AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING ZONING ORDINANCE
SECTION 9 04 08 15 040 TO ALLOW GENERAL OFFICE USES ON THE GROUND
FLOOR IN THE FRONT 75' OF A PARCEL WITH THE APPROVAL OF A
CONDITIONAL USE PERMIT IN THE BSC-2, BSC-3 AND BSC-4 PORTIONS OF THE
BAYSIDE COMMERCIAL DISTRICT
WHEREAS, on May 28,1997, the Planning Commission approved a Resolution of
Intention to modify SectIon 9 04 08 15 040 of Article IX of the Santa MOnica MUnicipal
Code to allow general office uses on the ground floor In the front 75' of a parcel With the
approval of a Condlttonal Use Permit In the BSC-2, BSC-3 and BSC-4 portions of the
Bayslde Commercial Dlstnct, and
WHEREAS, the Planning Commission held a public heanng on the proposed Zoning
Ordinance Text Amendment on July 16, 1997, and recommended City CounCil adoption
of the amendment, and
WHEREAS, The City CounCil held a publiC heanng on the proposed Zoning
Ordinance Text Amendment on September 9, 1997, and
WHEREAS, the City Council finds and declares that the proposed amendment IS
consistent In principle with the goals, obJectives, policies, land uses, and programs
specified In the adopted General Plan In that allowing ground floor office uses only with a
Conditional Use Permit will ensure that office uses are only allowed In locatIons where the
Planning Commission, or City Council on appeal, can make the required Conditional Use
Permit fmdlngs which will ensure that an office use does not negatively Impact the
surrounding area Furthermore, allowing such uses with a Conditional Use Permit will
ensure consistency with land Use Element Policy 1 34 which reqUires that "a maJonty of
ground floor street frontage on a block by block basIs be active pedestnan-onented use In
order to promote pedestrian activity at the ground floor",and
WHEREAS, the City Council finds and declares that the public health, safety and
general welfare requires the adoption of the proposed Ordinance In that the proposed
ordinance wIll allow the Plannmg Commission, or City Council on appeal, to approve a
Conditional Use Permit to allow ground floor office uses In situations where they find that
a ground floor office use will not negatively Impact the surrounding area
NOW, THEREFORE THE CITY COUNCil OF THE CITY OF SANTA MONICA
DOES HEREBY ORDAIN AS FOllOWS
SECTION 1 Section 9 04 08 15 040 of the Santa MOnica MUniCipal Code IS
amended to read as follows

9 04 08 15 040 ConditIonally permitted uses
(2) The following uses may be permitted In the BSC-2, BSC-3 and
BSC-4 portions of the BSC DIstrict, subject to the approval of a conditional use permit
(a) Automobile parking lots and structures
(b) Bars, subject to the limitations contained In Section
9 04 08 15 080
(c) Billiard parlors
(d) Bowling alleys
(e) Cinemas
(f) Clubs and lodges
(g) Convention and conference faCIlities
(h) General offices uses on the ground floor In that portion of a
parcel between 25' and 75' from the front parcel line
(I) Homeless shelters With fifty-five beds or more
0) Hotels and motels
(k) Nightclubs, subject to the limitatIons contained In Section
9 04 08 15 080
(I) Open-air farmers markets
(m) Skating rinks
SECTION 2 Any provIsion of the Santa MOnica MUniCipal Code or appendIces
thereto inconsistent With the provIsions of this Ordinance, to the extent of such

inconsIstencies and no further, IS hereby repealed or modified to that extent necessary to
affect the provIsions of this Ordinance
SECTION 3 If any section, subsection, sentence, clause, or phrase of this
Ordmance IS for any reason held to be Invalid or unconstitutional by a decIsion of any court
of competent JUriSdictIon, such decIsion shall not affect the validIty of the remamlng
portions of this Ordmance The City Council hereby declares that It would have passed this
Ordmance and each and every section, subsection, sentence, clause, or phrase not
declared Invalid or unconstitutional Without regard to whether any portion of the ordmance
would be subsequently declared invalid or unconstitutional
SECTION 4 The Mayor shall sign and the City Clerk shall attest to the passage of
this Ordinance The City Clerk shall cause the same to be published once m the official
newspaper Within 15 days after Its adoption ThiS Ordinance shall become effective 30
days from ItS adoption
