CITY OF SANTA MONICA
PERTAINING TO PICTURES FOR
COMMERCIAL PURPOSES

non-proflt filmlng shall also be governed by thls Resolutlon.
No commercial fllmlng shall be accomplished wlthout first
obtainlng the appropriate permlts and approvals as defined
hereln.
B. Appllcatlons for such permlts shall be made upon
forms provlded by the Department of General Servlces. Such
permlts shall speclfy the locatlon to be used, the dates(s)

and t1me(s) for WhlCh such permit 1S desired and shall set
forth such spec1al cond1tlons regarding the use of such
perIT1ts as the Director of General Servlces (or hlsjher
oes1gnate) shall, in his/her dlscretion, determlne.
Such permits shall also set forth the fee or charge WhlCh is
to be pa1d to the City at the time the permit 15 issued.
Each permlt shall speclfy that no reference shall be made by
dlalcgue or plcture to the Santa Monlca Police Department,
lts offlcers or personnel, or to the Clty of Santa Monlca,
except as persons fam111ar wlth the commun1ty might recognlze
the locale.

A. FEES
Fees to be charged for the lssuance of a fllm permit for each
calendar day or portion thereof are hereby established as

B. ASSOCIATED CHARGES
1. charqes for After Hours Use of Non-Sworn city
Personnel
The use of any location or area wh~ch occaSlons speclal
d~fficulty or expense to the City, thereby requlring the use
of non-sworn City personnel (i.e., other than pollce and fire
personnel) in any capaclty in connection with such commercial
filmlng or photography, and for the use of City personnel for
general asslstance, supervlsion, or other purposes for such
fllming or photography outslde of regular work hours, a per
hour charge of two times the overtlrne salary for each
employee for a rnlnimum of four hours, shall be made agalnst
and payable by the permittee to the city.
2. Penalty Fees
In the event that a permittee or other person violates the
proV151ons of Sectlon 3 relatlng to allowable hours of
fllmlng activity, said activity will be immediately stopped
and penalty fees shall be charged as follows:

Sectlon 3. SPECIAL PROVISIONS
A. The follow~ng are special prov1sions for f~lming
wlthin certaln areas ln the City:
1. Airport
No alrcraft shall be brought to Santa Monlca Airport for
commerclal fllmlng purposes unless it complies wlth the 95
deClbel maximum nOlse limlt established by the Santa Monlca
Clty Council. Any aircraft used for this purpose must be
approved by the Alrport Dlrector.
2. City Hall
Interlor shooting shall only be allowed on non-workdays or
after 6 p.m. on workdays upon approval by the City Manager.
3. Commercial Areas
No fllming shall be allowed In coromerclal areas from the day
before Thanksglvlng to January 2. In addition, lf there is
any residence located within 250 feet of the proposed filming
slte, fllmlng may only take place between the hours of 8 a.m.
and 10 p.m.
4. Resldential Areas
Filmlng ln any residentlal nelghborhood of the City shall
only be allowed between the hours of 8 a.m. and 10 p.m.

B. INSURANCE
Each permit shall conta1n a statement that the perm1ttee
holds the Clty harmless from any and all liabillty for
personal lnjury and property damage arislng out of the use of
the permit and the use of City property and facl1ities. In
addition, as a condltion of the issuance of a permit, the
permittee shall first provlde public liabllity insurance
naming the Clty of Santa Monica, lts City Councll, boards and
commissions, officers, agents, servants and employees as
co-insures, In amounts of not less than a combined
single-limit POllCY with aggregate limlts as determlned by
the Clty's R1Sk Management Division and required by that
offlce in the amount not less than $1,000,000. Such
certificate of lnsurance shall be furnished to the Dlrector
of General Servlces or his/her deslgnate and shall further
contain a provlslon that notice in writing is to be provlded
to the Director of General Servlces or hls/her deslgnate
wlthin thirty (30) days prlor to cancellation of such policy.
C. DENIAL OF PERMIT
The Director of General Services or his/her designate, upon
appllcation for a permit, shall reVlew the same, and may seek
the advice of such other City departments as may be affected
by the requested fllming or photography activlties prior to
lssuance of such a permlt. If the Director or his/her
designate finds that the lssuance of such a permlt would

constitute a hazara to the welfare of the communlty or its
cltlzens, pose a threat to publlC safety, endanger Ilves or
property, or unreasonably disrupt, impede or block any publlC
street, sldewalk or rlght of way, he or she may refuse to
lssue the permlt applied for.
D. STUDENTS AND NON-PROFIT ORGANIZATIONS
Students shall supply a wrltten certificate from the school
of thelr attendance which shall state that they are bona-fide
and currently enrolled students of such school. Nonprofit
organlzatlons shall supply a certlficate statlng that they
are exempt and classlfled as nonprofit under federal and
state taxing statutes.
E. EDUCATIONAL FILMS
For the purposes of this Resolution, an educatlonal fllm
shall be one WhlCh provides instruction, especially for
students, ultl~ately llmlted to classroom use, and a film for
WhlCh no admlSSlon charges wlll be made. The Director of
General Servlces or his/her deslgnate shall have discretion
hereunder to determlne, pursuant to this subsection, whether
the object of a permlt appllcation is for commerclal or for
educational fllming.
F. The prOV1Slon of this resolutlon shall not apply to
the Santa Monlca civic Auditorlum, and fees for the use

thereof shall otherwlse be set.
SECTION 4. CERTIFICATION
The Clty Clerk shall certify to the adoption of thlS
resolution, and thenceforth and thereafter the same shall be
