A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
AMENDING THE EXECUTIVE PAY PLAN
WHEREAS, the Executive Pay Plan adopted by Resolutl.on No.
7058 (CeS) has been in effect for one year; and
WHEREAS, certain of its prOViSIons require updating to
reflect organIzational changes and to update compensation and
benefits proviSions;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1:
The CIty Councll does hereby establish an
Executive Pay Plan which defines the wages and benefIts of the
City'S Department Heads and those members of the Executive Staff
of the CIty Manager's OffIce who choose to represent themselves
indIVIdually under Ordinance No. 801 (CC8).
SECTION 2: The elements of the Executive Pay Plan shall be
as follows:

City Librarlan, Director of Civic AudItorium, Director of
CommunIty and EconomiC Development, Director of Flnance, Director

DIrector of
Inforrnatlon Services.
FIre Chief, Police Chlef, DIrector of t1unlclpal Airport, and

Budget DIrector, Senlor Management Analysts, Management Analysts,
and Risk Manager on the Cl ty Manager's staff may partIcIpate in
the Executive Pay Plan if they choose to IndIvIdually represent

Hours of Work and Overtime.
Participants 1n the
Executlve Pay Plan are exempt employees under the Fa1r Labor
Standards Act, work during normal business hours of the City and,
in addltion, devote whatever time is necessary to accompllsh the
work
of

responslbillties.
Senlor
Management
Analysts and Management Analysts asslgned to the budget process
will receive 40 hours of pald leave upon completion of the budget
season WhlCh must be taken off prlor to December 31 of the next
fl.scal year ln recognl. tion of the long hours assoc1.ated wlth
budget preparatlon. Time not taken off by December 31 shall be
forfeited with no payoff.

F. Pe rformance Based COJUEe_nsa tl.on. The City Manager or
hl.s designee shall evaluate the performance of participants l.n
the Executive Pay Plan annually. The evaluatl.on shall be made no
later than 45 days followl.ng the end of the fl.scal year. Sald
evaluation shall include an assessment of general management
skl.lls and speclfl.c accompll.shments of each indl.vidual employee.
The City Manager or hlS deslgnee shall meet wlth each indlvidual
employee to discuss the evaluation and shall establish mutually
agreed upon performance crlterla upon WhlCh the followlng year1s
evaluatlon shall be based. The oral evaluation shall be followed
by a wrltten evaluatl.on wlthln 10 worklng days If the employee so
requests or lf the City Manager or hlS deslgnee deems It
advisable.
When, in the opinlon of the Cl.ty Manager, the capabllitles and
accompllshments of an l.ndlVldual employee have been exceptlonally
merltorlOus, a cash payment of 1% to 10% of that employee1s
annual salary on June 30 of the flscal year for WhlCh performance
1S belng evaluated shall be made. The bonus shall be pald no
later than 30 days followlng the date of the evaluation. Said
payments shall be regarded as one tlme bonuses and shall not
become part of the employee I s base salary. Said payments are
subJect to retirement contributlons.
A merlt pool not to exceed 5% of the base salarles of the
partlCl.pants l.n the Executlve Pay Plan shall be established
annually from which any and all said payments shall be made.
Nothing hereln shall be construed as requlrlng that all pooled
funds be dlstrlbuted l.n any year.

If an employee recommended for a cash payment prefers, the Clty
Manager may provide pald time off in lleu of all or part of the
cash payment prov1ded that the value of the above alternative
shall not exceed the cash payment or1g1nally proposed and the
"merlt pool" shall not be considered to be increased by virtue of
election of th1S alternative.
If, 1n the oplnlon of the C1ty Manager, no cash payment or pa1d
t1me off lncentive 18 warranted by an employee's performance, the
employee shall have the opportunity to present, withln 10 days of
notlflcat1on that no payment is due, addltional informatlon that
mlght alter the C1. ty Manager IS decls1on. The dec1.sion of the
City Manager, after considerat10n of any such add1.tional
informatlon, shall be flnal and no appeal may be taken therefrom.
It 1S expressly understood by partic1pants 1n the Executlve Pay
Plan that the performance-based payments described 1.n this
sectlon do not const! tute a generally granted increase under
Section 1100 of the Clty Charter and Section 210SE of the
MunlC1.pal Code, and that denial of such payments does not
consitute a demotlon.
G. Deferred Compensation. ParticJ.pants in the Executive
Pay Plan who partlc1pate 1n the C1ty'S Deferred Compensation Plan
shall recelve from the City an amount equal to the amount that
the employee is contr1buting toward the Deferred Compensation
Plan, to a maXimum of $150.00 per month.

