R-8388 e e Attachment C RESOLUTION NO. 8388(CCS) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADOPTING THE EMPLOYER ANNUAL IMPACT FEE FOR THE TRANSPORTATION MANAGEMENT PLAN PROGRAM WHEREAS/ on October 23, 1984 the Santa Monica City council adopted the Clrculation Element of the General Plan, which directed the Cl ty to develop a Transportation system Management Plan to implement the transportation management policies contained in the Circulation Element; and WHEREAS, since adoption of the Circulation Element, the South Coast Air Quallty Management District (SCAQMD), through adoption of Regulation XV, has required reduction l.n the number of home-to- workslte vehicle trips and resultant air pollution for employers wlth 100 or more employees; and WHEREAS I the primary purposes of the Transportation Management Plan (TMP) ordinance are to reduce transportation congestl.on on city streets and to lmprove alX quality through the effective management and coordination of both transportation demand and systems in the city; and WHEREAS, the TMP ordinance goes beyond the requirements of SCAQMD's Regulatlon XV program by covering employers of 10 or more 1 e e employees and requirlng trip reduction programs for both the morning and even1ng peak periods; and WHEREAS, a preliminary draft TMP ordinance was released to the publlC ln March 1989 and a revised draft ordinance was released in March 1991; and WHEREAS, the Flnal Envl.ronmental Impact Report concluded that the lmplementation of the TMP ordinance would not result in any significant environmental impacts and was adopted by the Cl.ty Councl.l on October 29, 1991; and WHEREAS, on March 20, 1991 the Planning Commission approved the TMP ordinance with recommendations to the City Council; and WHEREAS, the TMP ordlnance was adopted by the Santa Monica City council on November 12, 1991 after several years of study and discussion with the business community; residential nelghborhood organizations; and other Clty, county and state jurisdl.ctions; and WHEREAS, the Employer Annual Impact Fee outlined in the TMP ord1nance, whose purpose l.S to pay for the costs of administrat10n and enforcement of the TMP ordl.nance, 1S to be set by separate resolution, 2 e e NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Counci 1 of the city of Santa Monica approves the lmplementation of an Employer Annual Impact Fee as required in the Transportation Management Plan ordinance. SECTION 2. The city Council certifies that the employers of 10-49 employees are required to pay an Employer Annual Impact Fee of eight dollars ($8) per employee. SECTION 3. The city Counc~l certifl.es that the employers of 50 or more employees are required to pay an Employer Annual Impact Fee of SlX dollars ($6) per employee. SECTION 4. The City Council certifies that employers of 100 or more employees are requlred to pay the Employer Annual Impact Fee the first year and all following years as specified in the TMP ordl.nance, while employers of 50 or more employees are required to pay the Employer Annual Impact Fee the second year and all following years, and employers of 10 or more employees are required to pay the Employer Annual Impact Fee for all following years. SECTION 5. The city Councll certifies that employers may achieve fee reductions of up to eighty five percent (85%) by meeting certaln goals and requirements outlined in the TMP ordlnance. 3 e e SECTION 6.
