RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEWAYS AND CURBS (SR-86-82)
WHEREAS, the Street SuperIntendent of the City of Santa
MonIca, pursuant to Section 5600 to 5630 of the Streets and Highways
Code, commenced proceedings to cause the repair of damaged sIdewalks,
dr 1 veways and curbs In the CIty of Santa MonIca at 1127 Grant St.,
1503 Maple St., 1502 Maple St., 2025 HIll St., 2015 HIll St., 1508
18th St., 1517 18th St., 1543 18th St., 1547 18th St., 1535 18th St.,
1418 10th St., 1423 10th St., 1444 10th St., 1417 11th St., 1425 11th
St., 1443 11th St., 827 10th St., 833 10th St., 924 10th St., and 1117
10th St. all wIthIn the City of Santa MonIca.
WHEREAS, SIxty days after said order was served, the work had
not been completed by the owners or persons In possession of the
affected properties, and the SuperIntendent of Streets caused the work
to be done; and
WHEREAS, the Superintendent of Streets gave the notice
required by Section 5616 of the Streets and HIghways Code; and
WHEREAS, the SuperIntendent of Streets dId fIle wIth the CIty
CouncIl of the City of Santa Monica hIS report of repaIrs and cost as
requIred by Section 5617 of the Streets and Highways Code; and
WHEREAS, upon the day and hour fixed for hearing by ResolutIon
Number 7220 (eCS), the CIty Council of the City of Santa MonIca heard
and passed upon the report of the SuperIntendent of Streets together

wi th all obJectIons and protests as requIred by Section 5618 of the
Streets and HIghways Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION
1.
The report of

SECTION 2. All protests and objections of every kind and
nature to the report of the SuperIntendent of Streets be and the same
are hereby overruled and denied.
SECTION 3. The cost of the repaIrs, as set forth in the
report of the Super1ntendent of Streets, shall be assessed agaInst the
propertIes therein described, WhiCh properties front upon the sIdewalk
upon which the repa1rs were made.
SECTION 4. I f such assessment 1 s not pa id WI thi n the time
permitted by law, the same shall constItute a special assessment
against and lien on the propert ies therein descr 1 bed, 1n the amount
set forth in the report of the SuperIntendent of Streets, Wh1Ch lien
shall continue untIl the assessment and all interest thereon is paid
or until it is dIscharged of record.
SECTION 5. If the assessment is not pa id wi thin the time
perroi tted by law, the Superintendent of Streets, in accordance wIth
SectIon 5628 of the Streets and H1ghways Code, shall delIver a NotIce
of Lien, prepared in the manner required by Section 5626 of the

Streets and Highways Code, to the County AudItor who shall collect the
assessment together wIth all other taxes against the property.
SECTION 6. The Cl t Y Clerk shall cert ify to the adoptIon of
thlS resolution and thenceforth and thereafter the same shall be in
full force and effect.