H. ~n.n.l!C!1 P})y?~~al Exam. PartIcipants In the Executive
Pay Plan shall recel.ve an annual physical examlnatlon at Cl. ty
expense.
I. Mental Health Insurance. Partl.cipants In the Executlve
Pay Plan shall recelve mental health insurance coverage at City
expense.
J. L.o.n.9. Term _ p_i_s_abll\ty_ Insurance. partic ipants l.n the
Executive Pay Plan shall recel.ve long term dl.sabillty insurance
coverage at Cl. ty expense. Sub] ect to the usual provis lons and
exclusions of such insurance plans, the coverage shall be for 60%
of salary after a 60 day ell.ml.natlon period.
K. Health and Dental Insurance. The City shall pay the
full preml.um of ex l.stl.ng fee-for-servl.ce or health maintenance
organizatlon (HMO) coverage for particlpants In the Executive Pay
Plan and elIgIble dependents.
L. Life Insurance. Partlclpants l.n the Executive Pay Plan
shall recelve $100,000 term life Insurance at City expense.
M. Retiree medIcal l.nsurance. Partl.cipants in the
Executi ve pay Plan whose combJ..ned ret1.remen t age and years of
Clty service equals or exceeds 70 shall be entitled to a
Cl ty-paId medlcal Insurance plan upon retIrement. For eliglble
retIrees who are between ages 65 and 70, that plan shall be a
Medlcare-supplement plan.
The CIty shall pay the premlums for the retiree only.
Payments shall cease when the retiree reaches age 70.

N. Management Leave. Participants In the Executive Pay
Plan shall receIve 72 management leave hours per fiscal year.
Payment at the employee's base salary rate for any unused
management leave days shall be payable to the employee upon
termInatIon or withIn 30 days from the end of the fIscal year in
WhICh the leave days were earned but unused at the salary rate In
effect on June 30 of the year in which they were earned.
o. Vacation Leave. PartICIpants In the Executive Pay Plan
shall recelve vacatIon leave as provided in Section 2104H of the
MunIcipal Code, provIded, however, that they may accrue a maximum
of three tlmes their annual accrual rate. In addItion, the CIty
Manager may authorIze the accrual of vacatIon beyond these limits
in indIvidual cases where the employee has been unable to use
vacatIon due to work demands.
Each employee covered hereIn shall accrue vacation leave on the
follOWIng baSIS:
I} FollOWIng completIon of the first SIX calendar months
of completed service, SIX workIng days.
2) Thereafter, up to and includIng five completed years of
serVIce, one working day for each completed calendar
month of serVIce.
3} Thereafter, up to and Including ten completed years of
serVlce, one and one-quarter (1.25) workIng days for
each completed calendar month of serVlce.

4) Thereafter, up to and includ~ng f~fteen completed years

A maximum accrual lim~t of 130 days of sick leave is applicable
to any employee who has elected payoff at any t~me dur~ng his/her
employment.
Q. Bereavement Leave. Bereavement Leave of not more than
40 hours with pay shall be prov~ded for absence from duty due to
the death of a member of the employee's ~mmedlate family, meaning
spouse,
ch~ld,
brother,
s~ster,
parent,
step-parent,
step-brother,
step-s~ster,
parent-ln-Iaw,
son-ln-Iaw,
daughter-in-law, grandparent, grandchild or any relative l~vlng
ln the same household.
R. ~ollday_~. The Dlrector of Transportatlon shall rece~ve
those pald holidays provided in the UTU MOD. The Clty Librarian
shall recelve those pald holldays provided in the Library Guild
and Library Non-Professlonals MOU. All other participants ln the
Executive Pay Plan shall receive the following paid holidays:

All Other Holidays Declared By The City Council
If the floating holiday is not taken off by June 30. it shall be
paid off in July of the new fiscal year at the rate in effect at
the end of the prior fiscal year.

Plan shall relmburse the City for any overpayment of wages or
benefits.
Sald reimbursement shall not be requlred until the
Clty notlfles the affected employee in writl.ng.
Reimbursement
may be accompll.shed by a lump sum deductlon from the next payroll
warrant lssued to the employee followlng notl.fication, or by
other reasonable repayment method mutually acceptable to the
employee and the Cl ty, except that lum sum deductl.on shall be

SECTION 3 :
This Resolutl.on shall be effective for the
perlod July 1, 1986 to June 30, 1987.
SECTION 4: The Clty Clerk shall certlfy to the adoption of
this Resolution and thenceforth and thereafter the same shall be
in full force and effect.
