SANTA MONTCA, DECLARING ITS INTENTION T4 ESTABLISH
AN ASSESSMEIVT DISTRICT TO PROVIDE FOR THE LE~TY AND
CdLLECTION OF ASSESSNIENTS TO E~NANCE IMPROVEMENTS
TO THE THIRD STREET MALL AREA. TiND DECLt~RING ITS
INTENTION T~ ADOPT AN ORDINANCE TO ESTABLISH A FEE
FOR THE OPERATION, MAINTENANCE AND REPAIR OF SUCH
IMPR~VEMENTS.
WHEREAS, the Caty Counc~]. of the Czty of San~a
Monzca proposes to particzpate in the acqu~sition, construc-
t~.on and £~nanc~ng of certa~n improvements relat2ng to the
Santa Mon~ca Th~rd Street Mall and perzpheral area; and
WHEREAS, at has b~en determined by the City Council
that proceed~ngs be commenced and canducted for the prelimi-
nary steps for tk~e format~on of an assessment district and
the Ievy~ng of assessments to f~nance such impravements;
NOW, THEREF~RE, TH~ CITY ~OUNCIL OF THE CITY 4F
SANTA MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That this City Cvunc~.l hereby declares
its intentzon to e~tablish an assessment d~strzct.
SECTI~N 2. That the "ThYrd Street Mall and Dot~tn-
town Assessment Dzstr~ct Report" (the "Report"} prepared by

Procedural Ordinance Na. 1377 of tha City adopted an July 8,
1986, is hereby can£irmed and ratified and shail be £~led
wx~h the City Clerk.
SECTION 3. That it is the intention of the C~ty
Caunc~.~ to determ,ine that the public conve~~ence and necessa-
ty require ~mprovements to be made in ~he area o£ the Th~rd
Street Mall and periphera~ area. The proposed improvements
(the "Improvements") shall znclude, but not be limYted to the
~tems set forth in Exhlbit A to the Report attached hereto.
SECTION 4. That the baundaries of the prvposed
assessment district are descrlbed in Exhib3t B to the Report
attached hereto.
SECT20N 5. That the district to be benef~ted by
the ~mprovements be assessed to pay costs and expenses there-
of and to be known as an assessment dis~rict, sha11 be all
that part of the City af Santa Mon~ca, within the pro~ect
area ha~ing exterior boundaries as shown on the assessment
distr~ct diagrasn set for~h in Exhibit B to the Report at-
tached hereto. Reference as hereby made to the diagram for a
ful~. and campl.ete descraption of the assessment dis~rict and
the diagram shall goverrs for all details as to the extent of
the assessment distrzct.

SECTION 6. That it is the intention of the City
Councfl to adopt an ordinance €t~e "Ordinance") to 1~vy an annual
f ee ( the " Fee °) f or t3~e o~pe rat i on , ma i nter~ance and repa i r of the
Improvements. The Ordinance will provide:
A. The Fee shail be equal ta ffve times the annual
B+xsiness Li.cense Tax establ.istted purst~ant to Artic].e VI of the
Santa Monica Munfcipal Code on businesses witt~in Lhe district;
B. The Fee shail be callected in the same manner, at
the same time, and subject to the same per~alties as the B~siness
License TaX established pursuant to Art~cle Vi of the Santa
Monica Municipal Cod~;
C. The City Gouncil by Resolution may adjust the
a~nount of the Fee an ail or classes of businesse~ within the
district to the extent necessary to assure t3~at revenues frnm the
Fee do nat exceed th~ cast of operat~on, mafntenance and repair
of the Impravements and to assure that the Fee r~asonably relates
ta Che benefits of the Improvements.
D. In no ~vent shall the amount af the Fee exceed the
lesser of five times GYse annual ausiness License Tax or
SiS,OQQ,00 adjusted ~nnually by increases in the Cor~sumer Price
Index.
SECTTOI~ 7. T~e City Council proposes ta find and
det~rmine that the gublic convenience and nece~sity require t~e
Improvements. A public hearing for hearing protests and
objections to the proposed Im~rovements and the Ordinanc~ wfll be

held on Tuesc}ay, August 19, 1986, in the City Council Chamk~~cs,
1685 Hain Street, Santa Manica, California, at 7:30 ~.m. The
City Clerk shall cause all notices af the hearing to be posted
and mailed as required by applicable ~aw. When notice by
publicatio~ is required, the City Clerfc shall publish such notice
in the Evening Outlook, a newspaper of generai circulation
published in the City of Santa Monica. After such hearing, if
the City Gour~cil finds and determines that the public convenience
and nece~sity requfre the Improvements, it may order the
Imprnven~ents and adopt the Ordinance.
SECTION B. The City Cleric shall certify to the
adoption af th~s Resolution, and thenceforth and thereafter the
same shall be fn full force and effect.

Third Street Mall and ac~jacent arass. Ta thie end, ARCHIPLAN has reviewed
the recarnmended ~tnprovement~, ~pdated esti.mated co~ts where necesearY,
identified the ta~estion of specific improvements, ana preparad geo~r~phic
boundarieB identitying the locataon of tI~ree geogrsphicsi z~nes of benefit.
I[at~, Hollis, Coren & As~ciatea h~s calculated the allaastion of ~enefit for
each property owner basec~ on the cost of impravements, the annuai
pr~ncipal and interest payments required to retire tho~se aasta, and Lhe total
grase floor ~erea in each zane. The cansultsnts have al~o relied on o~ttaide
bond counse€ and undet~~riter aervices, provided by D'Melveng dc Meyers
snd Rauacher Pierce Ref~nes, Inc., re~pectively.
During this process, Ci#,y and TSDC staff have met with various s~fected
groups including the Santa Manica Chamber of Comtnerce, the Third Street
Merc~ant and Praperty Ownera Assaci$tiona snd have conducted SpBC1P2C
meetings wiLh individual merchants and property owners on Third, Fourth,
and Secand Streeta. The pctrpase of these meeting's ha~ been ta diacus~ the
Draft Plan, the proposed exterior assessment dis#.riet boundaries and zones~
