A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA APPROVING EMERGENCY RULES
AND REGULATIONS PROMULGATED BY THE DIRECTOR
OF EMERGENCY SERVICES
WHEREAS, on April 3D, 1992, the c~ty Council of the c~ty of
Santa Monica adopted Resolut~on Number 8399 (CCS) declaring a
local emergency and approved Emergency Order Number 1 of the
Director of Emergency Serv~ces; and
WHEREAS,
the
Director
of
Emergency
services
issued
Emergency Orders 2, 3, 4, 5, and 6 conta~ning rules and
regulations promulgated pursuant to the provisions of Municipal
Code section 2305; and
WHEREAS, Mun~cipal Code Section 2305 requ~res that the c~ty
Council of the city of Santa f10nica approve and conflrm any
emergency rules and regulat~ons at the earliest practlcable time,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1.
The Cl ty Council of the City of Santa Monlca
does hereby approve and confirn Emergency Orders Number 2, 3, 4,
5, and 6 attached hereto as Exhibit A.

SECTION 2. The Clty Clerk shall certify to the adoption of
this Resolution, and thenceforth and thereafter the same shall be
in full force and effect.

Pursuant to the Emergency Proclamation issued by the City Council of the
City of Santa 110nica dated Apnl 30, 1992, and pursuant to Municipal Code
Section 2305, the Director of Emergency Services does adopt and the City
Council does approve the followmg rules and regulations are promulgated:
SECTION 1. A curfew is Imposed from dusk to dawn during whIch no
person shall be in any public place In the City of Santa ~fonica unless as follows:
(1) When the presence of such person in a public place is necessary
to go to or from the person's home.
(2) When the presence of such person in a public place is connected
with or required WIth respect to such person's business, trade, professIOn,
occupatlOn or employment in which the person is lawfully engaged.
(3) When the presence of such person in a public place is necessary
to go to or from a lawful public meeting or place of worship.
A person in any pubhc place dunng such period may be stopped and
questioned by any law enforcement officer to determine whether or not such
person IS in compliance with this curfew.
F or purposes of this curfew, public place shall include streets, sidewalks,
parks, beaches, parkmg lots whether publicly or privately owned and any other
place in the City of Santa 1vlonica which is not fully enclosed.
SECTION 2. No person shall sell or dispense any gasoline or other
flammable liqUIds except dUring the normal filling of motor vehicle gasolme tanks
WIthin the CIty of Santa IvlollIca.
SECTION 3. No person shall possess gasoline In any container (other than
a motor vehIcle gasoline tank) in any public place as defined in Section 1 above.
SECTION 4. No person shall sell or transfer any ammunition within the
City of Santa :Momca and no firearm shall be delivered or transferred in the City
of Santa 1\.1omca.
SECTION 5. These restrictIons shall not apply to peace officers,
firefighters, emergency operations orgamzatIons personnel, and national guard or
other military personnel.
SECTION 6. These restnctions shall be effective immedIately and shall
remam In force and effect untIl rescinded by either the CIty Councilor DIrector
of Emergency Services.

SECTION 7. Any violatIon of these restrictions shall constItute a violation
of :Mulllclpal Code SectlOn 2309.
SECTION 8. The following finds support this Emergency Order Number
1: Government Code Section 8634 empowers the City Councilor delegated
officials to provide rules or regulations to protect the public, includmg adoption
of a curfew. A local emergency has been proclaimed and it is extremely difficult
to preserve public safety. This order is necessary to protect public safety because
of the imminent danger to life and property, particularly during hours of darkness.

are cancelled:
(1) Imagine a Circus at Santa l\.10nica Airport on 11ay 2-3, 1992.
(2) Cmco de l\.1ayo at Virginia Park on l\.1ay 2, 1992.
(3) rvlahbu & Conejo Kennel Club Dog Show at the Santa Monica
Civic Auditorium on rvlay 2-3, 1992.
(4) The Fun Zone on Santa :Monica Pier from May 1, 1992, through
1fay 3, 1992.
SECTION 2. These restrictions shall be effective immediately and shall
remam III force and effect untIl rescinded by either the City Councilor Director
of Emergency SerVIces.
SECTION 3. Any vIOlatIOn of these restrictIOns shall constitute a violation
of ~.lulllclpal Code SectIOn 2309.
SECTION 4. The following finds support this Emergency Order Number
2: A local emergency has been proclaimed and It is extremely difficult to
preserve publIc safety ThIS order IS necessary to protect pubhc safety because
of the Immment danger to life and property and the congregation of people in

SECTION 1. All beach parking facilities in the City of Santa Monica and
the parking facilIties on Santa ~lonica Pier shall be closed from 9:00 a.m. on May
1, 1992, to 9:00 a.m. on May 4, 1992. During such hours, no person shall be
present or remam on such beach or pier parking facilities and no person shall park
a vehIcle on such beach or pier parking facllities. The City may issue a permit
or honor previously issued permits to park in such facilities and any person
entering such facilities for the sole purpose of parking a vehicle shall not be in
VIOlatIOn of this order.
From 9:00 a.m. on 11ay 1, 1992, to 9:00 a.m. on May 4, 1992, no person
shall remam on any beach in the City of Santa MOllica If ordered to leave the
beach by any law enforcement personnel.
From 9:00 a.m. on ~1ay 1, 1992, to 9.00 a.m. on ~1ay 4, 1992, no person
shall remam on the Santa ~1onica PIer if ordered to leave the Santa ~10nica Pier
by any law enforcement officer.
SECTION 2. Any violatIOn of these restnctions shall constitute a violation
of ~1uniclpal Code SectIOn 2309 and Government Code Section 8665.
SECTION 3. The followmg findmgs support this Emergency Order
Number 5: A local emergency has been proclaimed and it IS extremely difficult
to preserve publIc safety. This order is necessary to protect public safety because
of the imminent danger to life and property and the congregation of people in
public and private places presents the potential for draining law enforcement
resources.

Pursuant to the Emergency Proclamation issued by the City Council of
the City of Santa rvlonica by Resolution Number 8399(CCS) dated April 30.
1992, and pursuant to Municipal Code Section 2305, the Director of
Emergency Services does adopt the following rules and regulations:
SECTION 1. Emergency Order Number 1, dated April 30, 1992, is
rescinded in its entirety and is replaced by the following provisions.
SECTION 2. The emergency curfew imposed on April 30, 1992 is
rescinded. ThIs rescission does not affect any arrest or prosecution for a
violation that occurred while Emergency Order Number 1 was in effect.
SECTIO~ 3 Ko person shall sell, dIspense or transport any gasoline
or other flammable liquids except during the normal filling of motor vehicle
fuel tank or as is necessary in order to carry out the lawful profession or
occupation of the person obtaining or transporting the gasoline or flammable
liquid within the City of Santa 1lonica.
SECTION 4. No person shall sea or transfer any ammunition within
the City of Santa !vlonica and no firearm shall be delivered or transferred in
the City of Santa 1-lonica.
SECTION 5. These restrictions shall not apply to peace officer, fire
fighters, emergency operations personnel, the national guard or other military
personnel.
SECTION 6. These restrictions shall be effectIve immediately and shall
remain in force and effect until rescinded by either the City Councilor
Director of Emergency Services.
SECTION 7. Any violation of these restrictions shall constitute a
violation of 1Junicipal Code Section 2309.

SECTION 8. The following finding supports this Emergency Order
Number 6: Government Code Section 8634 empowers the City Councilor

SECTION 9 ThIS Emergency Order Number 6 shall be effective on
