Intentlon adopted by the Clty Council on May 28, 1991. belng Resolutlon Number
8229 (CC5): and
WHEREAS, the contract for the above-descrlbed work has been fulfllled
to the satlsfactlon of the Superlntendent of Streets: and
vJHEREAS, the 5upen ntendent of Streets has made an assessment to
cover the sum due for the work performed and spec1fled 1n the contract; and
WHEREAS, the assessment has been flled wlth the Clty Clerk; and
WHEREAS. the City Clerk gave the notlce requlred by Sections 5362 and
5363 of the Streets and Hlghways Code, and
WHEREAS, upon the day and hour flxed for hearlng by the Clty Clerk,
the Clty Councll of the Clty of Santa Monlca heard and passed any and all
obJectlons, appeals, and protests,
NOW, THEREFORE, THE CITY COUNCIL Of THE CITY OF SANTA 1.1ONICA DOES
RESOLVE AS FOLLOWS.
SECTION 1. All obJect1ons, appeals, and protests of every bnd and
nature be to the confirmation of assessment of costs, and the same are hereby,
overruled and denled.

(CCS) and thereln declared to be the property to be assessed to pay the expense
of the lmprovements. 1S approved and the C1ty Clerk 1S dlrected to execute the
cert1flcate on the dlagram certlfYlng such approval and to dellver the dlagram
to the Superlntendent of Streets.

SECTION 5. The assessment roll, warrant, and dlagram shall be
recorded ln the Offlce of the Superlntendent of Streets, and lmmediately
thereafter the Clty Clerk shall flle a copy of the assessment diagram in the
Offl ce of the County Recorder, and thereafter shall record 1 n sa 1 d Offl ce of
the County Recorder a Notlce of Assessment, all ln the manner and form

SECTION 6. Assessments not pald to the Clty wlthln the speClfled
time shall be sent to the Los Angeles County Assessor to collect such
assessments upon the tax roll WhlCh general taxes are collected.

SECTION 7. The Clty Clerk shall certlfy to the adoptlOn of thlS
Resolution, and thenceforth and thereafter, the same shall be in full force and
effect.
