CM:CP:resos Santa Monica, California Resolution Number 8374(CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA PERTAINING TO REGIONAL COOPERATION ON SOLID WASTE MANAGEMENT ISSUES THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: WHEREAS, The State of California is experiencing serious environmental problems related to the management of solid waste; and WHEREAS, state legislation (AB 939) requires that all cities, counties and sanitation districts in California reduce their volume of trash hauled to landfills by 25 percent prior to 1995 and by 50 percent by the year 2000; and WHEREAS, The achievement of a reduction in the volume of solid waste which is hauled to landfills will result in significant long-term environmental and financial benefits to the City of Santa Monica; and WHEREAS, The City of Santa Monica is currently involved in a collaborative process with the neighboring jurisdictions of Beverly Hills, Culver city, Los Angeles and West Hollywood 1 . . through the westside Summit cities group to arrive at consensus solutions to regional problems; and WHEREAS, The Wests ide Summit cities recently sponsored a Five Cities Environmental Summit meeting to discuss the need for regional cooperation on solid waste problems; and WHEREAS, The Five Cities Environmental Summit meeting resulted in the adoption, by acclamation, of various specific resolutions on solid waste and recycling related issues; NOW, THEREFORE, the City Council of the city of Santa Monica does resolve as follows: 1. The City council of the City of Santa Monica supports the process to identify and pursue regional cooperation to achieve solutions to solid waste management problems. 2. The city Council of the City of Santa Monica adopts the attached six resolutions and six concurrence resolutions approved by the Five cities Environmental summit and establishes these resolutions and concurrent resolutions as policy goals of the City on solid waste and recycling issues. 2 . . 3. Resolution #1 Materials Recoverv Facilities (MRFs) WHEREAS, every city m California must achieve a 25 percent diversion of mumcipal solId waste by 1995 and a 50 percent diversion by 2000 under the mandates of AB 939; and WHEREAS, in order to fully achieve these diversion goals, cities may need to construct their own Matenals Recovery Facility (MRF) or transport their solId waste to a public or privately operated-MRF in a neighboring jurisdiction; and WHEREAS, a MRF is defined as a processmg facility where unsorted so11d waste and/or commmgled recyclables are sorted either by hand or by use of mechamcal systems mto the vanous categories of recycled matenals; and WHEREAS, it is likely that increased cost efficienCIes and increased environmental benefits can be achieved through construction of MRF facilities shared jointly by cities as part of long-term cooperative arrangements; and WHEREAS, the location and operation of a successful MRF is a matter or genume and legitimate concern for all peoples of other communities; NOW. THEREFORE, BE IT RESOLVED that the Cities of Beverly Hills, Culver City, Los Angeles. Santa Monica and West Hollywood agree to direct the WestsIde CIties Waste Management Committee to formulate a proposal for a feasibility study to examine the joint construction, funding structure, shared use, and cooperative planning for Materials Recovery Facilities in their JunsdictlOns; and BE IT FURTHER RESOLVED that any efforts within the Westside cities to cooperatively plan, develop, and operate a MRF should assure the full parttcipation of the diverse ethnic communities which live in other cities: and BE IT FURTHER RESOLVED that various options for public and/or private ownership and operation of MRFs will be explored; and BE IT FURTHER RESOLVED that representatives of the Westside cities will include the topic of MRF development in future discussions of regIOnal solid waste Issues at meetings of the WestsIde Cities Regional Summit. . . ResolutIOn #2 Creation of a Shared Yard Waste Processim~ Facilitv WHEREAS, yard wastes compnses from 10 to SO percent of the resIdentlal waste stream in most communIties; and WHEREAS, AB 939 reqUIres all cities in California to divert 25 percent of theIr solid waste by 1995 and 50 percent by 2000; and WHEREAS, the diversion of yard-waste from the solid waste stream wIll be an rmponant component of the final Source ReductIOn and Recycling Elements of the cltles of Beverly Hills. Culver City. Los Angeles. Santa MOnIca and West Hollywood: and WHEREAS, these ClUes are III the process of examming the feasIbility of developmg theIr own yard waste processmg facIlities or transporting theIr yard waste to a public or privately operated processmg facility in a neIghbonng JUrISdIctIOn: and WHEREAS, it is likely that signIficant cost efficiencies, marketing advantages and envlrorunental benefits could be gained through the cooperatIve development of a shared yard waste processmg facility by these Westslde cmes; NOW, THEREFORE, BE IT RESOLVED that the CIties of Beverly Hills, Culver City, Los Angeles. Santa Monica and West Hollywood agree to pursue the development of one or more yard waste processing faCIlities and/or green