R-8362 ~ t e e FD:JM:ckl.pub.manager/firereso city Council Meeting 2-25-92 Santa Monica, California RESOLUTION NUMBER 8362(CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA SUPPORTING LEGISLATIVE EFFORTS BY ASSEMBLYMEMBER TOM BATES TO REGULATE BUILDING FIRE SAFETY IN URBAN INTERFACE AREAS WHEREAS, disastrous fires destroying multiple buildings in Urban Interface Areas have occurred many times in the State of california, causing loss of life and precious resources; and WHEREAS, these fires rapidly cross jurisdictional areas through brush, grass and trees during conditions of hot, dry and windy weather that occur in the State; and WHEREAS, the risk of injury, life and multiple building loss within Urban Interface Areas can be substantially reduced through regulation of building proximity to combustible vegetation and slopes and their exterior construction; and WHEREAS, Assemblymember Tom Bates has proposed to introduce a 1992 Fire Prevention Act to reduce the risk of injury and loss of life and buildings in Urban Interface Areas; and WHEREAS, the act will cause the classification of lands in Urban Interface Areas by hazard and will regulate combustible roofs and the proximity of buildings to combustible vegetation; and WHEREAS, the city of Santa Monica recognizes the demonstrated effectiveness of fire protection design measures to substantially reduce the risk of injury, life and property loss from fires in Urban Interface Areas and the limitations of - 1 - .. , e e emergency response to control such loss; and WHEREAS, the city recognizes that control of loss in Urban Interface Areas requires a system of fire protection measures that includes, ultimate removal of combustible roofs, specification of fire and drought resistant green belts, control of combustible vegetation, the regulation of building proximity to slopes, the exterior design and combustibility of buildings including overhangs such as eves and patios, and emergency resources access, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA HONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The city Council hereby supports the proposed Fire Prevention Act of 1992 to be introduced by Assemblymember Tom Bates for purposes of regulating the combustibility of roofs and the proximity of combustible vegetation to buildings in Urban Interface Areas and requests that amendments be considered to the proposed legislation to include additional safety measures. Community Conference and Meeting Space is intended for uses such as human service-related conferences, direct service delivery to low income residents, forums, public hearings, training sessions, volunteer meetings, staff meetings, Soard of Directors' Meetings, and other approved activities which promote the success of local human service non-profit organizations: and WHEREAS, access to the facility should be available to all people without discrimination as to race, disability, religion, sex, marital status, economic status, or sexual preference; and WHEREAS, all organizations which use the facility follow the established procedures for application, payment when applicable and adherence to facility guidelines: and WHEREAS, the human service organizations not funded directly by the City of Santa Monica making use of a limited public facil- ity pay their just share of the cost of operating and maintaining the facility, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION l. fees for Services: The following factors will be considered in Charging the use of the Ken Edwards Center for Community A. Fees will be charged and assessed for use of the facility when: (1) The organization applying to use the facility is not a human service organization funded directly by the City - :2 - . . of Santa Monica, or is not a City of Santa Monica De- partment, Division, Board or Commission. (2) A City-funded organization exceeds its annual cap of meeting hours without charge. Additional fees may be charged when: (1) Use of the facility by any organization requires build- ing coverage or maintenance beyond that normally provided. (2) Use of the facility results in permanent damage to the facility interior, exterior or its furnishings. B. Definitions: (1) City Funded Agencies. Non-profit human service or- gani zations which are funded through the Community De- velopment Program of the City of Santa Monica. Funded programs are allowed use of the facility at no charge for 300 meeting hours each fiscal year. (2) Other Non-Profit Human Service organizations. Non-profit organizations which strive to meet the human service needs of Santa Monica residents which are not funded directly by the City of Santa Monica. Such organiza- tions are charged the non-profit fee. (3) Senior Service organizations. Non-profit organizations, not funded by the City of Santa Monica, that provide senior programming consistent with the City's Senior - 3 - . . Services Division and meet the needs of Santa Monica's senior citizens. To encourage a full range of senior services, such organizations are given a reduction in the non-profit fee when utilizing the Senior Nutrition Program Room of the ground floor. When using other ar- eas of the facility, such organizations are charged the non-profit fee. (4) Private Organizations. Those private groups convening meetings, free of charge and open to the public, that focus on human service issues that will benefit low and moderate income Santa Monica residents. Such organiza- tions are charged the private fee. SECTION 2. The following rental fees are established for the ground level of the Ken Edwards Center for Community services except for filming or taking pictures for commercial purposes. A. FEE SCHEDULE - CITY FUNDED AGENCIES There is no fee charged for City-funded agencies for the first 300 meeting hours each fiscal year. Agencies using more than 300 hours during any fiscal year wfll be charged the non-profit fee. B. FEE SCHEDULE - CITY DEPARTMENTS, DIVISIONS f BOARDS AND COMMISSIONS There is no fee charged to City Departments, Divisions, Boards or commissions. - 4 - . . C. FEE SCHEDULE - SENIOR SERVICE ORGANIZATIONS HOURLY FEE $10.00 $20.00 $25.00 Fees are based on an hourly rate according to room size with a 25% reduction in fees when utilizing the Senior Nutrition Program Room.
