RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEWAYS AND CURBS (SR-86-84)
WHEREASt the Street Superintendent of the City of Santa
Monica, pursuant to Sectlon 5600 to 5630 of the Streets and Highways
Code, commenced proceedlngs to cause the repaIr of damaged sIdewalks,
driveways and curbs in the Clty of Santa Monica at 2215 Marine Street,
228 Eucl id Street I 238 19th Street, 1625 Ashland Avenue, 434 14th
Street, 2504 32nd Street, 1002 Washintop Street, 404 21st Street, 1620
Ashla~d Avenue, 1410 15th Streett and 238 19th Street, all within the
CIty of Sapta MonIca.
WHEREASt SIxty days after said order was served, the work had
not beep completed by the owners or persons in possessIon of the
affected properties, and the Superintendent of Streets caused the work
to be done; and
WHEREAS, the Superintepdent of Streets gave the notice
required by SectIon 5616 of the Streets and HIghways Code; and
WHEREAS, the Superlntendent of Streets did fIle wlth the City
Council of the CIty of Santa MonIca his report of repalrs and cost as
required by Section 5617 of the Streets and Hlghways Code; and
WHEREAS, upon the day and hour fixed for hearing by Resolution
Number 7239 (CCS), the City CouncIl of the City of Santa Monica heard
and passed upon the report of the Superintendent of Streets together

Streets and Highways Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION
1 .
The report of

SECTION 2. All protests and obJect Ions of every kInd and
nature to the report of the Superintendent of Streets be and the same
are hereby overruled and denIed.
SECTION 3. The cost of the repairs, as set forth 1n the
report of the Superintendent of Streets, shall be assessed against the
properties therein described, Wh1Ch propertIes front upon the sidewalk
upon which the repairs were made.
SECTION 4. If such assessment IS not pa id WI thi n the time
permitted by law, the same shall constItute a special assessment
against and lien on the propertIes therein descrIbed, in the amount
set forth in the report of the SuperIntendent of Streets, WhICh lIen
shall contInue until the assessment and all interest thereon 1S pa1d
or untIl It is discharged of record.
SECTION 5. If the assessment is not paid WI th1n the time
perml tted by law, the Superintendent of Streets, in accordance wi th
Sectlon 5628 of the Streets and Highways Code, shall deliver a Notice
of LIen, prepared 1n the manner requIred by Section 5626 of the

Streets and Highways Code, to the County Auditor who shall collect the
assessment together with all other taxes aga1nst the property.
SECTION 6.
The Cl ty Clerk shall certify to the adoptlon of
this resolution and thenceforth and thereafter the same shall be in
full force and effect.
