R /' q fi ( CCS ) (City Council Series) RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA OPPOSING SECTION 26 OF SB 402 AS IT RELATES TO 415 PACIFIC COAST HIGHWAY, URGING ITS VETO AND DIRECTING THE CITY MANAGER TO TAKE ALL NECESSARY IMPLEMENTING MEASURES WHEREAS, since 1949, the city of Santa Monica and State of California have entered into agreements authorizing the City to operate and manage Santa Monica State Beach on behalf of the State; WHEREAS, the current operating agreement for the beach was entered into in 1981 and does not expire until December 31, 2006; WHEREAS, the property located at 415 Pacific Coast Highway falls within the control of the City pursuant to the operating agreement; WHEREAS, the city has managed the state beach in good faith and in complete compliance with the operating agreement and has contributed several hundred thousand dollars of its own general funds for the maintenance, upkeep and operation of the state beach; - 1 - e e WHEREAS, under the City's stewardship, the Santa Monica beach has become the most heavily used beach in the state; WHEREAS, for the last several years the City and State have worked together to increase public use of 415 Pacific Coast Highway and to end the exclusive use of the site by a private membership beach club, the Sand and Sea Club: WHEREAS, the City evicted the Sand and Sea Club and has undertaken building renovations and established recreational and cultural activities at 415 Pacific Coast Highway in an effort to expand public utilization of the site: WHEREAS, beginning in 1988 the city began negotiations with a developer for a proposed hotel use at 415 Pacific Coast Highway; WHEREAS, following negotiations the matter was placed before the voters of the city for decision on whether the hotel should be constructed: WHEREAS, in November, rejected the proposed hotel: 1990 the voters overwhelmingly WHEREAS I Section 26 of SB 402 represents an effort to c1rcumvent the vote of the people who rejected the proposed hotel and constitutes a reneging by the state to its commitment of local control: - 2 - - It NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the city of Santa Monica strongly opposes section 26 of SB 402 and urges Governor Pete wilson to delete or line-item veto section 26 of SB 402 which pertains to 415 Pacific Coast Highway. SECTION 2 . The city Manager is directed to take all appropriate measures to implement the city council's position. SECTION 3. The City Clerk shall certify to the adoption of this Resolutionl and thenceforth and thereafter the same shall be in force and effect. APPROVED AS TO FORM: ~'^-~~ --' ROBERT M.
