R-7283 .. -- ATTACHMENT 2 e CA: RMM: DK~'il: klc City Council Meet~ng: 8/12/86 Santa Monica, Cal~fornla RESOLUTION NO. 7283(CCS) (CIty CouncIl SerIes) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT ON THE THIRD STREET MALL SPECIFIC PLAN WHEREAS, a Not1ce of preparatIon of an Environmental Impact Report was Issued In September 1986; and WHEREAS, NotIce of CompletIon of a Draft Environmental Impact Report was publIshed In AprIl 1986, In complIance wIth the CalifornIa EnvIronmental QualIty Act and the City of Santa MonIca CEQA GUIdelInes; and WHEREAS, a publIC reVIew perIod expIred In June 1986; and WHEREAS, In July 1986, the comple tion of the Final EnVHonmental Impact Report on the proposed proJect, consist1ng of the Draft EnvIronmental Impact Report, comments on the document, and responses to comments was cert1fled; and i'lHEREAS, 1n July 1986, the CI ty PlannIng CommISSIon reviewed the F1nal EnVIronmental Impact Report and recommended Its certIfIcatIon to the CIty CounCIl; and - 1 - e e WHEREAS, on August 12, 1986, the Clty CouncIl, as Lead CIty Agency, revIewed the FInal EnVlronmental Impact Report, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The CIty CounCIl has revIewed the Final EnvIronmental Impact Report on the ThIrd Street Mall SpecIfIc Plan consIstIng of the Draft EnvIronmental Impact Report, publIC comments and CIty responses. SECTION 2. The CIty CouncIl fInds that the FInal EnvIronmental Impact Report adequately reVIews and analyzes potentIal enVIronmental effects of the proposed proJect. SECTION 3. The CIty CounCIl fInds that there are no reasonable and avaIlable alternatIves to the proJect that would SIgnIfIcantly reduce the Impact on the enVIronment and and would accomplIsh the proJect obJectIves. SECTION 4. The CIty CouncIl hereby makes a Statement of OverrIdIng ConsIderatIons, pursuant to ArtIcle VI, SectIon 13 of the CIty CEQA GUIdelInes and SectIon 15093 of the State CEQA GUIdelInes, and fInds that whIle the Flndl EnvIronmental Impact Report IndIcates that there may be SIgnIfIcant effects on cIrculatIon If antIcIpated development substantIally exceeds that proJected by the Speclflc Plan, these Impacts are unlIkely to occur, and that wIth the amount of antlcIpated development, there wIll not be SIgnIfIcant adverse effects on cIrculatIon, and that as development IS proposed, approprIate analYSIS pursuant to CEQA - 2 - e e WIll be performed, and If necessary, approprIate mlt~gatlon measures wlIl be requIred of such development, and that the development standards proposed by the Speciflc Plan are necessary to aSSIst In the revltalizatlon of the Thlrd Street Mall, WhICh 15 an lmportant socIal, and economIC goal of the City of Santa Monlca, and that therefore, the potentIal lmpact on clrculatlon 15 acceptable and cannot be r~asonably avoided w1thout Jeopardlzlng the fundamental goals of the Third Street Mall SpeclfIc Plan. SECI'ION 5. The Cl ty Counc 11 hereby makes a Sta tement of OverrldIng ConsIderatIons, pursuant of ArtIcle VI, SectIon 13 of the CIty CEQA GUIdellnes and Sectlon 15093 of the State CEQA GUIdellnes, and flnds that while the FInal EnVIronmental Impact Report indIcates that there may be SIgnIfIcant effects on aIr qualIty, the proposed ThIrd Street Mall SpeclfIc plan incorporates a number of mItIgatIon measures In Its ParkIng and CIrculation and Conservatlon Elements WhICh WIll reduce, although not elImInate aIr qualIty effects, that a CItY-WIde Transporta.tlon Systems t'1anagement plan which Will address approprIate mItIgatIon measures to reduce veh1cle trIps for IndIVIdual proJects 15 1n preparation, that the amount of development proposed by the Th1rd Street Mall Plan 15 necessary to promote reVItalIzatIon of the area, WhICh 1S an important soc1al and econom~c goal of the Cl. ty and that therefore, the potentIal 1mpact on alr qualIty IS acceptable and cannot be reasonably avo1ded WIthout JeopardIZIng the fundamental goalS of the ThIrd Street Mall SpeCIfIC Plan. - 3 - e e SECTION 6. The CIty CouncIl certIfIes that the envIronmental reVIew for the proJect was conducted In full complIance wIth State and Cl ty CEQA GUIdelInes, that there was adequate publIC reVIew of the Draft Envlronmental Impact Report, that the Cl ty Councll has conSIdered all comments on the Draft EnVIronmental Impact Report, and responses to comments, that the FInal Envlronmental Impact Report adequately dIscusses all slgnlflcant envIronmental issues and that the Clty CounCIl has conSIdered the contents of the Flnal EnVIronmental Impact Report In Its decISIon-maklng process. SECTION 7. The Cl ty Clerk shall cer tlfy to the adoptIon of thIS ResolutIon, and thenceforth and thereafter the same shall be In full force and effect. APPROVED AS TO FORM: ~ ""'"' \-- ROBERT M.