waste transfer stations which can be shared by all Westside cities; and BE IT FURTHER RESOLVED that the Westside cities l-ommn to the completIon of a jointly-funded feasibility study on a central yard-waste processmg facility, to include an examination of construction costs, siting, and marketIng Issues by January 1,1993. Resolutzon #3 . . Market Develo~ment for Recvclables WHEREAS, implementation of the provIsions of AB 939 WIll result in dramatIc Increases In the volume of materials diverted for resource recovery; and WHEREAS, the long term viabIlIty of mumcIpal recycling efforts is dependent upon the abIlity of local governments to assure reliable, stable supplies of uniformly hIgh quality matenal, to find strong markets and stable prices, and to promote local and reglOnal development for the recyclables that they collect; and WHEREAS, the regional marketIng of recyclables will provide enough volume to enter large markets and command more favorable prices for recycled matenals: and WHEREAS, cooperative marketing emp-Qwers communities to retaIn control of recychng aCtIVItIeS, costs and revenues; and \VHEREAS, cooperatIve marketIng is advantageous to new busmesses who will use recycled materials as feedstock because It prOVIdes access to a large volume of matenals through a smgle agent; and WHEREAS, assIsting the development of such businesses WIll improve demand for recycled matenals and assist local economic development; NOW, THEREFORE, BE IT RESOLVED, that the citIes of Beverly Hills, Culver Cuy, Los Angeles, Santa Momca, and West Hollywood agree to examine mechamsms for Jointly accomplIshing the following: 1. Strengthening the cines' market poSItion and marketing skills for recyclable matenals; 2. Stabthzmg supply and demand, and assuring uniformly high quality standards for recyclable matenals; 3. Improving demand for specific recycled materials which are in abundant supply on the WestsIde; and 4. Assisting the development of industrIes, busmesses, and school distrIcts WhICh utIlize recycled materials and recycled products includmg exploring Jointly participating in the development of recyclmg market development zones 5. Convemng a conference specifically on the interlock between recycled matenal market development and economic development; and BE IT FURTHER RESOLVED that the formation of a cooperative marketmg program WIll be agendized as an important topic for discussion at a future meetIng of the WestsIde CitIes RegIonal Summit; and BE IT FURTHER RESOLVED that the WestsIde cities will recognize the essentIal role of cooperatIve procurement polIcies (as provided in Concurrence ResolutIon #5) in effectIve market development. . . Resoiullon #4 Household Hazardous Waste Reduction and :\1anal!ement WHEREAS. household hazardous waste IS an IncreasIngly troubling component of the mUnICIpal sohd waste stream. and WHEREAS. state law desIgnates source reducnon (efforts to elirmnate the generanon of hazardous waste products) as the preferred method of addressmg household h:l7:1Tdous waste. and WHEREAS, recyclIng IS the preferred method of addressmg those wastes not amenable :0 source reductIon, and WHEREAS. habIIHY and operanng costs aSSOCIated WIth operann~ a household r.azardous waste prograIIl can be protubmve; and WHEREAS. the cooperatIve development of household hazardous waste source reducuon and recycimg programs can reduce costs and aVOid unnecessary duphcanon of efforts, ;.iOW. THEREFORE, BE IT RESOLVED that the ClUes of Beverlv HIlls. Culver Cltv. Los Angeles. Santa Momca and West Hollywood comnnt to the establIshment of a means to sep'arate and manage household ha7'.::Irdous waste for theIT reSIdents; and BE IT FURTHER RESOLVED that the Westslde ClUes agree to Jomtly and cooperauvely estabhsh educanonal outreach and management programs to reduce and recycle household hazardous wastes as well as hazardous waste generated from ciry operanons to the maximum extent poSSIble. and BE IT FliRTHER RESOLVED that the WestSlde ClUes work WIth busmesses lIcensed to handle hazardous waste to explore the esrabhshment of a work-SHe recychng program for household hazardous waste: and BE IT FL'RTHER RESOLVED that the Westslde ClUes comrmt to support state legIslanon to reduce lIabIlny for Clnes managmg household b:l7~rdOUS waste collected from thelT reSIdents and legIslatIon that would allow for the work-sIte collecuon of household hazardous waste: and BE IT FURTHER RESOLVED that the Westslde ClUes agree to explore the establIshment of locallegtslauon and/or stateWIde legIslauon which establIshes an advanced dISpOSal fee for hazardous household products and theIr contaIners and that fee proceeds be :.-etumed to local agenCIes for the reunbursement of household hazardous waste management COSts. and BE IT FURTHER RESOL YED that the WestsIde ClUes agree to explore the setnng of firm and aggressive goals for the reductIon. reuse, and recycling of household hazardous waste. and BE IT FL'RTHER RESOLVED that the Westslde Clues agree to explore the establIshment of permanent household b:l7~rdous waste collecnon faciliues, eIther Jomtly or md1Vldually, and an appropnate network of satellite collecuon acnvltles. . . ResolutlOn #5 Imnlementation of Variable Rates for Refuse Collection for Source Reduction WHEREAS, an important means by which waste diversion and waste reduCtlon goals can be met is the creation of economic incentives for recycling and source reduction by individual resIdential and commercial customers; and WHEREAS, one of the most effective means to create economic mcentives for recycling and source reduction.