R-8305 e e RESOLUTION NO. 8305(CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA FINDING THE PUBLIC CONVENIENCE AND NECESSITY REQUIRES THE CONSTRUCTION OF STREET LIGHTING AND APPURTENANT WORK AND ORDERS WORK TO BEGIN ON SIXTH STREET BETWEEN SANTA MONICA BOULEVARD AND ARIZONA AVENUE AS SET FORTH IN RESOLUTION OF INTENTION NUMBER 8287 (CCS) WHEREAS, the City Council of the city of Santa Monlca, on the loth day of September 1991, passed and adopted its Resolution of Intentlon, being Resolution No. 8287 (CCS), declarlng its lntention to order work descrlbed therein to be done, which Resolution of Intention duly and legally was published as required by law and notice of said improvement has been given in the manner required by law and all wrltten objections and protests to the proposed work or the extent of the district to be assessed were heard and considered by the city Council; and WHEREAS, a public hearing has been held duly and regularly pursuant to Resolution No. 8287 (CCS) and the laws and Constltutlon of the State of California on the proposed construction of streetlighting and appurtenance work thereto I as described in the Resolution No. 8287 (CCS), on SIXTH STREET BETWEEN SANTA MONI CA BOULEVARD AND ARI ZONA AVENUE, wi thin the city of Santa Monica. WHEREAS, sald lmprovement has been considered fully, - 4 - e e NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The public interest and convenience require, and the city Council of the City of Santa Monica hereby orders, the work described in Resolution No. 8287(CCS) to be done on SIXTH STREET BETWEEN SANTA MONICA BOULEVARD AND ARIZONA AVENUE, wlthln the City of Santa Monica. Any and all of said protests and objections of every k1nd and nature to the proposed work or to the extent of the distr1ct to be assessed be, and the same hereby are, overruled and denied. SECTION 2. The ci ty Counc1l hereby finds and determines further that "Special Assessment Investigation, Limitation, and Majority Protest Act of 1931" shall not apply to the making of said improvement. SECTION 3. Improvements shall be conducted under the Improvement Act of 1911, which is Division 7 of the streets and Highways Code of the state of Californla, and the street Superintendent and the city Attorney presented to the said city Counell the Resolutlon of Intention required by said Improvement Act to 1nitiate the proceedings for said lmprovement. SECTION 4. After the bid package has been prepared, the City Clerk hereby 1S directed to post a notice for five days on or near the door of the City Council Chambers of the Clty Hall invlting sealed proposals or bids for doing the work ordered and - 5 - e e referrlng to the specifications on file and to publish a notice invltlng such proposals for two days in the Outlook, a newspaper published and clrculated in said city. SECTION 5 . Reference hereby is made to Resolution No. 8287{CCS) for a description of the work, the assessment distrlct, the bonds to be issued, and for further partlculars. SECTION 6. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be ln full force and effect. APPROVED AS TO FORM: ROBERT M.
