A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA AUTHORIZING
THE CITY MANAGER TO EXECUTE AN
AMENDMENT TO THE MEMORANDUM OF UNDERSTANDING
WITH THE SANTA MONICA POLICE OFFICERS' ASSOCIATION (SMPOA)
WHEREAS, the City of Santa Monica and the Santa Monica
Police Officers' Association (SMPOA) entered into a Memorandum of
Understanding in June, 1987; and
WHEREAS, it is the mutual desire of the city and SMPOA to
amend certain terms of that Memorandum of understanding,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Manager is hereby authorized to
execute the attachment amendment to the Memorandum of
Understanding between the City of Santa Monica and SMPOA.
SECTION 2. The City Clerk shall certify to the adoption
of this Resolution, and thenceforth and thereafter the same shall
be in full force and effect.

AGREEMENT AMENDING
MEMORANDUM OF UNDERSTANDING
THIS AGREEMENT entered into this day of
, 1987, by and between the CITY OF SANTA
MONICA, a municipal corporation (hereinafter "city"), and the
Santa Monica Police Officers' Association (hereinafter "SMPOAII),
is made with reference to the following:
RECITALS

B. It is the mutual des ire of City and SMPOA to amend
certain terms of the MOU in order to clarify the intent of the
parties regarding their respective obligations to pay any cost
attendent upon the implementation of the PERS Health Insurance
Program pursuant to Section 3.01 of the MOU for the period
commencing July 1, 1987 through June 30, 1989.
NOW, THEREFORE, it is mutually agreed by and between City
and SMPOA as follows:

1. On and after August 1, 1987, section 3.0l is hereby
amended to add the following:
Under the "cafeteria plan, If each employee shall select
one of the following:
1. Application of the entire contribution toward the
payment of the PERS Program options described in the
fourth paragraph of this section; or
2. A cash payment, which should be used for the
purpose of purchasing health insurance under one of those
options.
If the cash payment option is elected, the employee will
be required to pay with after-tax dollars his or her share
of the PERS Health Insurance Premiums.
The amount of the cash payment shall be added to the
employee's "compensation" reported to PERS for retirement
purposes. Any additional employer and employee retirement
contribution to PERS shall be satisfied out of this cash
payment. For example, if the monthly MOU bonus amount is
$210.00, and the combined employer and employee
contribution rate is 40% of compensation, then the net
cash payment to the employee will be $150.00. Sixty
dollars ($60.00) would be paid to PERS. ($210.00 MOU
bonus amount minus $60.00 to PERS equals a $150.00 net
cash payment to the employee.)
The employee I s election under the cafeteria plan shall
remain in full force and effect and may not be changed
until the next ensuing open enrollment period.
2. Except as expressly modified herein, all other terms
and covenants set forth in the MOU shall remain the same and
shall be in full force and effect.

Agreement Amending Memorandum of Understanding to be executed