-and insure a more equitable rate structure IS through the implementation of variable rates for each customer class; and WHEREAS, rmplementatlOn of variable rates results in a system whereby regular solid waste collection and disposal charges are tied to an mdividual customer's generation of solid waste; and WHEREAS, experience has shown that a vanable rate structure SIgnificantly increases recycling participation and results in more consumer attentIon to excessive product packaging; and WHEREAS, regional cooperation and communication on the issue of vanable rates WIll benefit each of the Westside cities; NOW, THEREFORE, BE IT RESOLVED that the cities of Beverly Hills. Culver City, Los Angeles, Santa Monica and West Hollywood commit to examining the feasibility of establishing a variable rate structure for their solid waste customers by January 1,1994; and BE IT FURTHER RESOLVED that representatIves of the Wests ide CItIes will include the topic of variable solid waste rates in future diSCUSSiOns of regIOnal solid waste issues at meetings of the Westside Cities Regional Summit: and BE IT FURTHER RESOLVED that the Westside cities will mdivIdually explore the establishment of variable rates for solid waste management and will share mformation obtained during theIr efforts at meetmgs of the Westside Cities RegIOnal Summit. Concurrence ResolutlOn #1 FQrmation of the Westside Cities Waste :\fanal!ement Committee WHEREAS, the reportmg requirements mandated by AB 939 could be more easily met through the coordination of information among the Cities of Beverly Hills, Culver City, Los Angeles, Santa Monica and West Hollywood; and WHEREAS, there are economic benefits to sharing information and resources; and WHEREAS, there are many opportunIues for speCific joint programs beyond those IdentIfied by the members of the Regional Summit: NOW, THEREFORE, BE IT RESOLVED that the Cities of Beverly Hills, Culver City, Los Angeles, Santa Monica and West Hollywood Will form the West Los Angeles Region Waste Management Committee to meet once a month to coordmate integrated waste management activities, AB 939 reporting requirements, diSCUSS specific topics and develop jointly funded and sponsored projects: and BE IT FURTHER RESOLVED that the first meeting of the Westside CIties Waste Management Committee will be held at the offices of the City of Santa MOnIca on (date); and BE IT FURTHER RESOLVED that each jurisdiction will deSIgnate at least one staff member as a member of the Westslde Cities Waste Management CommIttee by January 1, 1992. . . Concurrence Resolutlon #2 Waste Reduction Education WHEREAS, reducmg wastes at the source can be the least costly and most resource efficient means of integrated waste management; and WHEREAS, AB 939 deSIgnates source reductIOn as the preferred strategy for reducmg wastes; and WHEREAS, an effectIve source reductlon program wlll involve changmg behavlOral patterns through educanon: and WHEREAS. an effecuve source reducnon program WIll provIde both the consumer and the busmess sector WIth specific mformanon regardmg how to reduce a sIgmflcant source of waste; and WHEREAS. several cines 10 the West Los Angeles area have access to mOVIe studiOS wIthin their Junsdlcnons and/or have thelT own producnon and dIstnbunon capablhnes for producmg audio and VIdeo public servIce announcements; and WHEREAS. the cooperanve development of waste reducnon educanon programs can save all ClUes slgmficant costs. avoid unnecessary duplIcauon, and allow all ClUes to take advantage of the specIal resources available to a few: ~OW, THEREFORE, BE IT RESOL VEn that the Cines of Beverly Hills. Concurrence Resolution #3 Citv Use of Comnost and Mulch WHEREAS, yard wastes currently comprise 10-50 percent of the resIdentIal waste stream in most California communities; and WHEREAS, AB 939 requires every local government to reduce solid waste disposal by 25 percent in 1995 and 50 percent in 2000; and WHEREAS, composting is likely to be a significant component of meeting AB 939 goals; and WHEREAS, the Cities of Beverly Hills, Culver City, Los Angeles, Santa MOnIca, and West Hollywood are m the process of or considenng developing compostmg faCIlities; and WHEREAS, developing a market for the compost and mulch is an important factor in the viability of such facilities, whether public or pnvate; and WHEREAS, the five CIties use soil amendments and mulch in parks, golf courses, CIty building landscapmg, street landscaping, and other public areas; and WHEREAS, the cities should act as models for residents and businesses wIthm the community in order to promote the overall goals of recycling and source reduction: ~OW, THEREFORE, BE IT RESOLVED that the Cities of Beverly HIlls, Culver City, Los Angeles, Santa Monica, and