONVENIENCE AND NECESSITY REQUIRE THE CONSTRUCTION OF
CONCRETE GUTTERS, STREET RESURFACING, SIDEWALK, DRIVEWAY AND
CURB REPAIR AND THE REMOVAL OF DAMAGED PAVEMENT IN PARKWAY
AREAS AND APPURTENANT WORK ON VARIOUS CITY STREETS, IN
CONJUNCTION WITH THE FY 1991-92 STREET RESURFACING PROGRAM,
AS SHOWN ON CITY DRAWING NO. 6026, IN THE CITY OF SANTA
MONICA
WHEREAS, the Clty Councl1 of the C1ty of Santa Monlca proposes to
lnlt1ate proceed1ngs under the Improvement Act of 1911 for the constructlon of
concrete gutters, street resurfac i ng. rep3lf of damaged 51 dewa 1 ks, dn veways
and curbs, and the removal of damaged pavement ln parkway areas; and
WHEREAS, SectlOn 19 of Art1cle XVI of the Cal1fornla ConstltutlOn
provldes that certaln specified debt llmitatlon and majority protest
prOV1Slons shall not apply lf, after the glving of such reasonable notlce by
publlcatlOn and posting and the holdlng of such public hearing as the C1ty
Councll of the Clty of Santa Monica shall have prescrlbed, the C1ty Councll,
by no less than four-flfths vote of all members thereof I flnds and determlnes
that the publlC convenlence and necessity requlre the proposed lmprovements to
be made; and
WHEREAS, Streets and Hlghways Code SectlOn 2804 provides that the
"Speclal Assessment, Investlgatlon, llmltation and MaJoflty Protest Act of
1931" shall not apply to any proceedlng otherWl se subject thereto when sald
lmprovement proceedlng 15 by a charter Clty and sald city has complled w1th
the prOV1S1ons of Section 19 of Artlcle XVI of the Callfornia Constltutlon;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION 1. The City Council proposes to 1n1t1ate proceed1ngs for the
1nstallatlon of concrete gutters, street resurfac1ng, repalf of damaged
sidewalks. drlveways and curbs, and the removal of damaged pavement in parkway
areas, and appurtenant work adJacent to resldent1al, commerclal and industrlal
propert1es on C1ty streets as shown on Clty Oraw1ng No. 6026 on flle ln the
offlce of the City Englneer as follows:

Act of 1911, which lS contained ln Divls10n 7 and Chapter 22 of the Streets
and Hlghways Code of the State of Callfornia.

SECTION 3. The en tern used to determl ne Whl ch streets are to be
resurfaced and the method of repaH lnclude: age, surface and subsurface
condltlons, complalnts received, type of use (l.e , commerclal, lndustrial or
resldentlal), current traffic volume, and projected change of use or volume.
The proposed work or improvements 1n the oplnlon of C1ty Counc1l of the C1ty
of Santa Monlca is of more than local or ordlnary publlC beneflt, and the Clty
Counell hereby proposes that:

The dlstnct affected by the proposed work or lmprovements 1$ shown upon a
certaln map indlcating the exterior boundary thereof, which sald Drawing No.
6025 1S on f11e in the offlce of the City Eng1neer. The map hereby 1$
referred to and shall govern for all details as to the extent of sald
assessment dlstrlct. The assessment distrlct lncludes 1n general the lots and
parcels descrlbed ln Sectlon 1 above but reference hereby lS made to sald
Drawlng for all detalls as to the extent of said assessment dlstrlct and for
any varlatlon between the last mentloned general descrlptlon and the extent of
sald assessment dlstrlct as shown on sald map.
SECTION 4. No bonds wlll be lssued for the aforementloned assessment
dl stnct.
SECTION 5. Notlce lS hereby glVen that on Tuesday, the 12th day of
May, 1992, at 7:30 P.M., ln the Clty Councll Chambers located In Clty Hall.
1685 Maln Street, Santa MOnlca, Callfornla, there shall be a publlC hearing
before sald Clty Councll for the purpose of determlnlng whether the publ1c
convenlence and necesslty requlre the above-descrlbed lmprovements and for the
purpose of allowing any and all persons havlng any obJectlons to the proposed
work or lmprovements to appear and show cause why the sald proposed work or
lmprovements should not be carrled out ln accordance wlth sald Resolutlon of
Intentlon. Inqulrles concernlng thlS publlC hearlng should be dlrected to the
Department of General Servlces, Divlsion of Englneerlng, at 458-8721.
SECTION 6. The C1ty Clerk shall give not1ce of the heanng by
postlng a copy of thlS Resolut1on In the manner descr1bed by the Streets and
H1ghways Code Sectlons 5065 and 5616 and by publlcat10n as here1nafter
prov1ded. Any 1nterested person may make protest aga1nst the proposed
lmprovement 1n wnt1ng flled w1th the C1ty Clerk at any t1me not later than

the hour set for the hean ng 1 n the manner provlded by the Streets and
Highways Code Section 5220.
SECTION 7.
The Superlntendent of Streets shall cause to be
conspicuously posted along the llne of sald contemplated work or lmprovements
and also along all the open streets within sald dlstnct, notlce of the
passage of this Resolution of Intent10n ln the manner and form prescribed by
1 aw.
The office of the Clty Eng1neer lS directed to mall notlces, 1n the
manner and form prescribed by law, of the adoption of thlS Resolutlon to all
persons OWnlng commerclal, industnal or res1dentul property ln the
herelnbefore described assessment distr1ct, whose names and addresses appear
on the 1 ast equall zed assessment roll for the C1 ty taxes or as known to the
offlce of the Clty Englneer.
SECTION 8 The Clty Clerk lS dlrected to publlsh thlS Resolutlon ln
The Outlook on two succeSSlve dates. The flrst publ1catlon lS to be made not
less than flfteen days pr10r to the date of the above publlC hearlng.
SECTION 9. Pursuant to PubllC Contract Code Sectlon 20433, the Clty
Co unci 1 hereby states that the property owners may not contract for the
lmprovements and that the Clty shall be responslble for awardlng and
adm1nlsterlng the constructlon contract for thlS dlstr1ct.
SECTION 10. The Clty Clerk shall certify to the adoption of thlS
Resolutlon, and thereafter the same shall be in full force and effect.
