RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEWAYS AND CURBS (SR-86-81)
WHEREAS, the Street Super~ntendent of the City of Santa
Monica, pursuant to Section 5600 to 5630 of the Streets and Highways
Code, commenced proceedIngs to cause the repair of damaged sidewalks,
dr~veways and curbs in the C1ty of Santa Monica at 1927 17th Street,
625 EuclId Street, 2019 Hill Street, 2437 Hill Street, 2255

WHEREAS, sixty days after said order was served, the work had
not been completed by the owners or persons 1n possession of the
affected properties, and the SuperIntendent of Streets caused the work
to be done; and
WHEREAS, the SuperIntendent of Streets gave the notice
required by Sect10n 5616 of the Streets and Highways Code; and
WHEREAS, the Superintendent of Streets dId file with the City
Council of the City of Santa MonIca his report of repairs and cost as
required by Sectlon 5617 of the Streets and Highways Code; and

WHEREAS, upon the day and hour fixed for hearing by Resolution
Number 7208 (CCS), the City Council of the City of Santa Monica heard
and passed upon the report of the Superl~tendent of Streets together
wi th all obJect1ons and protests as required by Sect10n 5618 of the
Streets and Highways Code;
NOW, THEREFORE, THE CITY COUNC IL OF THE CITY OF SAN! A MONI CA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The report of the
heretofore filed and above-described be
confirmed.
Superintendent
and the same
of
Streets
is
hereby
SECTION 2. All protests and obJections of every kind and
nature to the report of the Superintendent of Streets be and the same
are hereby overruled and denied.
SECTION 3.
The cost of the repairs, as set forth in the
report of the Superintendent of Streets, shall be assessed aga1nst the
properties thereIn described, WhiCh properties front upon the sIdewalk
upon WhICh the repairs were made.
SECTION 4. If such assessment is not paid W1 thin the time
permitted by law, the same shall constItute a spec1al assessment
aga1nst and lien on the propertIes therein descrIbed, 1n the amount
set forth In the report of the Superintendent of Streets, WhICh lien
shall continue until the assessment and all interest thereon is pa1d
or until It is discharged of record.
SECTION 5. If the assessment 1S not paid wi thin the time
permi tted by law, the Super intendent of Streets, in accordance Wl th

SectIon 5628 of the Streets and Highways Code, shall del1ver a Notice
of Lien J prepared in the manner requIred by Section 5626 of the
Streets and Highways Code~ to the County AudItor who shall collect the
assessment together wIth all other taxes against the property.
SECTION 6. The City Clerk shall cert1fy to the adoption of
this resolut1on and thenceforth and thereafter the same shall be in
full force and effect.