West Hollywood resolve to use soIl amendments and mulch compnsed of locally composted green waste as a first chOIce for city landscaping needs. . . Concurrence Resolution #4 Promotion of Green Waste Reduction WHEREAS. yard wastes currently compnse 10-50 percent of the reSidentIal waste stream In most Cahfonua commumues; and WHEREAS. AB 939 requITes every local government to reduce sohd waste disposal by 25 percent m 1995 and 50 percent in 2000; and WHEREAS, green wastes can be reduced through backyard composnng, leavmg grass clippmgs on the lawn, mulching and xenscape; and WHEREAS, the Metropolitan Water Distnct estrmated that homes that pracuce compostIng and mulchmg save 750-1500 gallons of water per month; and WHEREAS. reducmg green wastes complements centralized composung, by reducmg land requITements and associated costs; saves transponation energy and reduces aIr enuSSlOns from transport vehicles: and WHEREAS, a recent survey of 800 homes found that 30 percent of those polled would be very WIlling, and another 25 percent somewhat WIlling, to compost thelT own yard wastes; and WHEREAS, the City of Los Angeles is already pursumg a green waste reductIon campmgn that mcludes public educatIon about lawn c1ippmg, mulchmg. and xenscape; and WHEREAS, a combined educatIon campaIgn mvolving all five ClUes would be more effecnve and econorrucally effiCient than mdlvidual programs; ~OW, THEREFORE, BE IT RESOLVED that the Westslde Cities Waste :V1anagement Comrmttee made up of staff from the Cities of Beverly Hills. Culver City, Los Angeles, Santa Momca. and West Hollywood wLlI meet to develop a coord1ll3ted pubhc educatiOn program targetmg green waste reductIon; and BE IT FURTHER RESOLVED that the program could mclude the potennal of cooperauvely purchasmg backyard composting bins. and/or producing public service announcements. Video mstrUcnon, workshops for landscape gardeners, compo sting classes. mdlvlduahzed lOstrucnon. educanonal matenals, and other Items; and BE IT FURTHER RESOLVED that each city staff member of the Westslde Clues Waste Management Comrruttee WIll report back to their respective department, policy committee and/or CIty counCIl on the status of the program by March 1. 1992. . . Concurrence Resolution #5 Procurement of Recvcled Products WHEREAS, unplementation of the provIsions of AB 939 will result in dramatIc mcreases III the volume of materials diverted for resources recovery; and WHEREAS. without adequate promotion of markets for recycled products, it is likely that the prices paid for recyclables will continue to drop, placmg an additional financial burden on city recycling operations; and WHEREAS, numerous products manufactured WIth recycled matenals are avaIlable for purchase and use by various CIty departments; and WHEREAS~ California State Law reqUIres that local agencies buy recycled products if fitness, quality and price are equal to nonrecycled products and allows local agencies to adopt purchasing preferences for recycled products; and WHEREAS. the regional coordination of purchases will reduce the costs of recycled products to local governments and result in increased overall demand for recycled raw materials; ~OW~ THEREFORE, BE IT RESOLVED that the cities of Beverly HIlls, Culver CIty, Los Angeles, Santa Monica, and West Hollywood will establish purchasmg poliCIes maximizing city purchases of recycled products; and BE IT FURTHER RESOLVED that each CIty will appomt a representatIve from their purchasing department/division to serve on a WestsIde CIties committee to develop uniform purchasing specifications and a plan for the coordmatlon of municipal purchases among CIties by June 1, 1992; and BE IT FURTHER RESOLVED, that the Westside cities commit to a coordinated effort to contact their elected representatives in the state legislature as well as other state officials to strongly urge the adoption of comprehensive state legIslation to mandate the use of recycled materials in all applicable manufacturmg operations in the State in order to ensure stable markets and prices for recyclables. . . Concurrence Resoiunon #6 vlaterials Exchanl!e And Reuse Prol!ram WHEREAS. a use-lt-once. throw It-away mentality is costly both in terms of envrronmental degradauon and resource conservauon; and WHEREAS, a matenals exchange and reuse program involves matchmg busmesses who have matenals they no longer want to busmesses who are lookmg for such matenals through use of a computerized database and catalog system; and WHEREAS. a materials exchange program facIlitates the reuse of matenals, and promotes economIC deveiopment, market development. and envrronmental health; and WHEREAS. the CalifornIa Integrated Waste Management Board (IWMB) IS developmg a Matenals Exchange and Reuse program: :"JOW. THEREFORE, BE IT RESOLVED that the CIties of Beverly HIlls, Culver CIty. Los Angeles. Santa Momca, and West Hollywood wIll promote the Matenals Exchange and Reuse Program by: 1. Sendmg the holder of every business license a letter that informs the busmess owners about the program and encourages therr parncipauon, and 2. ProvIding a media release on the program to all media servIces located in the ClUes.
