RESOLUTION NO. 7229(CCS)

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT
OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEWAYS AND CURBS (SR-86-80)
WHEREAS, the Street SuperIntendent of the City of Santa
MonIca, pursuant to SectIon 5600 to 5630 of the Streets and HIghways
Code, commenced proceedings to cause the repalr of damaged sidewalks,
driveways and curbs In the City of Santa MonIca at 3002 Delaware Ave.,
506 Palisades Ave., 908 22nd Street, 1128 22nd Street, 1114 22nd St.,
1121 22nd St., 1106 22nd St., 1050 Centinela Ave., 1042 Cent1nela
Ave., 853 20th St., 845 20th St., 807 20th St. 833 20th St., 811 20th
St., and 817 20th St., all within the City of Santa Monica.
WHEREAS, sixty days after sald order was served, the work had
not been completed by the owners or persons 1n possesSIon of the
affected properties, and the Superintendent of Streets caused the work
to be done; and
WHEREAS, the Superintendent of Streets gave the notice
requ1red by SectIon 5616 of the Streets and Highways Code; and
WHEREAS, the Superintendent of Streets did fIle with the CIty
CouncIl of the City of Santa Mon1ca his report of repairs and cost as
required by SectIon 5617 of the Streets and HIghways Codej and
WHEREAS, upon the day and hour fIxed for hearing by Resolution
Number 7195 (CCS), the City Counc1l of the City of Santa Monica heard
and passed upon the report of the Superintendent of Streets together

with all obJect1ons and protests as requlred by Sectlon 5618 of the
Streets and Highways Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CrTY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1.

SECTION 2. All protests and obJections of every kind and
nature to the report of the Super1ntendent of Streets be and the same
are hereby overruled and denied.
SECTION 3. The cost of the repa1rs, as set forth 1n the
report of the Superintendent of Streets, shall be assessed aga1nst the
properties therein described, which propertles front upon the sldewalk
upon which the repairs were made.
SECTION 4. If such assessment is not pa1d wi th1n the time
perm1tted by law, the same shall constltute a special assessment
against and lien on the propertles therein described, in the amount
set forth 1n the report of the Superlntendent of Streets, which lien
shall continue unt1l the assessment and all loterest thereon is paId
or untll it 1S discharged of record.
SECTION 5. I f the assessment is not pald wi thIn the t1me
perml t ted by law, the Super Intendent of Streets, in accordance W1 th
Section 5628 of the Streets and Highways Code, shall deliver a Notice
of Lien t prepared 1n the manner required by Section 5626 of the

Streets and Highways Code, to the County Auditor who shall collect the
assessment together with all other taxes against the property.
SECTION 6.
The City Clerk shall cert1fy to the adoption of
thlS resolutIon and thenceforth and thereafter the same shall be in
full force and effect.
