RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA, CALIFORNIA
CONFIRMING THE ASSESSMENT IN THE CITY
OF SANTA MONICA ASSESSMENT DISTRICT
OF THE THIRD STREET MALL AREA, ORDERING
THE PROPOSED IMPROVEMENTS TO BE MADE,
AND DES I GNAT I NG THE COilllTY TAX COLLEC-
TOR TO COLLECT AND RECEIVE MONEY
WHEREAS, the C~ty Counc~l of the C~ty of Santa
Monlca by Resolutlon No. 7255 heretofore adopted by the Coun-
cll on July 15, 1986, declared lts lntentlon to order the
work to be done and the lmprovements to be made as descrlbed
~n that resolutlon as shown and deslgnated on that certaln
d1agram referred to 1n Resolutlon No. 7255, such dlagram
belng on flle ln the offlce of the Clty Clerk and the Depart-
ment of Commuolty and EconomlC Developmenti and
WHEREAS, the COUDCll 10 and by that resolutlon
conflrmed and ratlfled the "Thlrd Street Mall and Downtown
Assessment Dls~rlct Report" (the "Report") prepared by Katz,
HolllS, Coren & Assoclates, Inc. 10 accordance wlth Procedur-
al Ordlnance of the Clty of Santa Monlca No. 1377 adopted on
July 8, 1986i and
WHEREAS, the Councll set Tuesday, August 19, 1986
at 7 30 p.m. In the chambers of the Clty CaUDell, 1685 Maln

Street, Santa MonIca, Callfornla, as the tIme and place for
the hearlng of protest or obJectIons to the proposed lmprove-
ments, the extent of the assessment dlstrIct, the proposed
fee for operatlon, maIntenance and repalr of the Improve-
men~s, and the proposed assessment and provIded for notIce of
the hearlngj and
WHEREAS, the CIty Clerk has flied WIth the CouncIl
an affIdaVIt settIng forth the tIme and manner of complIance
WIth the requlrements for publlshln9, postlng and maIlIng
notlces of the passage of ResolutIon No. 7255 and of the tIme
and place for hearIng protests or obJectIons to the proposed
Improvements, and the CounCll hereby fInds that the notlce of
the passage of that resolutIon and of the tIme and place for
hearlng protests or obJectIons to the proposed Improvements
have been publIshed, posted and maIled In the tlme, form and
manner requIred by law; and
WHEREAS, the hearIng was duly held by the CounCIL
at the tIme and place for the hearIng of all obJectIons to
the proposed Improvements; and
WHEREAS, the CIty CounCIL thereupon found that the
publIC convenIence and neceSSIty requIre the proposed Im-
provements to be made;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
SANTA MONICA DOES RESOLVE AS FOLLOWS.
SECTION 1. ~he Counc~l hereby conflrrns the pro-
posed assessment ~n the amount to be determ~ned as set forth
~n the Report and declares that the Report, ~nclud~ng the
plans, spec~f~cat1ons, descr~pt~on of acqu~s~t1ons, est~rnate
of the ccs~ of the ~mprovements, assessments, boundary map
and d1agram, ~s hereby f~nally adopted, accepted, conf~rmed
and approved.
SECTION 2
The Counc11 hereby orders the work and
Improvements descr~bed 1n Resolutlon No. 7255 and 10 the
Report to be done and made.
SECTION 3. The C1ty Clerk shall transm~t to the
C~ty Tax Collector the d1agram and assessment, and the C~ty
Tax Collector ~s hereby d~rected to record the d1agram and
assessment ~n h~s/her off~ce ~n a substant~al book kept for
that purpose and upon the date of recordatlon 10 the C~ty Tax
Collec~or's Off1ce, the assessment shall become due and pay-
able, and 1n addlt1on, the C1ty Clerk 1S to record forthWlth
a not1ce of assessment 1n the Offlce of the County Recorder,
County of Los Angeles, and upon the date of such recordat1on
1n the Recorderfs off1ce the assessment shall become a lien
upon the lands upon wh~ch lt lS levled, all pursuant to Santa
Mon1ca C1ty Ord1nance No. 1377.

SECTION 4. The County Tax Collector of the County
of Los Angeles 1S hereby deslgnated to collect and rece1ve
the money pa1d pursuan~ to the assessmen~, ~n the manner
prescrlbed by law.
SECTION 5
The Clty Clerk shall cert1fy to the
adcptlon of thlS Resolutlon, and thenceforth and thereafter
the same shall be 1n full force and effect.
