O1886 PCD SF OM f \plan\share\councll\ord\rvc Council Mtg September 23, 1997 Santa MOnica, California ORDINANCE NUMBER 1886 (ecs) (City CouncIl Senes) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING ZONING ORDINANCE SECTION 90408 12040 TO ALLOW OFFICE USES IN THE RVC DISTRICT TO BE LOCATED WITHIN UP TO 25% OF THE GROUND FLOOR STREET FRONTAGE, SUBJECT TO THE APPROVAL OF A CONDITIONAL USE PERMIT WHEREAS, on May 22,1997, an apphcatlon was filed for a Zoning Ordinance Text Amendment to modify Section 9 04 08 12040 of Article IX of the Santa MOnica MUnicipal Code to allow office uses In the RVC Dlstnct to be located In the ground floor street frontage, subject to the approval of a conditional use permit, and WHEREAS, the Planning Commission held a public heanng on the proposed ZOning Ordinance Text Amendment on July 16, 1997, and recommended City Council adoption of the amendment, and WHEREAS, The City Council held a public heanng on the proposed Zoning Ordinance Text Amendment on September 9, 1997, and WHEREAS, the City Council fmds and declares that the proposed amendment IS consistent In pnnclple With the goals, obJectives, poliCies, land uses, and programs specified In the adopted General Plan In that allowing ground floor office uses only with a Conditional Use Permit will ensure that office uses are only allowed In locations where the Planning CommissIOn, or City CouncIl on appeal, can make the required Conditional Use Permit findings which will ensure that an office use does not negatively Impact the surrounding area Furthermore, Ilmltmg the amount of ground floor street frontage which can be used as office space to 25% will ensure that 75% of the ground floor street frontage IS devoted to pedestrian oriented uses, which IS consistent With Land Use Element Policy 1 54 which IS to "encourage day and night pedestrian activity along the street frontage on Main Street, Ocean Avenue and the Promenade", and WHEREAS, the City Council finds and declares that the public health, safety and general welfare requires the adoption of the proposed Ordinance In that allowmg office uses In up to 25% of the ground floor frontage of a parcel wIll accommodate Situations where the Planning Commission, or City Council on appeal, finds that ground floor office uses are appropnate, and limiting the amount of ground floor office uses to 25% of a parcel will ensure that the majority of the parcells devoted to pedestnan onented uses NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY ORDAIN AS FOLLOWS SECTION 1 Section 90408 12040 of the Santa MOnica MUnicipal Code IS amended to read as follows 2 9 04 08 12 040 Conditionally permitted uses The following uses may be permitted In the RVC District subject to the approval of a Conditional Use Permit (a) Bed and breakfast facIlitIes (b) Child day care centers (c) Eating and drinking establishments permItting alcoholiC beverages (d) General offices uses, except Within the ground floor street frontage such uses may not exceed 25% of the parcel Width or 1,000 square feet whichever IS less (e) Hotels and motels (f) Outdoor dIsplays and sales of the follOWing Items on private property adjacent to either The Promenade or the streets between The Promenade and Appian Way (1) Artwork and pottery. (2) Flowers and plants (3) Handcrafted products and goods (4) Recreational equipment rentals such as rollerskates, bicycles, and surfboards (5) Any other Items determined by the Zonrng Administrator to be Similar to those listed above (g) Parking faCIlities 3 (h) Shelters for the homeless (I) Theaters only In the Pier Overlay SECTION 2 Any provIsion of the Santa MOnica MUnicipal Code or appendices thereto inconsistent with the provIsions of thiS Ordinance, to the extent of such inconsistencies and no further, IS hereby repealed or modified to that extent necessary to affect the provIsions of thiS Ordinance SECTION 3 If any section, subsection, sentence, clause, or phrase of thIS Ordinance IS for any reason held to be Invalid or unconstitutional by a decIsion of any court of competent JUriSdiction, such decIsion shall not affect the validity of the remaining portions of thiS Ordmance The City Council hereby declares that It would have passed thiS Ordinance and each and every section, subsection, sentence, clause, or phrase not declared Invalid or unconstitutional without regard to whether any portion of the ordinance would be subsequently declared Invalid or unconstitutional 4 SECTION 4 The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance The City Clerk shall cause the same to be published once In the official newspaper within 15 days after ItS adoption This Ordinance shall become effective 30 days from ItS adoption APPROVED AS TO FORM ~hf~-' MARSHA 19NES MOUi-~~ City Attorney 5 ~t:~ Robert Holbrook.
