RESOLUTION NO. 8331 (CCS)
City of Santa Monica
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA IN SUPPORT OF THE TOXIC CLEANUP EQUITY AND
ACCELERATION ACT
WHEREAS, large corporations which are most responsible for
polluting our nations's landfills and waterways are employing the
tactic of enjoining municipa11t~es as third parties in Superfund
lit1gation in order to pass on the burden of Superfund cleanup
costs: and
WHEREAS, the city of Santa Monica l~ke hundreds of cities
nationw~de is involved in a Superfund lawsuit; and
WHEREAS, cities have formed a national single-issue
coa11tion organization, American Communities for Clean-up Equity
(ACCE), wh1ch has lobbied for fair treatment for local governments
regarding superfund clean-up l1abilitYi and
WHEREAS, persistent lobbying efforts by ACCE have led to
the creation of the IIToxic Cleanup Equ1ty and Acceleration Acti"
and
WHEREAS, central concerns of Santa Monica and cities across
the country regarding Superfund responsibilities and related
lit1gation are addressed in the acti
NOW, THEREFORE I be it resolved that the City Council of the
C1ty of Santa Monica does hereby support the IIToxic Cleanup Equity
and Acceleration Actll and urges that it be adopted as quickly as

posslble to provide fair and equitable relief to local governments.
