A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AUTHORIZING THE CITY TO PARTICIPATE
IN THE LOS ANGELES COUNTY COORDINATED PARATRANSIT NETWORK
WHEREAS, the Americans with Disablllties Act (hereinafter
referred to as "ADA") was enacted on July 26, 1990 (PubllC Law
101-336); and
WHEREAS, on September 6, 1991, the United States Department
of Transportation (hereinafter referred to as II DOT" ) issued a
flnal rule lmplementing the transportation-related provislons of
the ADA (49 CFR Parts 27, 37 and 38, Transportatlon for
Individuals with Disabilities); and
WHEREAS, Subpart F, Sectlons 37.121 and 37.135 of 49 CFR 37
requlres that
each
fixed
route tranSl t operator provide
complementary paratransit service to dlsabled
individuals,
prepare a plan for implementation of such service and begin
service implementation by January 26, 1992; and
WHEREAS, Subpart F, Section 37.141 of 49 CFR 37 allows the
preparation and submittal of a single coordinated paratransit
plan among the operators of fixed route translt service with
overlapping and contlguous service areas; and
WHEREAS, the Clty of Santa Monica (hereinafter referred to
as "City") operates a fixed route transit system in Los Angeles

County and is required to begin lmplementation of ADA-eligible
complementary paratransit service and submlt a paratranslt plan
to DOT by January 26, 1992, and annually thereafter; and
WHEREAS, the Los Angeles County Transportatlon Commlssion
(herelnafter referred to as "LACTCII), which is mandated by state
statutes to coordinate paratransit serVlces In Los Angeles
County, has determined that the development of a countywlde
coordinated paratransit network (hereinafter known as the
IINetwork") is the most appropriate and effective means of meeting
the ADA obligatlons of the Los Angeles County flxed route transit
operators; and
WHEREAS, the LACTC has agreed to prepare the comprehenslve
DOT-required annual coordlnated paratransit plan (hereinafter
referred to as the "Planll) for all participating Los Angeles
County fixed route transit provlders who pass resolutlons
supporting the plan; and
WHEREAS, the LACTC has agreed to prepare and submlt an
interim plan including such support resolutlons to DOT by January
26, 1992, and prepare and submit the complete countywide
coordinated paratransit plan to DOT by July 26, 1992; and
WHEREAS, the LACTC has agreed to coordinate the
implementation of complementary paratransit serVlces through the
development of a countywlde paratransit network and begln
implementatlon of a coordinated paratransi t network to provlde
the ADA-mandated complementary paratranslt services; and
WHEREAS, the LACTC will provlde funding for any increase ln
paratransit servlce, above the level of elderly and disabled

transit services currently maintained by the Clty, which may be
required by the Plan; and
WHEREAS, the Clty desires to meet lts ADA-mandated
paratransit obllgations through partlclpation in the coordinated
paratransit plan and network being developed by the LACTC,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. The ci ty is commi tted to provide ADA
paratransit services and agrees to participate in the development
of the Los Angeles County coordinated paratransit plan to provide
such service in conformance with the requirements of 49 CFR Part
37 Subpart F.
SECTION 2. The city will make the followlng efforts toward
participation in the Plan:
A. Provlde relevant fiscal and operating data (as
described in Attachment A) about its current flxed route
and paratransit services to the LACTC in a timely manner
for inclusion in the required annual ADA paratransit plan.
B. Participate in the development of the Los Angeles
County consolidated ADA paratransit plan due to DOT on July
26, 1992.
C. Present such plan for city Council adoptlon prior
to June 15, 1992.
D. Elther adopt the consolidated paratranslt plan or
prepare and submit an indlvidual city paratransit plan
prior to July 26, 1992.

E. In accordance with 49 CFR Part 37.141, the City
will malntain current levels of paratransit serVlce untll
the coordinated plan goes lnto effect.
SECTION 3. The Clty Clerk shall certify to the adoption of
this Resolution, and thenceforth and thereafter the same shall be
