ORDINANCE NO.1919 (CCS)

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA ORDERING THE SUBMISSION OF
A PROPOSITION TO THE QUALIFIED VOTERS OF THE CITY OF SANTA MONICA,
TO INCUR BONDED DEBT TO CONSTRUCT, IMPROVE AND REMODEL SANTA
MONICA LIBRARY BUILDINGS AND RELATED FACILITIES, AND CALLING AN
ELECTION TO BE HELD FOR THAT PURPOSE
WHEREAS, the City CounCil (the "City CounCil") of the City of Santa Monica (the
City") has adopted, by a two-thirds vote of all the members of the City CounCil, a
Resolution entitled "A Resolution of the City CounCil of the City of Santa MOnica
Determining That the Public Interest and Necessity Demand the Construction,
Improvement and Remodeling of the Santa MonIca Main Library BUIlding, Branch Libraries
and Related FaCilities and Their Financing Through the Issuance of General Obligation
Bonds" (the "Resolution"), and
WHEREAS, In order to prOVide for the Issuance by the City of Its general obligation
bonds to finance the capital Improvements desCribed In the Resolution, It IS necessary for
the City CounCil to pass an ordinance ordering the submission of the propOSition of

Incurring bonded Indebtedness to the qualified voters of the City at an election held for that
purpose, and
WHEREAS, the City Council desires to submit such a proposition to the qualified
voters of the City at a special mUnicipal election to be held In the City on November 3,
1998,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES ORDAIN AS FOLLOWS
SECTION 1 The City Council orders submitted to the qualifIed voters of the City,
at a special municipal election to be held In the City on November 3, 1998, the proposItion
set forth below In substantially the follOWing form

The proposition submitted by this Ordinance shall be designated on each ballot by a letter
printed on the left margIn of the square containing the descnptlon of the proposition, as
prOVided In Section 13116 of the California Elections Code
SECTION 2 The object and purpose of Incurring the Indebtedness IS to finance a
capital Improvement program to construct, Improve and remodel the main Library bUilding,
branch Library bUildings and related faCIlities (the "Capital Improvements") as set forth In
the Resolution of NeceSSity
SECTION 3 The estimated cost of the Capital Improvements IS Twenty-Five Million
Dollars ($25,000,00000) ThiS estimated cost Includes legal and other fees, costs of
printing the bonds and other costs and expenses Incidental to or connected With the
Issuance and sale of the bonds
SECTION 4 The amount of the pnnclpal of the Indebtedness to be Incurred IS not
to exceed Twenty-Five Million Dollars ($25,000,000 00)
SECTION 5 The maximum rate of rnterest on the Indebtedness shall be twelve
percent (12%) per annum, or such higher rate as may hereafter be established for general
obligation bonds of the City by the Legislature of the State of California

SECTION 6 The date of the special electIon which IS hereby called and ordered
to be held, shall be November 3, 1998
SECTION 7 Except as otherwise provided In thIS Ordinance, the special mUnicipal
election shall be held and conducted, election officers appointed, voting precincts
designated, ballots printed, polls opened and closed, ballots counted and returned, returns
canvassed, results declared, certificates of election Issued and all other proceedings
InCidental to and connected with the special mUnicipal election shall be regulated and
done, In accordance with the prOVIsions of law regulating the statewide election to occur
on November 3, 1998, with which statewide election the special municipal election called
hereby IS to be consolidated, as proVided In a Resolution entitled "A Resolution of the City
Council of the City of Santa Monica Requesting the Board of Supervisors of the County
of Los Angeles to Consolidate a Special Municipal Election of the City of Santa Monica to
be Held on November 3, 1998, related to Library bonded Indebtedness with the Statewide
General Election to be Held on Said Date Pursuant to Elections Code Section 10403"
Ballots for the election shall be proVided In the form and In the number provided by law
On these ballots, In addition to any other printed matter which may be required by law, two
voting squares shall be set off to the right of the proposition submitted at the election, In
the manner proVided by law, one haVing the word "YES" pnnted before it, and the other
haVing the word "NO" printed before It Each voter to vote for the proposition and for the
Incurnng of said Indebtedness shall stamp or write a cross, or indicate by hole punch or
other means, In the blank space opposite the word "YES" on the ballot to the nght of the

proposition, and each voter to vote against the proposition and against the Incurring of the
Indebtedness shall stamp or wnte a cross, or Indicate by hole punch or other means, In the
blank space opposite the word "NO" on the ballot to the fight of the propositIOn
SECTION 8 This Ordinance shall be adopted upon a vote of no less than two-
thirds of all members of the City Council
SECTION 9 This Ordinance shall take effect upon adoption, as provided In Section
619(a) of the City Charter
SECTION 10 The Mayor shall sign and the City Clerk shall attest to the passage
of thiS Ordinance Pursuant to Government Code Section 43611, the City Clerk shall
cause the same to be published In full once a day for at least seven (7) days In a
newspaper published at least SIX days a week In the CIty, or once a week for two weeks
In a newspaper published less than SIX days a week In the City The first of said
publications shall be within fifteen (15) days after adoption of thiS Ordinance
